Bar Obliged to Pay $2 Million For Serving Alcohol to a Minor

Business Insider reported that Crossroads Sports Bar in Florida was sued for $2 million “for intentionally serving an underage client who then got behind the wheel and ran over a pedestrian and 2-year-old child.” It was determined that the underage drunk driver, Valerie Dibble, had a blood alcohol content level of 0.22% which is more than twice the Florida legal limit.

It was stated that a pedestrian, Isaac Sanchez, was carrying his toddler nephew while “standing on the side of a road when Dibble drove off the road and over a lawn before hitting him.” Although Sanchez’s nephew was thrown to the floor, he did not receive any serious injuries. On the other hand, Sanchez did receive serious injuries. It was stated that “he only remembers part of the accident.” Sanchez told sources, “Everything happened so fast you know, it was like a flash – the impact, the pain.”

During trial, Crossroads Sports Bar told the court that “Dibble was never in the bar.” However, the jury refused to believe the bar and required it to pay Sanchez $2 million as penalty. Dibble was charged and convicted for drunk driving and causing serious injuries to Sanchez. She was given a punishment of serving three years of community supervision.

New York Lawyer Resists DWI Arrest

Post Star reported that John W. Caffry, an attorney from Glens Falls, received a DWI misdemeanor charge on Thursday evening. Glens Falls police officials stated that Caffry, who is 51 years old, resisted the arrest. However, they managed to arrest him shortly after 11:53 p.m. at a traffic stop near Ridge Street.

Robert Ash, who is in charge of the Glens Falls police department, stated that Caffry “was stopped because the vehicle he was driving had a headlight out.” Police officials administered Caffry several field sobriety tests, all of which he failed. It was determined that Caffry’s blood alcohol content level was 0.09%, which is above the New York limit of 0.08 %.

After Andrew Mija, who is one of the police officers involved in Caffry’s case, told Caffry he was under arrest, Caffry responded back to him by saying, “No I’m not.” He then tried to walk away from the officer, which caused him to receive another charge for resisting legal authority. Caffry did not make any further comments about his situation and  was released with a prosecution pending from  City Court.

Drunk Driving Woman is Stopped Through Citizen’s Arrest

A Scio, Ohio resident, Mark Napier, stopped a woman who was driving drunk down Ohio State Highway 151. The drunk driver, Brandy Hutchison of West Virginia, was dangerously weaving in and out of traffic on the highway. Napier saw her nearly hit four vehicles on the highway and was able to pull his truck in front of her car to stop her. Napier pulled his truck in front of her car near an R&R Gas Station, and another vehicle stopped and blocked her car from behind.

Hutchison was charged with operating a vehicle under the influence and driving on a suspended license. She will be arraigned in Harrison County Court on Jan. 22. OVI convictions in Ohio have a range of penalties, with the highest penalties being reserved for those with a BAC over .17%. The fines range from $375 to $1,075 for a first conviction. Under Ohio law, those convicted of drunk driving may be required to drive with yellow license plates that signify the driver as someone with a previous drunk driving conviction.

Wisconsin Man Arrested for DUI has BAC Ten Times the Legal Limit

A man arrested for his sixth offense of drunk driving reportedly had a BAC that was ten times the legal limit. Julio Garrdio, 61, of Madison, was traveling northbound in southbound lane around 3:30 p.m. on Thursday. Nearby, police officers were conducting traffic enforcement and watched as his vehicle suddenly stopped without any apparent reason to do so. Officers approached Garrdio and arrested him for his sixth OWI/DUI offense. His blood alcohol content was .20%.

A motorist with five OWI convictions in Wisconsin cannot legally drive if their BAC is over 0.02%. This is why Garrdio’s BAC was technically ten times the legal limit, even though the state law mandates that the legal limit is 0.08%. Wisconsin police say that Garrido may also be charged with failure to install an ignition interlock device and with third offense driving after license revocation.

jeffrey barnesA repeat DUI offender in Bear, Delaware, was arrested for his sixth DUI on January 18, 2012. The incident occurred in Rehoboth Beach after police spotted a vehicle making an illegal U-turn at around 1:15 am. The driver, Jeffrey W. Barnes, was traveling northbound on Route 1 and made an illegal U-turn into the southbound lanes before crossing over a concrete median and then back again.

