Canada Denies Entry to Those With DWI Record

If you are planning on traveling to Canada, be aware that you can be denied entry to the country if you have a criminal arrest record.

It doesn’t matter if your visit to Canada is for business, school, immigration or pleasure, and it doesn’t matter how major or minor the nature of your offense. A past conviction for shoplifting, driving while intoxicated or drug possession is enough to be denied entry to Canada.

The legal code for denying admission to criminals has existed for some time, though in a post 9/11 environment, the United States and Canada are sharing more information. Immediate access to regularly updated databases makes enforcement easier. Now even ski bums on a weekend vacation are being turned away by Canadian immigration.

A juvenile criminal conviction (for crimes committed when younger than 18) will most likely not result in being prohibited entry. Adults can file a form declaring rehabilitation, though this must be done well in advance of any effort to enter Canada. A DWI Defense Attorney may be able to help with the expungement of a previous drunk driving arrest.

West Virginia Law Would Require Stiff Sentence for DUI Fatality

The House of the West Virginia Legislature unanimously approved a bill that would increase the minimum prison term for motorists who cause a traffic fatality while driving under the influence.

Currently those convicted of a West Virginia DUI that involved a fatality would face from 1 to 10 years in jail. DUI offenders are typically credited for days spent in jail while their case is pending in court, diminishing the impact of final sentencing. The new legislation would ensure at least some prison time by changing the minimum sentencing to 3 years and increasing the maximum to 15 years.

According to federal statistics, in 2005 there were 108 deaths in West Virginia attributable to drunk drivers. That equaled 29% of all vehicular deaths in the state.

The bill is now being considered by the West Virginia Senate.

One of the stars in last month’s SuperBowl, Rhodes was stopped in far northwest Indianapolis for speeding in his truck. He was reportedly cooperative with state troopers during the DUI arrest and, after being held overnight, he was released on his own recognizance.
