Randy Travis Receives Penalties for DWI

Rolling Stone reported that country singer, Randy Travis, “pleaded guilty to a driving while intoxicated charge stemming from a dramatic incident last August where he crashed his car and was found naked on a Texas highway.” Consequently, Travis received multiple penalties for his DWI case. It was determined that Travis received a 180 day jail sentence, which can be suspended if he doesn’t break the law within his 2 year probation period. In addition, he has to pay a $2,000 fine, spend at least a month’s time in a rehabilitation center, work through 100 hours of community service, and install an ignition interlock device on his vehicle.

Other sources reported that Travis “left the courtroom noting that he was grateful for his supporters, and relieved to have the case behind him.” In addition, Travis’s attorney told the media that Travis has been trying to stay sober. Travis’s DWI case has definitely been one of the “most serious in his recent string of tangles with the law.” Travis faced other DWI accusations throughout the year. Critics don’t believe that Travis’s charges will have any negative effects on his new album and its tour dates, which are set to be planned through the month of August.

bryan wendlerRepeat DUI offender Bryan Wendler was arrested for his sixth DUI on January 19, 2013 in Franzen, Wisconsin. According to police, Wendler was arrested around 1 a.m. after being found passed out behind the wheel of his car with a six pack of beer sitting in the passenger seat beside him. When an officer with the Sheriff’s Department approached the vehicle, in the middle of the road, it was still running and the music was apparently still playing loudly. The officer proceeded to wake Wendler, who was still asleep in spite of the blaring music and noticed immediately that the repeat DUI offender seemed “dazed and confused”. The officer then asked Wendler to exit the vehicle and perform a series of field sobriety tests, which he did not pass.

After failing the sobriety tests, the officer requested that Wendler submit a breathalyzer test. That test revealed Wendler’s blood alcohol content (BAC) level to be .19%, more than double the legal limit of .08%. Ironically, Wendler happened to be wearing a joke t-shirt that reads, “Been Drinking? Free Breathalyzer Test – Blow Here”, with an arrow pointing down torward his crotch. The officer then placed Wendler under arrest and transported him to Saint Claire’s Hospital to have his blood drawn for further BAC tests. Wendler, a repeat DUI offender, will be facing his sixth DUI charge as well as a probation violation and driving while license revoked. Wendler’s preliminary hearing is scheduled for January 30.

carmine giovinazzoActor Carmine Giovinazzo, known for his role on the TV show CSI: New York, was arrested for DUI on January 21, 2013 in Scottsdale, Arizona. According to police, Giovinazzo was seen swerving in and out of lanes around 2:40 a.m. when he was pulled over. When police began to question Giovinazzo, he was immediately apologetic and said his erratic driving was a result of using a gps device because he was lost. Giovinazzo, who had 2 other passengers with him in his Jeep Wrangler said that he was not from Arizona. As police continued to question the actor, they notice several symptoms of alcohol intoxication such as slurred speech, bloodshot eyes and an odor of alcohol.

When police asked if he had been drinking, Giovinazzo admitted to having some scotch at the W Hotel before driving that night. Giovinazzo was then placed under arrest for DUI, although, police have said that he was extremely nice and cooperative throughout the ordeal. The arresting officer commented on the incident, saying Giovinazzo had “repeatedly apologized to me and told me he didn’t want to be an ‘a**hole“. Police say that the actor’s blood alcohol content (BAC) level was .149%, almost double the legal limit. The officer did say that Carmine Giovinazzo was very nice and “thanked me many times for not treating him like a criminal and showing him respect“.

Actor Thomas Gibson Gets Plea Deal For DUI

Actor Thomas Gibson, known for his role on the hit TV show “Criminal Minds”, plead “no contest” to an alcohol related reckless driving charge on January 29, 2013. Gibson was arrested for DUI earlier this month on January 6 after driving his car into a barricade in downtown Los Angeles. After pleading “no contest”, prosecutors dropped the DUI charges, which is not surprising considering the fact that the actor does not have a history of DUI arrests. Now, under the terms of the plea deal, Gibson will have to pay $300 in court costs, attend alcohol education classes for one year, and complete 36 months of probation.

