Busta Rhymes Charged with New York DWI

Busta Rhymes was arrested for drunk driving Thursday in New York City. NYPD officers stopped Rhymes on the west side of Midtown Manhattan shortly before 1:00 a.m. because the windows of his 2006 Yukon Denali were tinted too darkly. The officers smelled a strong odor of alcohol on the rapper’s breath and requested a field sobriety test. Rhymes was charged with New York DWI and booked at a Midtown police precinct.

This is not the first run-in with law enforcement for Rhymes, 34, whose real name is Trevor Smith. He is scheduled to go to trial on May 8 for two assault charges; one case involves assaulting a fan at a music festival last August and the other stems from the beating and kicking of his former driver over a pay dispute last December. In February he was stopped for running a red light and subsequently arrested for driving with a suspended license.

Rhymes was issued a traffic last November for talking on his cell phone while driving. He has not cooperated with an investigation into the February 2006 shooting death of his bodyguard, even though he was a witness to the murder.

The rapper is known for his antics during performances and for his outlandish outfits. His music hits include ‘Touch It’ and ‘Put Your Hands Where My Eyes Could See’. He also appeared in the movie ‘Shaft’.

Iowa Upholds Use of Breath Test in DUI Cases

The Iowa Supreme Court ruled that breath test results can be used to determine blood alcohol content and justify arrest for suspicion of drunk driving.

At issue was a legal challenge against DataMaster breath test equipment. DUI defense attorneys argued that the machine results are too unreliable to be entered as evidence in a court of law. The high court decided to hear arguments in the case because the equipment is widely used in Iowa and the justices wanted to provide guidance to judiciary and attorneys. Their finding overturns a lower court decision that found the DataMaster unreliable and evidence gained from its use inadmissible.

Those arrested for Iowa DUI can still challenge the results of a breath test during trial. The Supreme Court decision, however, allows prosecutors to enter the test results into evidence.

California Court Says DUI License Suspension OK Even If Not Driving

Supreme Court of the State of California has ruled that motorists don’t have to be caught in the act of driving under the influence to lose their driver’s licenses.

Under California law, if you have been suspected of driving while intoxicated, and refuse to take a breath test, your license will be automatically suspended. The Supreme Court ruling says the penalty for refusing a test to measure blood alcohol content applies broadly to all those who drive and use the public streets and highways and no proof is required of actual driving immediately prior to a suspected DUI arrest.

The issue stems from a 2003 case where Terry Troppman was found passed out behind the wheel of her car while parked on the side of the road. Police suspected intoxication and administered a series of field sobriety tests, which Troppman failed. A partially consumed bottle of wine was found in her vehicle though Troppman denied drinking and driving. She said she had consumed the wine only while sitting in her parked car. Even though no one had witnessed Troppman driving after drinking, when she refused to submit to a breath test, her license was suspended.

The ruling by the high court affirms the act of refusal is sufficient to result in the revocation of one’s license.

Taipei, Taiwan – A Taiwanese businessman woke up in the middle of the road with more problems than headache. A nearby security camera captured the motorist passed out in his Mercedes Benz. It also documented that the driver was too drunk to realize that a passing thief had pulled him from the car and stolen the luxury car. To top things off, police also charged the businessman with drunk driving.

Pennsylvania, USA – A thief in America was not as lucky as his Taiwanese counter-part. Brian William Russ, 28, stole a vehicle and then passed out in the driver’s seat. He was found and arrested around 5:30 a.m., and charged with Pennsylvania DUI and receiving stolen property.

Wiesenburg, Germany – A man had a few too many beers and decided to use a heated bank ATM lobby to sleep off the effects. He was on horseback however and, due to a lack of a hitching post, he brought his horse, Sammy, into the lobby with him. A customer discovered the sleeping rider and his horse at 4:15 in the morning and alerted police. They woke the man and sent him on his way.

Ottawa, Canada – A 73-year old woman put her car in reverse, exited her driveway, drove across the street and struck a pole. She then continued in reverse through a church parking lot before hitting a parked car and coming to rest against handrailings on the front steps of the church. Though not injured, Lahja Pohjoisrinne was charged with driving while impaired and having a blood alcohol content over the legal limit.

Watford, England – Police were alerted to a suspected drunk driver attempting to leave a parking garage without paying. They found Jane Taperell, 36, at a closed barrier and when asked to back-up she did so only after flashing her bright lights and honking her horn. After a breath test showed her BAC to be above the legal limit, she was placed in the police car. Taperell tried to make a run for it but was subdued and booked at the Watford police station. There she refused to submit to another breath test that is part of normal procedure. Her attorney defending her behaviour by stating that she “was getting teased. She had wet herself during the incident and the officers were calling her pissy pants."

Rapper Wrecks Maserati and Is Charged with DUI

Rapper Eve was charged with California DUI after wrecking her gold Maserati on Hollywood Boulevard.

Eve was reportedly hit a center road divider around 2:45 in the morning in Hollywood, totaling the front end of her exotic car. She was ‘visibly upset’ while being handcuffed and led to a squad car by Los Angeles police for suspicion of drunk driving. Before posting bond, Eve was visited at 4:00 am by Sean Penn who, according to police, “came to see how Eve was doing.”

The singer (real name Eve Jeffers) is a multi-platinum Grammy winner. She has starred in movies and once had a self-titled sitcom.

Sex, alcohol and driving in Florida – Joe Conner was driving his Jeep in Fort Myers Beach when his passenger wanted to have sex while driving. At some point in the encounter, Conner lost control of his vehicle, hit three mailboxes and a guardrail before ending up in a ditch. A blood test revealed that Conner’s BAC was nearly three times the legal limit and he was arrested for Florida DUI.

