Massachusetts Principal Stephen Gross Gets Jail For 3rd DUI

IMAGE DESCRIPTIONStephen Gross, a former principal with Robinson Middle School in Lowell, Massachusetts, was found guilty of a third drunken driving offense and sentenced to serve 18 months in prison. Gross was convicted Wednesday February 20, 2013 and found guilty of Operating Under the Influence, which is a similar offense to DUI in Massachusetts, as well an open-container violation. Gross will also lose his driver’s license for 8 years and was originally sentenced to serve 2 1/2 years in jail, but the balance was suspended for 3 years while he is on probation. Gross has been replaced since being placed on administrative leave after being arrested in September 2011 by Mirrimac police and according to Superintendent Jean Franco, his contract was not renewed. Gross was arrested after police responded to a call from someone at a local barbershop claiming to have seen a man getting out of his vehicle and dropping a bottle of whiskey.

When police arrived at the scene, Gross was just returning to his Camry with some items he purchased at Francesca’s variety store. When they approached Gross, officers noticed several symptoms of alcohol intoxication such as red, glassy eyes and an odor of alcohol on Gross’s breath. Gross agreed to let an officer retrieve his wallet from the center console of the Camry and that is when the officer found a half full plastic cup of whiskey, a half full bottle of whiskey as well as a bottle of ginger ale on the passenger side floor. Officers then placed Stephen Gross under arrest and asked him to submit a breathalyzer test, which showed his blood alcohol content (BAC) level to be .13%, almost double the .08% legal limit. Police continued to search Gross’s vehicle and found a duffel bag with four more bottles of Jim Beam whiskey. Gross’s defense attorney argued that there was no probable cause to arrest his client since he didn’t appear intoxicated and was not behind the wheel or driving erratically. Gross has been convicted of drunken driving before, once in 1991 and again in 2000.

ABC News reported that a Utah state trooper, Lisa Steed, has been fired from the Utah Highway Patrol and is facing a lawsuit for filing false DUI charges and arrests. Steed was at one point the most celebrated Utah state trooper for her ability to garner hundreds of arrests, setting records, earning praise as a rising star and becoming the first woman to become trooper of the year. It was noted that in 2009, she broke the state record for DUI arrests by filing about 400 DUI arrests, which was more than twice the average amount that other state troopers declared.

However, in 2012, Steed was on the stand in a DUI court case and admitted to purposely leaving her microphone in her patrol car so that superiors wouldn’t know she was violating agency policy. Then, in April 2012, a prosecutor refused to continue prosecuting DUI cases if Steed’s testimony was the only evidence available. One of Steed’s victims, Michael Choate, told ABC News that she stopped him for wearing a Halloween costume and booked him even though three breathalyzers tests showed no alcohol in his system. Choate stated that because of this he spent $3,800, had to take four days off of work to get his DUI charged dismissed, and nearly lost his security clearance and job as an aircraft logistics specialist at Hill Air Force Base.

Attorney Michael Studebaker said that although the lawsuit against Steed only involves two defendants, dozens of others are lined up and willing to tell their stories and requesting the lawsuit be broadened into a class action lawsuit. They claim that Steed’s behavior has negatively and severely impacted their personal lives and caused them a lot of expense to get them fixed. In addition, the lawsuit extended towards the Utah Highway Patrol for ignoring Steed’s patterns of higher-than-normal DUI bookings and waited too long to take her off patrol.

jack swaggerWWE westling star Jack Swagger was arrested for DUI and drug possession on February 19, 2013 in Gulfport, Mississippi. Swagger, whose real name is Donald Jacob “Jake” Hager Jr., was pulled over just around midnight in Gulfport for speeding when the officer found a small amount of marijuana in his possession. While questioning Swagger, the officer suspected that the wrestler might be under the influence of alcohol, although, it is still unclear what Swagger’s blood alcohol content (BAC) level was. According to Lt. Craig Peterson, Swagger was stopped on the northbound side of Lorraine Rd six miles south of I-10. Jack Swagger had apparently just finished taping an episode of WWE Smackdown in Biloxi at the Mississippi Coast Coliseum. Lt. Peterson also said that Swagger’s vehicle was towed and that the WWE star was released to a friend after being released at the police station.