On the night of the arrest, Thomas Gibson drove his Audi SUV into a barricade meant to block traffic in downtown Los Angeles during a nighttime half marathon. When police arrived and began to question Gibson, they detected an odor of alcohol coming from the actor and requested he take a breathalyzer test. Gibson refused to submit a breathalyzer test; he was eventually brought down to the ground by five police officers while he shouted, “I am not resisting. I am not resisting“. Thomas Gibson was arrested on suspicion of misdemeanor DUI and released the next day on $15,000 bail.

South Carolina “Party Girl” Charged with Murder in DUI Case

Lisa Pistolis, 25, of South Carolina was awaiting trial on a previous DUI charge on the day she drove drunk and killed a local man. Pistolis was charged with DUI in February 2012, and on January 28, 2013 she was charged with Felony DUI after crashing into a Jeep which killed 35-year-old Serjei Cahuantzi. Pistolis was driving on Interstate 526 and drifted off the roadway and into the median; she tried to merge back onto the interstate and collided with Cahuantzi’s Jeep, causing both vehicles to spin out of control. Cahuantzi was thrown from his vehicle and died. Pistolis and one of her passengers was taken to a hospital, and two of her other passengers were not seriously injured.

Rumors of Pistolis being a “party girl” are swirling on comment threads following the story. A picture of the drunk driver doing a keg stand appears to have been taken from her Facebook account before the account was deleted.

Dental Hygienist without a Driver’s License Charged with DUI Involving Death

Deadly Dental Hygienist Charged with DUI Hit-and-Run

Delia Aguila, 27, was driving drunk over the weekend when she struck and killed a couple who were changing a flat tire. Aguila, a dental hygienist, has been charged with two counts of aggravated DUI involving a death. She was given a ticket for driving without insurance, failure to reduce speed, transporting an open container of alcohol, failure to render aid, transporting an open container of alcohol, and driving without a license. Apparently, Delia Aguila has never had a license even though she could have tried to obtain one. After the accident, her blood alcohol levels were tested and it was discovered that she was more than two times over the legal limit. Her bond was set at $300,000.

Prosecutors said that the victims had pulled their vehicle to the side of the road at around 10:45 p.m.; Aguila drove her Nissan Quest SUV at about 60 mph when she swerved and struck William Brunson, 39, and Victoria Means, 34. Brunson was knocked out of his shoes and died by the force of the impact, and Means was knocked out of her coat and was pronounced dead shortly after being transported to a medical center.

After the crash Aguila kept driving and made a right turn. Police tracked her down and found her SUV struck on railroad tracks. Police say the wheels were spinning because Aguila was trying to accelerate. Her SUV had heavy front-end damage and Aguila had glass in her hair. Police say she had bloodshot eyes, slurred speech, and was crying. On the passenger side of her vehicle, there was an open bottle of vodka. Her attorney, Myron Goldstein, said that she is a longtime dental hygienist and supports a 10-year-old and a 2-year-old son. An assistant who has worked with Aguila for eight years said in a telephone interview that their whole office was in shock over the news. Segarra called Aguila as “one hell of a good person” who was a caring and dedicated mother, who worked hard to support her children and her live-in boyfriend. “She’s always working hard, trying to support her family,” Segarra said. “She never really goes out at all. It’s just a crazy situation.”

Bossier Sheriff’s Deputy Fired after DWI Charge

Louisiana Deputy Fired Over DWI Charges

Bossier Parish Sheriff Julian Whittington has terminated one of his own kind after his deputy, Jesse Williams, Jr., was caught drunk driving by a State Trooper on Highway 3. The Trooper alleges that Deputy Williams appeared intoxicated and had bloodshot eyes, was emmitting a strong odor of alcohol, and had poor balance. The report said that he performed poorly on the field sobriety tests that he likely had administered to many others in the past, and the deputy had foolishly left open containers of alcohol in his vehicle. Deputy Williams was booked into Bossier Maximum Security Facility for his first DWI and for driving with an open container.