More Florida sex– A Hillsborough County Sheriff’s Deputy is under investigation for having sex with a DUI suspect. Raymond Choy, 35, suggested he would not charge the female motorist with DUI if she cooperated. A DNA test confirmed a sexual encounter. Choy is on paid administrative leave until the outcome of an internal investigation.

Cutting more than grass in Louisiana – Larry Minniefield, 48, of West Monroe, was arrested for driving a lawnmower while intoxicated. Ouachita Parish sheriff’s deputies spotted Minniefield drive by on a John Deere lawnmower. A short time later Minniefield passed by again, driving in the middle of the road and showing signs of intoxication. He was arrested and deputies returned the lawnmower to Minniefield’s mother.

Brothers with a lot to talk about in Arkansas –De Queen resident Sebastian Nabor hit a curb while driving and responding officers suspected drunk driving. Sebastian attempted to avoid what would be his second Arkansas DWI by giving the arresting officer his brother’s name. Sebastian then made the mistake of calling his brother, Antonio Moreno Nabor, to bail him out of jail. When Antonio arrived and paperwork was filed, the plan unraveled. Police added criminal impersonation to the DWI charge.

Playing chicken in Massachusetts – David P. Rice, 53, careened off an Interstate 95 exit at high speed, drove across two grass medians, went airborne, cleared a guardrail and crashed into a barn and chicken coop. Both buildings were severely damaged and Rice killed nearly two dozen prized roosters and chickens. He was arrested for Aggravated Massachusetts DWI and Reckless Conduct.

Nevada Assembly Passes Bill That Requires Stay in Jail for DUI

The Nevada Assembly recently passed legislation requiring people arrested for Nevada DUI to stay in jail 12 hours so their blood-alcohol content drops below the legal limit.

The author of the bill, Mark Manendo, said the intent is to keep people from leaving jail and endangering others while still intoxicated. He cited examples of people being released within hours of a DUI arrest who still had a BAC over twice the legal limit.

Though the legal limit for drunk driving in Nevada is .08, Manendo’s proposal calls for holding DUI offenders in jail until their BAC reaches .04.

Drive-thru convenience in Wisconsin – Michael W. Crawford was charged with his fifth Wisconsin DUI after being arrested after placing an order at a McDonald’s drive-thru. When approached by a local sheriff and asked how much he had to drink, the 47-year old Sheboygan man said “too much,” and told the officer not to bother with a field sobriety test because he was drunk.

Carting around in Florida – A deputy sheriff was a little surprised to see a go-cart with no headlights go zipping by on a dimly lit road at 4:00am. Jeremiah Whetstine, 23, of Astor was too impaired to stand when stopped and arrested for Florida DUI. He told the deputy he was on his way to McDonald’s.

Another drive-thru in Pennsylvania – Lisa Klenchik, 39, got more than a burger and fries at a Towanda Burger King drive-thru. State police were called to the restaurant around 4:30 after Klenchik appeared “incoherent and confused.” She was charged with Pennsylvania DWI.

Having it her way in Virginia – Drema Johnson, 40, didn’t quite get it her way after driving through a Burger King and Hardee’s in Verona. Employees alerted police around 4:00 pm after detecting a strong smell of alcohol, and noticing that Johnson was nude from the waist down. While being charged with DUI, Johnson, 40, told officers she had just had a sexual encounter with a friend and was hungry.

Bumper cars in North Carolina – Police were called to a McDonald’s in High Point after a man started ramming cars in the parking lot. Robert Sterling Padgett, 27, was charged with North Carolina DWI and careless and reckless driving. Four cars, including Padgett’s, were damaged.

Houston Area Fights Texas DWI With Signs

Montgomery County has joined a Texas Department of Public Safety special program aimed at reducing DWI. Red and yellow billboards educate and warn motorists on Interstate 45 of the dangers of driving under the influence. The signs have a picture of a wrecked vehicle involved in a fatal accident and indicate the number of alcohol and drug related vehicular deaths and injuries along the highway during 2006. Drivers are also encouraged to call 911 if they suspect a drunk driver is on the road.

The signs were paid for and installed by the Texas Department of Transportation. Similar signs were placed in Harris County two years ago along roads known to have a higher number of traffic fatalities and injuries. Nearby Galveston and Brazoria counties have expressed interest in joining the DWI awareness program.

Montgomery County has been recognized by the state for its DWI and speeding enforcement. The county sheriff’s office has received federal funds for enforcement programs and judges are on standby to authorize warrants for blood tests when motorists are suspected of driving while intoxicated. The number of Texas DWI arrests in Montgomery County has increased in each of the past three years.

Former Footballer Warren Moon Arrested for DUI in Washington

Former NFL Football Hall of Fame quarterback Warren Moon was arrested for suspicion of Washington DUI around 2:00 am Friday after police stopped him for speeding in downtown Kirkland.

According to the police report, Washington State Patrol officers suspected the presence of alcohol and Moon was arrested. He was taken to the Kirkland police station to test his blood alcohol level. Results of the breath test will not be released until charges are filed by the King County prosecutor’s office. Moon’s vehicle was impounded.

The 50-year-old Moon played at the University of Washington, and was the most valuable player during a Rose Bowl victory over Michigan in 1978. He started his pro career playing for the Edmonton Eskimos of the Canadian Football League, leading the team to five consecutive Grey Cup victories. Moon played 17 seasons in the NFL with the Houston Oilers, Minnesota Vikings, Kansas City Chiefs and Seattle Seahawks. He retired after the 2001 season. He was elected to the Football Hall of Fame in Canton, Ohio last August.

Recently, Moon has been an analyst on Seattle Seahawks radio broadcasts.