A police officer began following Barnes and pulled him over in a Walmart parking lot. According to police, Barnes tried to run after being pulled over but was chased down and eventually caught. After police ran a background check on Barnes, they found that he was a repeat DUI offender with 5 prior DUI arrests since 1996. Barnes was arrested and taken to the Troop 7 barracks where he was charged with a felony DUI in addition to other traffic offenses with bail set at $9,400.

A woman who jokingly moonwalked her field sobriety tests doesn’t impress police and is arrested for DWI. 23-year-old Coral Li Rape was stopped by Senior Officer J. Rhodes when he saw her black Cadillac CTS parked in front of an intersection with a green light. Coral was at the intersection of Holly Road and Flynn Parkway, and she suddenly turned onto Flynn Parkway when the cruiser approached. She began traveling southbound in a northbound lane so Officer Rhodes stopped her to investigate.

Officer Rhodes pulled over the Cadillac and approached Coral, who appeared to be intoxicated and was unwilling to co-operate. Officer Rhodes, joined by Officer Sanders, had her step out of her car and asked her to perform a field sobriety test. She “moonwalked” over to the officers as an answer. Officer Sanders placed her under arrested and she was transported to the City Detention Center, where she was given a breathalyzer. The breathalyzer results came back which showed Rape’s blood alcohol content was over .15%, which is a Class A Misdemeanor.

Florida Man Jumps Off Bridge to Avoid DUI Arrest

A man in Florida tried jumping from a bridge to evade a DUI arrest. Late Monday night, several motorists reported a white Chevy Impala heading northbound in the southbound lane of the Seven Mile Bridge, the famous bridge in the Florida Keys that was once the longest bridge in the world. The driver reportedly side-swiped the bridge several times, causing body damage to the Chevy Impala.

Police Deputy Vincent Weiner saw the Chevy Impala heading northbound and began to follow it, but the car did an abrupt U-turn and began traveling south. Weiner flashed on his lights and the Impala stopped briefly. Suddenly, the Impala sped off and Weiner continued to follow the car, which began reaching speeds of 90 miles per hour. The car chase neared the hump of the bridge and a large, black cloud of smoke blew out from the Impala and the car began to slow down. The driver of the Impala, 45-year-old Dale A. Darosa of Massachusetts, got out of his and walked to the edge of the bridge. By this time, police Deputy Weiner was joined by Sgt. Joel Slough. The officers ordered the driver to stop and put his hands up.

Darosa ignored their requests and proceeded to hop over the railing, balance on edge, and jump. Darosa fell into the water and the current dragged him toward the old 7 Mile Bridge. This is when he began yelling for help. The Coast Guard, Fish and Wildlife Conservation Commission were called to search the area where Darosa jumped. Luckily, he was recovered a half mile away and was airlifted to the Ryder Trauma Center for treatment. Darosa faces charges of reckless driving, fleeing, eluding arrest, and resisting arrest.

Brenda Conway is the girlfriend of Judge Caretti, a Macomb County judge. One night Conway, Caretti, and Carreti’s two children attended a wedding reception and by the end of the night, Conway was in jail for DWI and Caretti was stranded when her car was impounded. Conway was driving the group home from the wedding when Caretti’s daughter texted her mother, the ex-wife of Judge Caretti. The daughter had sent a message that said her father had Brenda Conway driving and Brenda was very drunk.

Lori Conway, Caretti’s ex-wife, immediately called police. When the group arrived at Lori’s home, Brenda, was arrested for drunk driving. “Judge Caretti was in no condition to drive either, so the car was towed,” Lori Conway said. Caretti was taken to a nearby restaurant to make other arrangements for him to find his way home. Police filed a child abuse and neglect report with the state.