This is not the first law enforcement officer to be charged with DWI this week. In Sandoval County, Albuquerque Police Detective Edwin Linson was caught driving drunk in an unmarked APD car.

New York Supreme Court Justice Charged with DWI

A member of New York State’s highest court was charged with drunk driving last week after swerving past an unmarked police car. Supreme Court Justice Carl Landicino, 47, was stopped by police at 4:06 p.m. on Interstate 87 in Menands last Thursday. According to police, the drunken judge failed field sobriety tests and refused to submit to an Alco-Sensor Test which would have measured his blood alcohol levels. In addition to the charges of driving while intoxicated (DWI), Landicino was also charged with speeding, following too closely, and for an unsafe lane change. His grey BMW was impounded.

Landicino served as personal counsel to scandal-ridden Assemblyman Vito Lopez. Lopez helped Landicino land the position as Kings County Supreme Court justice, earning a cool $136,700 annually. Landicino lives in Yorktown Heights, a Westchester suburb with an annual household income of one person averaging $75,427. Landicino has faced mounting criticism for his work and his connections over the years. His job with the Democratic Party in Brooklyn was to allegedly “sue candidates Lopez wanted to keep off the ballot.” Landicino represented Supreme Court justice Jack Battaglia, who sued in a $1 million lawsuit over a slip-and-fall that happened when he fell on a recently mopped floor in his own courthouse. Landicino will serve as a judge until 2025, and originally won the seat with 15.6% of the vote. He was released on his own recognizance after his arraignment.

Man Faces Three Years in Prison Over 11th DUI

Russell Paul Price was sentenced to more than three years in prison over his 11th conviction for driving drunk. He pleaded guilty on Monday and now faces between 40 months and 5 years in prison; he was also given concurrent terms of 180 days for driving with a suspended license, and 90 days for possession of marijuana. He got 5 days credit for days already served, and was ordered to pay $2,473 in costs and fines. Assistant Prosecutor Kelly Travis said, “He has a history of drunk driving. This is his 11th conviction for it and the last time he was sent to prison. He’s not probation or local jail material. If he wants to drink himself to death at home, he can, but it’s another thing to get behind the wheel of a car when he’s drunk.”

Price showed remorse in court when he said he never thought he would be in court again for drunk driving. He added that he had gone to counseling and had been on medication, however the costs of those were too much and he had to stop treatment. He referred to his last episode of getting drunk and getting behind the wheel a “drastic mistake”. Berrien County Trial Judge Dennis Wiley said, “There’s no question that you’re an alcoholic and continue to abuse drugs. Then you get behind the wheel of a car and endanger every other human being out there. This is your 11th conviction. One of these days you’re going to kill someone else or yourself.”

The sentencing guidelines for a case such as Price’s is only 7 to 23 months in jail or prison, however Wiley departed from the guidelines and gave Price a significantly longer sentence considering the number of prior convictions on Price’s record.

Pittsburgh Fire Lieutenant Charged with Third DUI

A Pittsburgh fire lieutenant is under fire for his third DUI. Mark Heslet ,43, was caught weaving through lanes of traffic on December 20th and was stopped by police. City fire Chief Darryl Jones said he only learned of the charges against Lieutenant Heslet on Monday, and at the time the Lt. had been continuing his job in the normal capacity. However, this tends to be normal procedure, as most employers will wait till a case has come to a conclusion before dolling out punishment to their employees.

Ross officers wrote in their complaint against the Lieutenant that he had trouble passing field sobriety tests. He also told the officers that he was having family troubles which were going through court, and that he went out drinking just for those reasons. Lieutenant Heslet’s first DUI dates back to 1992. For his first DUI, he completed an accelerated rehabilitative program for first-time offenders. Despite his success with rehabilitative treatment, he received another DUI in 2000.

In 1997, Lieutenant Heslet joined the fire bureau. He will be in court for a preliminary hearing in front of District Judge Richard Opiela on Feburary 27th, and he had no attorney on file.