Swagger is set to appear in court on March 12 for misdemeanor charges. Even though the charges are misdemeanors, city prosecutor Kirk Clark says, “We have never recommended mere fines and fees only on a DUI. We always recommend the maximum sentence of two days in jail for first offenders. That time can be suspended but only on completion of certain court-ordered conditions like probation, classes, AA meetings, etc.“. If convicted, Swagger could have to pay $188 for driving 10 mph over the speed limit, $1,300 for a first time DUI and $437 for possession of a small amount of marijuana. Swagger could also have to complete a Victim Impact Panel should he be convicted. An official spokesman for the WWE said that “Mr. Swagger is responsible for his own personal actions“. Before becoming a professional wrestler, 260 pound, 6 foot 7 Jack Swagger played football and wrestled for the University of Oklahoma.

amy bovenizerMelrose Place actress Amy Bovenizer was sentenced to 3 years in prison on February 14, 2013 after being found guilty of vehicular manslaughter and assault by auto. In June of 2010, Bovenizer was involved in a fatal DUI accident that killed Helene Seemen and critically injured her husband Fred. The sentence was considered a lighter sentence given the fact that Bovenizer could have served 5-10 years in prison had she been convicted of vehicular homicide, not manslaughter. Superior Court Judge Robert Reed noted in his decision that he didn’t feel sympothy for Bovenizer, although, he decided on the 3 year sentence due to the fact that the Melrose Place actress has a young daughter that’s fighting Crohn’s disease.

Prosecutor Geoffrey Soriano will be appealing the decision and said “It is the position of this office that the judge mistakenly applied the law in sentencing this defendant. The filing of this appeal is the very least, we believe, to which the victim’s family is now entitled“. Both Ford Seemen and his son, Ford, shouted at Judge Reed for what they believed to be an unjust sentence. Fred Seemen, who could hardly control his outrage, shouted “Having a sick child doesn’t give you a pass to kill my wife!“. Before the sentencing, Amy Bovenizer said that she would spend the rest of her life making sure people understand the consequences of drinking and driving. In an apologetic statement, the actress said “I hope you believe that I never intentionally set out to put anyone at risk that night. Please know that the reality that I did cause you such loss haunts me every day and it will continue to for the rest of my life”.

Huffington Post reported that Todd Helton, MLB Colorado Rockies player, fought tears as he apologized Sunday and asked for forgiveness at the start of spring training for his recent DUI charge and arrest. He sincerely apologized to his community, family, and team. Helton said, “Last week I got behind the wheel of my truck after I had drank. All I can do now is apologize and ask for forgiveness. I spoke to my teammates today and they were very supportive.” In addition, he also expressed gratitude to his family, wife, and teammates for their support. Helton did not make any comments on the type of treatment that he will be receiving.

Helton’s manager, Walt Weiss, stated his support for Helton and commented, “…Todd’s built up a lot of goodwill and respect with this club and in the community.” Towards the end of a practice, Helton signed autographs from fans and claimed that he understands its going to take work to repair his image with his fans. Comedian Killed in DWI Crash

The Durham Herald Sun reported that Brian Edward Kiley, a Tennessee stand-up comedian, was killed in a DWI car crash on Sunday. It was stated that Kiley, 38 years old, was driving east on I-40 about 3:40 a.m. and was just past the N.C. 54 interchange when Raul Herrera, who also was driving east, swerved and hit Kiley’s Nissan Maxima. The impact caused both vehicles to go off the road and overturn.

Durham police officials stated that Herrera, 31 years old, received a couple of minor injuries and was sent to the hospital. He was charged with a DWI. Kiley was pronounced dead at the scene of the accident. Durham police department closed the accident section and detoured traffic in order to finish investigation procedures. A tow truck was called to remove Kiley’s heavily damaged black four-door car from the interstate. Police reported that both vehicles were total losses.

Kiley had just finished performing at the Newton-Conover Auditorium with Jon Reep, who is a comedian best known for his role in the Dodge commercial asking  “That thing got a hemi?” J.J. Brent, a close friend of Kiley, told sources that Kiley had  just married the love of his life a few short months ago and that he took parenting with great love in his heart. In addition, Brent mentioned that Kiley was a very spiritual individual, always involved with his church, and with high values. His familiy is deeply grieving his death.

