reese witherspoonActress Reese Witherspoon and her husband Jim Toth were both arrested following a DUI incident on April 19, 2013 in Atlanta Georgia. The incident occurred early Friday evening after a state patrol officer observed the vehicle being driven by Toth weaving in and out of lanes. After pulling the couple over, the officer noticed that Toth displayed several symptoms of alcohol intoxication such as red, glassy bloodshot eyes, droopy eyelids and had an odor of alcohol about him. According to the trooper, Toth admitted to having had a drink at a restaurant a couple hours prior to being pulled over.

In his report, the officer said that Witherspoon initially got out of the vehicle when her husband began performing a series of field sobriety tests, but got back in after being told by the officer to do so. The officer adds that when Witherspoon got out of the vehicle a second time, he told her she would be arrested if she did it again. It was at that time that the actress, who was intoxicated as well, began to hang out of the window saying she didn’t believe he was a real officer. Officer Pyland wrote in his report, “I told Mrs. Witherspoon to sit on her butt and be quiet“. After performing an alcohol breath test, Pyland found that Toth had a blood alcohol content (BAC) level of .139% and placed him under arrest for DUI. It was at that time that Reese Witherspoon got out of the car and asked the officer, “Do you know my name?“, to which he replied, “No, I don’t need to know your name right now“. Then, Witherspoon told officer Pyland that he was about to find out who she was and that he’d be on national news. Pyland says “I advised Mrs. Witherspoon that was fine“. Officer Pyland proceeded to arrest the actress as well and both were taken to jail. Witherspoon was charged with disorderly conduct and released in time to make it to a movie premiere on Sunday in New York.

Reese Witherspoon has since released a statement apologizing to the officer for her actions. In the statement, Witherspoon says “I clearly had one drink too many and I am deeply embarrassed about the things I said,” Witherspoon said. “It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I’m very sorry for my behavior“.

WFAA reported that a sheriff’s deputy in North Texas has died and authorities have arrested a repeat drunk driver for allegedly hitting him while he was directing traffic. According to the Grayson County Sheriff’s Office, Ricky Trent Stanley ran over Deputy Chad Christian Key, on Saturday evening while Key was directing traffic near U.S. Highway 82.  Stanley, who is a local from Whitesboro, was arrested after fleeing the scene of crime. Key, who had only been on patrol duty for about two months, was immediately taken to the the local hospital and pronounced dead. He left behind his wife and three sons with ages 20, 10, and two months. It was noted that drunk driver Stanley, of 28 years old, had two previous DWI charges but was let out in August after paying a $10,000 bond. Stanley’s drunk driving test results have not been released, and the bond has not been set to include the new charges:  intoxication manslaughter of a peace officer, failing to stop and render aid, driving with an invalid license, and unlawfully carrying a weapon.

The New York Post claimed that Al Michaels, legendary sports broadcaster, was busted for drunken driving in Los Angeles Saturday night after being pulled over for an illegal U-turn. Richard Lewis, Santa Monica police sergeant, stated that Michaels, who is 68 years old, was driving east near Pico Boulevard approximately at 9:30 p.m. when officials spotted him making an illegal U-turn. Police officials immediately stopped Michaels, who was driving a Mercedes vehicle. Lewis also added that Michaels smelled of alcohol and had slurred speech before failing field-sobriety tests, however, he was described as cooperative. It was noted that Michaels became globally recognized when he participated as the broadcaster for the U.S. Hockey Team, which really angered the Soviets, in the 1980 Winter Olympics in Lake Placid. Michaels’ “Do you believe in miracles? Yes!” quote is still memorable today. It was reported that he is currently broadcasting “Sunday Night Football” on national television for NBC.

MyNorthwest.com reported updates on their blog about the health of Elias and Karina Schulte, the victims involved in a Seattle DUI crash that occurred earlier this month. Elias, a one month old baby, and his mother, Karina, were the only survivors from the accident. They were crossing a Seattle street along with Elias’ grandparents, who were killed, when a drunk driver (Mark Mullan) hit them with his car. Elias and Karina were taken to the hospital under critical condition and are still receiving medical care. It was stated that Elias received brain damage, while Karina suffered from a fractured pelvis and hip, and torn ligaments in one of her knees. Dan Schulte, Karina’s husband, told sources that after being at the hospital for several weeks now, both Karina and Elias have improved. He commented, “Elias is now breathing on his own, without the breathing tube…he looks and acts just like a newborn should…his cries are a little softer and squeakier than if he were at his best, it’s clear he’s trying to jump start his recovery too.” It was noted that the family has received about $63,000 in donations from individuals from all over the nation that are supporting them. Although Mullan has continued to plead “not-guilty” for his DUI and vehicular homicide charges, prosecutors are working very diligently to punish him. If convicted, he faces a sentence range of 15 to 19.5 years in prison, but prosecutors are pushing for a longer sentence.

The Statesman Journal reported that Adam Roth, a North Salem High School student, was charged with a DUI after crashing his car into a house in the 1200 block of Market Street NE around 12:30 p.m. Tuesday. In addition to the DUI, Roth also received charges for driving recklessly and jeopardizing the lives of the three passengers that were riding with him. It was said that Roth and three other students were driving back to school from their lunch break when he crashed into the house. One of the passengers, Zack Rosenblatt, told sources that Roth’s head kind of went down. Roth, who was driving a 1968 blue Ford Mustang, accelerated past a stop sign, ran through a raised yard, and crashed into a house, damaging the siding and a water spigot.

