Ventura County DUI Test Results Available On-Line

The Ventura County Sheriff’s Department has announced the creation of a website link that allows motorists accused of driving under the influence in California to check the results of their blood or breath tests. A new link titled ‘Alcohol Test Results’ is at the bottom of the main website. Users must log-in with information known only to the California DUI defendant or those familiar with details of the arrest. The report is in a PDF format that can be printed.

A copy of the same information is also available by presenting identification to the Forensic Sciences Laboratory in the Ventura County Government Center.

The web page was created with funding from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

California DUI Deaths Decline for Fourth Year

The California Highway Patrol has announced a decline in the number of traffic fatalities involving drunk driving. The total was tabulated after a year long DUI and safety enforcement campaign that ended in October. It is the fourth year in a row that the figure has dropped.

Starting in October 2009, the Border-to-Border DUI initiative conducted by CHP sought to reduce alcohol related deaths and injuries on state highways. The effort included more than 50,000 hours of enforcement patrols, 240 sobriety checkpoints and 100 California DUI task force operations. A total of 1,900 arrests were made for driving under the influence in California. In addition, CHP conducted a statewide media campaign on the dangers of impaired driving, made numerous traffic safety presentations and supported Designated Driver Programs.

The Border-to-Border campaign was funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Pro Football Player Waived After North Carolina DWI

The Carolina Panthers waived wide receiver Dwayne Jarrett after an arrest for driving while intoxicated in North Carolina. It was the second Charlotte drunk driving offense for the troubled player.

Jarrett was stopped by Charlotte-Mecklenburg County police for speeding around 2:00 am Tuesday. The officer determined there was probable cause for a North Carolina DWI arrest. Jarrett refused to submit to a breath test while being booked at county jail, and he was taken to a medical facility for a blood draw to test blood alcohol content. The results from a state lab are pending.

Jarrett was charged with DWI in Charlotte in March 2008 after he crossed the center line of a highway and ran a red light. He pleaded guilty to that offense and received a sentence that included community service, payment of $420 in court costs and loss of license. Because of that conviction, the NFL required Jarrett to undergo regular alcohol and drug testing.

The Panthers general manager said he talked to Jarrett and told him “the situation was just not working out for either side.” To fill the roster spot caused by Jarrett’s dismissal, the team picked up receiver David Clooney off waivers from the New York Jets.

Illinois DUI Arrest in Police Parking Lot

A 44-year old man was arrested for driving under the influence in Illinois after he arrived at the Montgomery Police Department around 6:30 Saturday morning. Antonio Trujillo claimed that his family at home was in danger and that there was an armed man in the back of his pick-up truck.

Police said the vehicle was empty and the family was safe. Trujillo was arrested and charged with IL DUI.

Yet Another Lawn Mower DUI Arrest

55-year old John Poshepny of Kenwood was arrested for California DUI around 7:50 pm Saturday night. California Highway patrol officers stopped Poshepny after he left the parking lot of a local market and drove down the road. The mower was not equipped with lights.

Poshepny had a bottle in a brown paper bag and his breath smelled of alcohol. He also staggered and had slurred speech. He was booked on misdemeanor driving under the influence in California at the Sonoma County Jail and released. Poshepny has no prior CA DUI arrests and he had a driver’s license. While he only lives two blocks from the market, he said that he occasionally uses the mower to get groceries.

All motorized vehicles and bicycles on public roadways are subject to California DUI laws, and the operators must have a valid driver’s license and registration.

Grandma Offers Grilled Cheese Sandwich in Effort to Avoid Florida DUI

A 65 year old woman in Ocala Florida tried to avoid an arrest for drunk driving by offering to make the police officer a grilled cheese sandwich. Elsie Wright O’Conner was stopped Thursday night after reports of an erratic driver. Marion County Sheriff’s Deputy Calvin Batts smelled alcohol on O’Conner’s breath and found two bottles of Skyy vodka in her Cadillac SUV. One of the bottles was empty and the other was half full.

O’Conner pleaded with Batts to not charge her, stating she was a grandma and not that bad. She went on to say, “I could have brought you back to my house and made you a grilled cheese sandwich.”

O’Conner reportedly failed a field sobriety test. While being booked on charges of driving under the influence in FL, O’Conner’s blood alcohol content registered more than three times the legal limit.

Woman DUI in Florida Hits Scooter and Flees Scene

A 20-year old Florida man is in fair condition after a woman crashed into him Friday night and fled. Bruce Barber is being treated for a broken leg and possible broken ribs. He was struck around 11:30 pm by a 1997 BMW driven by Jessica J. Eddy. St. Petersburg police have not indicated how they tracked the vehicle, but when they arrived at Eddy’s home they found the scooter still stuck to the front of the car.

Eddy, 22, was arrested for driving under the influence in Florida, DUI with injury, leaving the scene of an accident and for driving with a suspended driver’s license. She was convicted for DUI in California in 2009 and is facing charges for an August drunk driving arrest in St. Petersburg. Her license was suspended after she refused to submit to a breath test during the August arrest.

Eddy was booked at the Pinellas County Jail and her bail as set at $23,000. She is scheduled to be in court Monday, October 4.

Arlington Texas DWI After Man Crashes Into Police Car

A man crashed into an Arlington Police Department squad car around 5:00 am Thursday, injuring the officer and resulting in a Texas DWI arrest. Officer Tony Crowsey was turning on a green arrow at the intersection of Pioneer Parkway and Texas 360 when his vehicle was struck by a speeding white Ford Crown Victoria traveling westbound. An open beer was found in the Ford, and the driver, Kedrain N. Bunton, had slurred speech and bloodshot eyes, leading officers to investigate the scene a drunk driving incident.

Officer Crowsey was taken to an Arlington medical center where he was treated for an injured leg and later released. Bunton, 23, was also treated for non-life-threatening injuries and then booked at the Arlington City Jail on charges of driving while intoxicated in Texas. His bail was set at $1000.

New Law Allows EMS Workers to Draw Blood from Ohio DUI Suspects

A new Ohio law permits emergency medical services employees to draw blood in situations where there is motorists are suspected of driving under the influence of alcohol or drugs and have caused an accident.

When gathering evidence to test for blood alcohol content or presence of drugs, there is a less than three hour window that yields a more accurate result. Previously, law enforcement officers would have to transport Ohio DUI suspects to a hospital for a blood draw. By allowing EMS workers to take samples, evidence is collected sooner and the officers can focus on the DUI site investigation.

During 2007, more than 19,000 motorists were arrested for suspicion of driving under the influence in Ohio.

The Ohio state board of emergency services initially opposed the new measure, but then signed off on it. The board is developing blood draw guidelines for the nearly 1300 EMS agencies across the state.

Florida Men Sell 'DUI Scooter'

Two men in Clearwater Florida have come up with an idea to fill a niche market. Doug Vitello and Gary Pharr own a scooter business and have struggled with the volatility of the market. After a bit of research, they began advertising ‘DUI Scooters’ to those convicted of driving under the influence in Florida.

After a Florida DUI, defendants typically have their license suspended. Because the DUI Scooter is electric and has a top speed of 20 miles per hour, it is legal to operate without a valid driver’s license. The X-treme scooter, manufactured in China and distributed in California, looks like a typical two wheel scooter with headlights, turn signals and pedals for manual operation. It costs between $1200-2000, and the scooter shop is selling about 10 per month. The shop even includes a copy of the DUI law to provide officers during a traffic stop.

Customers who have purchased the special scooters are pleased to have the mobility to ride to work and the store. Law enforcement officials are not quite so enthused, and are looking into ways to approach electric scooter use by FL DUI offenders.
