According to the Twin Cities’ Pioneer Press, the University of Minnesota’s men’s basketball assistant coach, Saul Smith, received a DWI charge in Minneapolis this past week. Norwood Teague, Gophers Athletics Director, stated that Smith “no longer is on unpaid administrative leave, but he is suspended through November 13.” His salary of about $94,775 was reinstated on Friday.

Smith, who is also the son of Gophers head coach Tubby Smith, will not be present in any practices nor any of the four upcoming games.

Smith was charged with a fourth-degree DWI. Legal investigations from the Minnesota State Patrol have evidence that his blood-alcohol level had been .18, which is more than twice the legal limit of .08. He will be summoned to a court hearing on November 9.

Teague added to his statements by saying, “I’ve discussed with Saul in depth just the nature of his actions and how inappropriate they were…how actions like this damage the reputation of the university as a whole…Saul has taken responsibility and been very remorseful about his actions…” Smith has agreed to take counseling and alcohol abuse education. Teague warned that if another behavioral situation such as this were to happen again, Smith’s job position could be terminated.

Tyrann Mathieu, former LSU cornerback football player and a one-time Heisman Trophy finalist, may have lost his chance to play college football again and of someday playing with an NFL team. Mathieu, better known as “Honey Badger,” and several of his former LSU teammates were arrested last Thursday for possession of marijuana charges. It was stated that they arrived at Mathieu’s apartment complex and “couldn’t figure out how to work a security gate and drew enough attention that it warranted a call to police who smelled marijuana and arrested the four former players on a variety of charges…after obtaining permission to search and finding  a marijuana grinder, digital scale, and 10 bags of high-grade marijuana…” They were apprehended and taken to a Baton Rouge, Louisiana jail.

Sources stated that Mathieu’s charge was a “first offense of simple possession.”  In August 2011, Mathieu was kicked off the LSU football team for failing a drug test and academic failure. Due to this, it seems highly unlikely that he will be able to play again with LSU. More importantly, his current situation might affect his chances of participating in April’s NFL draft.

On the other hand, other sources claim that “it’s certain that Mathieu will come into the NFL under the watchful eye of the league…it is the league that doles out four-game suspensions for positive marijuana tests—the same punishment given to first-time steroid users.”

Mark Grace, Ex-Chicago Cub, Gets Prosecuted for 4 DUI Counts

According to the Chicago Sun-Times, former Chicago Cubs and Arizona Diamondbacks player Mark Grace has been indicted for a DUI charge that occurred on August 23. If found guilty, he could face up to four years in prison. On October 3, a grand jury indicted Grace with “four felony counts of aggravated driving or actual physical control while under the influence of intoxicating liquor or drugs.”

Legal authorities stated that each of Grace’s felony accounts carry severe punishments, including one to 4 years of imprisonment. However, they claimed that the punishments “would likely be imposed concurrently if he’s convicted because they relate to one incident.” Grace’s attorneys stated that he could reduce his jail time if he chooses to plead guilty. He does not qualify for probation because it is the second DUI charge he received within a 15-month time period.

On August 23, Grace was arrested by police officials for having a blood-alcohol level of .095%, which is above the legal limit of .08%. Furthermore, he was driving on a suspended driver’s license and did not have the mandatory interlock device that was supposed to be installed in his vehicle from a DUI he received in May 2011. Grace took a voluntary leave of absence after his second arrest, but the Diamondbacks recently placed him back in the broadcast booth after nine seasons.

Model Still Eligible for Pageant Regardless of DWI Arrest

Miss University of ArkansasDash cam video of beauty queen Sarah Gafvert’s DWI arrest has been released. The 21-year-old was crowned Miss University of Arkansas on October 21, despite having been arrested for DWI on September 26. She was charged with a DWI after allegedly failing several field sobriety tests and violating traffic laws. Pageant personnel declared Gafvert eligible for competition. Gafvert did alert pageant officials of her arrest and that her case was pending, and that she was fighting her charges.

Gafvert was stopped by a police officer for suspicion of drunk driving. The arresting officer said that “she had bloodshot and watery eyes and slurred speech…her car gave off an odor of intoxicants…” Her blood alcohol level registered at .13%, which violated the legal limit of .08%. She was apprehended and taken to Washington County Detention Center at 3:37a.m., and was released on a bond of $1,200. She will be summoned to a hearing at Fayetteville City Court next Monday. As for now, she faces misdemeanor DWI charges as well as charges for driving with an expired driver’s license and failure to use turning signal device.

Braden Kessler, a Tennessee teacher at Bolivar Central High School was arrested Monday October 22, 2012 for DUI and drug possession. Kessler was also charged with intent to distribute Xanax and unlawful possession of drug paraphernalia. He was released from jail on a $25,000 bond. Kessler is set to appear before the Hardeman County General Sessions Court on October 30th at 9 a.m. and has been suspended without pay as a result of his arrest. Kessler is a first-year teacher and taught business technology.

Apparently, the district did conduct a background check prior to hiring Kessler. Hardeman County Director of Schools Warner Ross said, “Nothing came out of his background check.” Jeff Barnes, the Principal at Bolivar Central High School, said that the Tennessee teacher did not have any complaints on his record. However, the district does not require drug screenings during the hiring process and Kessler did not have a history of drug arrests. Kessler has not made a public statement and could not be reached but Ross did say that his future teaching at the high school would depend on the outcome of the case.