Lieutenant Keith Blair stated that Roth had been smoking spice prior to the accident which impaired his ability to drive. Sources defined “spice” as a mix of various herbs that is sold as “synthetic marijuana”. In addition, Blair stated that spice has become increasingly popular among young individuals during the last couple of years. Luckily, none of the passengers received injuries. On the other hand, Roth received minor injuries and was taken to the Salem Hospital. It was noted that initially police officials thought the vehicle accident was related to a medical condition, however, after questioning Roth at the hospital, they learned that he had been DUI.

dont drink drive signA repeat DUI offender in Island County, Washington will soon be sentenced after pleading guilty to 3 separate drunk driving incidents occurring in 2008 and 2012. Joe Clyde, the repeat DUI offender, was first arrested for DUI in 2008 and was later enrolled in a deferred prosecution program. Then, in 2012, Clyde was arrested on August 9 after crashing his vehicle, ironically, into a “Please Don’t Drink and Drive” sign while driving on Highway 525.

When he was arrested that night, police found his blood alcohol content (BAC) level to be .20%, more that double the legal limit of .08%. Clyde was released shortly after his arrest, however, less than 24 hours later police arrested the repeat DUI offender once more after spotting him driving erratically on the road. Police reported that Clyde was driving a different vehicle during the second incident and found his BAC level to be .21%. Currently, prosecutors with Island County are recommending a 3 year sentence for Clyde.

The incident happened at around 2 am after deputies responded to a call about a vehicle swerving between lanes. When deputies spotted Gallardo, he was going 40 mph in a 55 mph zone and upon pulling him over, said that he was “very cooperative“. According to police, Gallardo displayed several symptoms of alcohol intoxication such as having an odor of alcohol, red, glassy eyes and slurred speech.

According to a police report, Gallardo was asked to perform a series of field sobriety tests, which he failed. When police conducted an alcohol breath test, they found the Brewers pitcher had a blood alcohol content (BAC) level of .22%, which is nearly 3 times the legal limit of .08%. Police said that Gallardo quickly admitted to having a “couple of beers“. After Yovani Gallardo was arrested, the Milwaukee Brewers issued a statement saying, “We have been made aware of the situation with Yovani and we take this matter very seriously. We have expressed our disappointment to him and know he understands that behavior of this nature is of great concern to everyone in the organization. Yovani has acknowledged the seriousness of this incident and is taking full accountability for his actions“.

lapdTwo LAPD officers accused of lying under oath about a DUI arrest made 3 years ago in Highland Park began their criminal trial this week. Craig Allen and Phillip Walters were charged with perjury and falsifying a police report in 2012. Walters is currently on suspension from the police force while Allen has since been fired. The DUI stop in question happened 3 years ago after Officer Cecilio Flores made a DUI stop and asked both Walters and Craig to assist him. Since Craig and Walters were on the DUI task force that night, Cecilio later handed off the stop to them, often called a “gimme”.

The remainder of the stop was fairly routine, with the driver being given field sobriety tests, arrested and then taken to jail. The problem arises in the police report, where according to prosecutor Rosa Alarcon, Allen wrote he was “in the area when they observed and pulled over the vehicle. He didn’t mention Flores“. Alarcon said that Allen later testified at another hearing and admitted to never having personally observed the offense happening. Allen’s attorney has said that his client had “no motive” for lying and that the error on the the police report was just that, a mistake. With regard to the perjury case, LAPD Police Chief Charlie Beck said, “I do not believe that their intent was evil, just extremely misguided. The character of our organization is defined by the conduct that we condone. These actions were entirely unacceptable“.

nick sizemoreNicolas Wade Sizemore, a senior football player with Kansas University was arrested on April 14, 2013 on suspicion of DUI and leaving the scene of an accident. The arrest took place early Sunday morning after Sizemore was stopped by police for driving without his headlights on. The arrested officers suspected the Kansas University football player of alcohol intoxication and also believe that he struck a parked vehicle just minutes before being pulled over.

Sizemore was taken to Douglas County Jail after his arrest on suspicion of DUI and leaving the scene of a non-injury accident, however, it is unclear at the time if he failed to pass any field sobriety tests or submitted an alcohol breath test. Sizemore was later released from jail on a $700 bond with a notice to appear in court on May 1, 2013. According to Kansas University head coach Charlie Weis, Sizemore, who plays as a tight end, has been suspended for the first 3 games of the 2013 as a direct result of the DUI arrest. Weis stated that Sizemore’s DUI arrest was a violation of team rules and said “As I have previously stated, every player on our team knows and understands our rules and regulations. They also know the consequences for violations“.

The Chicago Tribune reported that Daniel Magana, a drunk driver in Hammond, Indiana, was charged with a DUI after colliding with a police SUV and injuring two police officers and a passenger that was in the vehicle at that moment. It was stated that Magana admitted he had drunk about 14 beers.  The police SUV was allegedly stationed in a local street when Magana struck it head-on, at about 4 a.m. Hector Alfaro, who is the Police News Affairs Officer, stated that the police officers had been completing paperwork from another traffic crash. The passenger that was sitting in the back seat of the police SUV, at the time of the accident, and one of the police officers were taken to Northwestern Memorial Hospital. The other police official was taken to Advocate Illinois Masonic Medical Center. It was confirmed that they were all stable and did not receive serious injuries.

A police report stated that Magana told police he had been drinking and had fallen asleep at the wheel. He was arrested and taken to the Near North District police station. Police officers stated that Magana had difficulty trying to maintain his posture and taking an alcohol breath test. He told police he’d had the 14 cups of beer while at the Cubs game Saturday at Wrigley Field and after the game at the home of a friend. Magana’s blood alcohol content level marked up to be .0193, which exceeds Chicago’s legal limit of .08. He received various charges: two misdemeanor DUIs, one misdemeanor for reckless driving, and another for violating traffic laws.