TV Guide reported that the mother of Phillip Phillips, who is a famous singer and winner of American Idol’s eleventh season, was arrested and charged with a DUI this past Wednesday. According to Seattle Post Intelligencer, Mrs. Phillips was stopped by an “undercover unit” that spotted her swerving across lanes of traffic in Albany, Georgia.  It was stated that police officers administered her several field sobriety tests, all of which she failed. In addition, officers suspected that she might have been under the influence of drugs as well. Mrs. Phillips was sent to the hospital, where she was diagnosed as healthy enough to go to jail. It was noted that Phillips has had a lot of trouble and personal public issues with his family, such as refusing to help his parents out financially and they were forced to sell their family-owned pawn shop.

Former Senate Staff Member Gets DWI

KARE reported that a former Minnesota senate staff member, Michael Brodkorb,  was charged with DWI after a single vehicle crash in the east metro that left him hospitalized. Police officials determined that Brodkorb’s blood alcohol level had been .10 the night of the accident. Investigators said Brodkorb ran off I-35E in Mendota Heights and struck the wall of a bridge before careening across the northbound lanes and into the median wall.

Brodkorb received serious injuries and was sent to Regions Hospital. He received charges for DWI, negligent driving, and driving without a seatbelt. The first three counts are misdemeanors punishable by $1,000 fine and/or 90 days in the county jail. The no seat belt charge is a petty misdemeanor subject to a $300.00 fine. It was noted that this was not Brodkorb’s first time in dealing with media attention. He had made headlines after he sued the Minnesota State Senate for dismissing him in the wake of a highly publicized affair with then-Senate Majority Leader Amy Koch.

Drunk Driver Causes Two Wrong-way Accidents In Fort Worth

Dallas Morning News reported that this morning Fort Worth police officials were involved in a very dramatic chase on Fort Worth’s I-35W Highway. They chased drunk driver, Jessica Roseman, with emergency lights flashing and public address system blaring, “all to no avail.” The news source stated that police officials were able to finally stop her with a stop stick, which flattened one of her front tires, causing her to crash into an abandoned police car stationed on the highway as a roadblock.

Police officials started the chase approximately around 3 a.m. after receiving various calls that a driver in a brown Ford Taurus was southbound in a northbound lane of the South Freeway. Roseman, who was speeding the wrong-way at 90 mph with her lights off, caused two car accidents. In the first crash, a white passenger car veered out of the Taurus’ way to avoid a head-on collision and hit a retaining wall. It was determined that one of the victims received minor injuries and another had a bloody nose and  chest pains, both were sent to the hospital. Next, the Taurus side-swiped a blue Chevy Suburban near East Berry Street. Luckily, nobody received any injuries in this crash.

The chase ended after police officials, who were patrolling from a helicopter and contacted Burleson police, put down spikes on the freeway to flatten the vehicle’s tires. It was reported that Roseman did not receive any injuries, but was still taken to the hospital for several blood alcohol content tests.

Giants Football Player, David Diehl, Pleads Guilty to DWI Charges

WABC news reported that David Diehl, the Giants lineman, pleaded guilty this morning to aggravated DWI and impaired driving charges. It was reported that Diehl admitted to a Queens judge that he drove a black BMW into two parked cars on 31st Street in Astoria on June 10. Diehl’s DWI charges have the possibility of getting dismissed if he complies with the penalties of completing two drunk driving programs, paying a fee of $1,200 to the owners of the car he hit, doesn’t break the law, and wears a SCRAM bracelet during the following 90 days. It was noted that Diehl could have faced up to a year in jail for his crimes.

Diehl’s attorney, Gary Certain, reported that Diehl is currently receiving treatment from the NFL’s DWI treatment program, and that he is not allowed to drive or apply for a driver’s license for the next six months. The New York Post stated that before Diehl was released from the court hearing, the judge scolded him by saying, “Sir, please don’t drink and drive. Look what happened here, you could have been seriously hurt.”