Denver Broncos linebacker D.J. Williams is finally serving his sentence for DUI. He was arrested on November 12, 2010 for DUI. According to NY Daily News, he has been sentenced to 30 days of house arrest that he can begin after the end of the season. After a lengthy court process, the judge sentenced Williams to house arrest beginning on Febuary 7, 2013. In addition to his house arrest, Williams must also complete 2 years probation, 56 hours of community service, pay $2,390 in court costs and attend alcohol education classes. Though Williams was originally arrested for DUI, a jury later found him guilty of the lesser charge of driving while ability impaired. Williams is currently serving a 3 game suspension mandated by the NFL since his conviction.

Williams has had run-ins with the law previously. Before beginning his current suspension period, he had just completed a separate 6 game suspension he received for violating the NFL’s performance enhancing substance policy. Since the start of the season, Williams has been banned from his team headquarters and is not allowed to practice or speak with the media until his suspension is over. His lawyer, Harvey Steinberg, said “We thought it was a fair and appropriate sentence given all the circumstances“. D.J. Williams was originally pulled over for driving without his headlights on, however, after failing several field sobriety tests, he was placed under arrest for DUI. Williams is expected to resume practice on November 12, 2012.

ESPN reports that Carlton Fisk, ex-Chicago White Sox and hall of fame catcher, was charged with a DUI in New Lenox, Illinois this past Monday. Police officials stated that they found him passed out in his vehicle, which was stationed in the middle of a corn field.

Deputy Chief Bob Pawlisz told sources that “they contacted local paramedics in New Lenox, had him examined, and the officers had reason to believe he was under the influence. He was transported to the local hospital and charged with a lane violation, driving under the influence and illegal transportation of alcohol. An open container of alcohol was found in the vehicle.” Fisk received a DUI citation and was arrested. However, he was set free on a bond payment. He is summoned to appear in the Will County Courthouse for a hearing on November 29, 2012.

Fisk, who is now 64 years old, started his major league baseball career with the Boston Red Sox from 1969-1980. He also starred in the 1975 World Series. Coincidentally, his DUI arrest occurred one day after his 37th anniversary of his home run clinching Game 6 versus the Cincinnati Reds. He signed a contract with the Chicago White Sox in 1981 and retired from the sport in 1993. He was submitted into the Hall of Fame in 2000.

Idaho Judge Renae Hoff To Retire After Getting DUI

The Idaho Press-Tribune has reported that Judge Renae Hoff was arrested for DUI on August 25, 2012. She has stepped down from her duties and will retire in January. Officers allegedly saw Hoff weaving in and out of lanes and proceeded to pull her over. When officers began to question the Third District Judge, they noticed that she displayed symptoms of alcohol intoxication such as glassy, bloodshot eyes, and they reported she had an odor of alcohol on her breath. According to the police report, Hoff “almost fell while stepping out of the vehicle, swayed and had an unsteady gait.

Hoff was pulled over around 1:30 a.m. and admitted to drinking beer while at the Idaho Shakespeare Festival earlier that night. Police first asked Renae Hoff to complete 3 field sobriety tests, which she did not pass. After failing the field sobriety tests, Hoff was placed under arrest and a blood alcohol test later showed her blood alcohol content (BAC) level to be .116%, which is higher than the state’s legal limit of .08%. Hoff has been removed from presiding over criminal cases until her DUI case is resolved. She plead not guilty to the charges and will begin her jury trial on December 4, 2012. Renae Hoff was appointed to the bench in 1990 and recently re-elected in 2010 when she ran unopposed. Since announcing her retirement, 7 people have applied for the job which earned Hoff $112,043 in 2011.

Bobby Brown Arrested for DUI, Again..

Just before 1a.m. on Wednesday, Bobby Brown was arrested for suspicion of DUI, his second DUI arrest in just six months. Brown was pulled over by law enforcement near the intersection of Ventura Blvd. and Corbin Ave. in Tarzana. Law enforcement reportedly could smell alcohol when they approached Mr. Brown.

He was booked and released said LAPD Officer Venus Hall. The records from the L.A. County Sheriff’s Department show that Brown’s bail was set at $25,000 and he left right before 8a.m.

The New Edition singer was given three years of informal probation and a day in jail for his first DUI conviction from earlier in the year. That time, Brown had originally been stopped for talking on his cell phone while driving, when officers suspected DUI. For that conviction, he was required to complete a 90 day alochol education program and pay a fine of $390.

Brown checked himself into rehab in early August and left after less than three weeks. He is due back in court on November 16.

Drunk Long Island Bus Driver, James Sommer, Gets DUI After Crash

Long Island bus driver James Sooner, 47, was arrested on October 22, 2012 for driving while intoxicated. Apparently, Sooner crashed his bus full of seventh graders during a field trip. The bus driver was trying to park when he suddenly backed into a tree limb. One of the students on the bus, a 12-year old girl, was taken to Huntington Hospital with minor injuries. There were 29 Plainedge Middle School students on the bus as well as one teacher when the accident occurred.

The students were being taken to the DNA Learning Center at the Cold Spring Harbor Laboratory when the accident occurred. Sommer has been charged with DWI while operating a school bus with students on board, DWI with a child passenger 15 years or younger, and endangering the welfare of a child. Sommer will be held overnight at the 2nd Precinct in Suffolk County with his arraignment scheduled for Tuesday at the First District Court. This is actually the third time this month that a Long Island bus driver has been arrested for driving drunk. Police found an open bottle of Vodka after one bus driver crashed his empty bus near an Expressway in Ronkonkoma on October 11. Another bus driver crashed his bus into a home with 5 elementary students on board just after leaving their Catholic school.