In another twist to the story, the 15-year-old daughter was supposedly asked to drive the car. She said she felt uncomfortable about doing so and declined. Judge Caretti came out with a statement defending those actions. He said his daughter had recently received her driver’s permit and was always asking if she could drive, so he offered her the choice to drive them home that night. In a statement, Judge Caretti said, “I had only two or three drinks over the course of seven hours at the hall and was certainly not intoxicated at midnight when we arrived at my ex-wife’s house as my very vindictive and inaccurate ex-wife claimed when you interviewed her…My daughter, who has her permit, always wants to drive, so I asked her if she wanted to drive for that reason only.”

Brenda Conway had a blood alcohol concentration of 0.18 that night, which is more than twice the legal limit.

N.J. Police Detective Charged with DWI After Drunk Driving Crash

After driving off a road in Chatham Borough, State Police Detective Joseph P. Brennan was charged with drunk driving. Detective Sgt. 1st Class Joseph P. Brennan was off-duty at the time of the crash. He had been playing bagpipes at a private birthday party for Newark Police Director Samuel DeMaio earlier in the night. Brennan’s car crashed through a concrete wall and came to a rest on top of a large rock.

The sources would not reveal if Brennan, a member of the Pipes and Drums of the Blue and Gold non-profit trooper-led bagpipe band, had been drinking. Brennan was found unresponsive behind the wheel of his SUV at 3:17a.m. by borough police. Police said once they got Brennan’s attention, he seemed confused and had to be told that he had been in an accident. Police reported that his breath smelled of alcohol and his lips were stained purple. Police asked if he had been drinking and he mumbled what sounded like a “no”.

Brennan is assigned to State Police’s Analysis Unit at the Regional Operations Intelligence Center in West Trenton. He joined the force in 1998 and was earning $105,588 in 2011. He was charged with DWI, reckless driving, and refusal to submit to a breath test. After his arrest, he was suspended without pay pending the conclusion of his case and an internal investigation.

The police report says that Detective Joseph Crecca asked Brennan to get out of his vehicle but Brennan repeatedly reached under his right hip under his jacket which made Crecca feel “unsafe”, so he handcuffed Brennan’s left hand and then guided him out of the vehicle. On Brennan’s right hip was his gun, which Crecca confiscated when another officer arrived. Officer’s seized Brennan’s State Police Badge and he was booked at borough police headquarters, where he refused a breath test.

Bastrop County Commissioner, John Klaus, was arrested for driving while intoxicated on Tuesday night. Torry Lail heard the accident and described it as sounding like a train wreck. Lail said, “He must have gone about 300 feet…and he was probably doing every bit of 60 miles per hour.” Lail said the front end of Klaus’ pickup truck was stuck on barrels that were on Lail’s property.

“He came in through this ditch right here and then hit and jumped over that fence line right over here…and he went right in between the tree and the burn pile over here…right there, he pretty much went through and knocked a few more trees down and came all the way over here and finally rested on this barrel.”

Lail pointed out the leftover damage that was left behind. “There’s pieces of the headlight and blinker. Beyond that tree I know we picked up a headlight and a mirror over here and we’re still looking for the front license plate.”

The arrest affidavit said that Klaus admitted to having one beer. Deputies on the scene reported seeing two 12-ounce cans of beer inside the Commissioner’s truck. The report also alleges that Klaus was stumbling and slurring. Lail described Klaus’ demeanor, “Whenever I went to open the driver’s door, he was about to get out and then he just said, ‘ugh’ and then closed the door real fast after he pushed me out of the way and threw it in gear and then turned the wheel toward me.”

Lail said that Klaus pulled onto a log and could not go any further, and said that his trailer hitch hit the tree, which gave Lail enough time to jump in the backseat, throw the vehicle in park, and grab the keys. Lail said that Klaus did apologize. Klaus was arrested for drunk driving, but no statements have been released about his DWI arrest.
