Actor Mickey Rourke Charged with DUI in Florida with a BAC of .081%

Actor Mickey RourkeMickey Rourke was charged with suspicion of Florida DUI while riding a scooter. Rourke reportedly left a nightclub with a female companion shortly after 4:00 am, jumped on his 2007 Vespa and proceeded to make an illegal u-turn at a red light right in front of the police.

Miami Beach police say Rourke then drove erratically, weaving between lanes and down the center of the roadway. After being stopped the 51-year old actor asked,

Rebecca De Mornay Arrested for DUI

Rebecca De MornayActress Rebecca De Mornay was stopped for a traffic violation, then Los Angeles cops smelled alcohol and arrested her for DUI because her BAC was .09%.

De Mornay has been arrested for suspicion of Driving Under the Influence in Los Angeles, California on October 30th. She was stopped around 10:30 pm for a traffic violation in Beverly Hills near Sunset Boulevard, and police detected alcohol on her breath. De Mornay reportedly registered a blood alcohol content of .09%, slightly above the legal limit of .08%.

She was booked for driving under the influence and released around 1:00 am.

Driving without pants in New York – Michael C. Schupner was stopped for suspicion of drunk driving in Ulster County around 2:45 in the morning. The deputy noticed, as he approached the vehicle, a can of beer spilling onto the back seat. When asked to step out of the car the police saw that Schupner was not wearing any pants. It was determined he had taken them off because they were wet from urine and spilled beer. Schupner refused a field sobriety test and breath test and faces five charges including felony New York DWI.

Arrested for drunk driving while on the way to court in Canada – A 54 year old Vancouver man, stopped for suspicion of drunk driving, mentioned to the arresting officer that he was on his way to court for a previous DUI charge. He has been charged with several new offenses, had his driver’s license suspended and his car impounded.

Officer with DUI suspect in police cruiser hit by another DUI suspect in Idaho – Deputy Steven Craig of the Ada County sheriff’s department was transporting an 18-year old arrested for drunk driving to jail when his cruiser was hit by Earl Hanson. Hanson, 44, was determined to have a blood alcohol content above .20 and he too was charged with Idaho DUI. No one was seriously injured in the crash.

New York firefighter shoots colleague while drunk – Volunteer fireman Stanley Memmelaar was charged with reckless endangerment, assault and DWI after he discharged a weapon inside the Moyers Corners Fire Station One and hit a fellow firefighter. Memmelaar, 26, was determined to be drunk when he accidentally pulled the trigger of his gun and hit Tyler Drake in the arm and chest. Memmelaar had been a Sheriff’s Deputy recruit but was released last August for undisclosed reasons.

Gary Collins Charged with California DUI

Gary CollinsGary Collins was charged with a DUI in California after being involved in a traffic accident in Sherman Oaks in the San Fernando Valley north of Los Angeles. The TV host and actor was driving a 2004 Ford Explorer when he was struck by an elderly driver in a Toyota. Train in Oregon – Robert Gillespie, of Eugene, was charged with Oregon DUI after running into the side of a Union Pacific freight train. Gillespie was trying to read a text message to his mobile phone around 2 in the morning when the accident occurred. Despite being trapped in his vehicle, Gillespie’s injuries were not life threatening.

Police cruiser in New York – Around 1:45 am Robert Hoar, of Flower Hill, crashed his 1998 Lincoln into the back of a marked Nassau County police cruiser, and then drove away. The police officer in the cruiser was uninjured. Other officers from a nearby precinct stopped Hoar nearly a mile away. After failing a field sobriety test, Hoar was charged with drunk driving, among other things.

A patrol car in Florida – A Flagler County Sheriff’s Department SUV was rear-ended while stopped at a red light. The motorist, 29 year-old Tony Garren, was taken to a hospital with minor injuries and then arrested for Florida DUI. The police officer also suffered minor injuries.

Another patrol car in Florida – Terry Gene Hughes, of Melbourne, crashed into the back of an off-duty police officer’s car on a Sunday afternoon. He then fled the scene and was stopped by another officer nearby. Hughes, 39, was found to have an open container and a young child in his car. He fought with officers and kicked at the door of a patrol car during his arrest. Hughes was charged with driving under the influence, DUI with injuries, DUI with property damage, refusing to take a breath test, criminal mischief, accident involving damage to a vehicle and or property and child abuse.

This Weeks Peculiar Drunk Driving Stories

Twice in three hours in Louisiana – Around 10:30 pm Tangipahoa Parish deputies arrested Richard M. Pierson at a DWI checkpoint, charged him with Louisiana DWI and released him on his own recognizance. Around 1:40 am Pierson was charged with a second drunk driving offense while attempting to drive a different vehicle through the very same DWI checkpoint.

Twice in three hours in Tennessee – Around 4:30 pm, a Marion County Trooper stopped Craig McDiffett for swerving while driving and charged him with Tennessee DUI after he admitted to mixing anti-psychotic pills and vodka. McDiffett is booked around 6:00 pm and then released shortly after 7:00 pm when his wife posted bond. Less than three miles from the jail, McDiffett crashed a truck into a tree along an interstate highway. After being airlifted to a local hospital he was charged with his second DUI for the day.

Twice in one day in North Carolina – Gaston County police charged James Smith with North Carolina DWI after a breath test revealed he had a blood alcohol content above the legal limit. He was released after promising to return to court. Five hours later, Smith’s neighbors described him as a falling down drunk yet that did not stop him from getting in his truck and driving off. Smith was stopped less than half a mile away by the same police officer from earlier in the day, at which time Smith jumped out of his truck and attempted to push it through an intersection. After being booked for his second DWI, he confessed, “I was so intoxicated I didn’t even know what my name was.”

Phoenix Moving to Blood Test for DUI Suspects

Phoenix has joined other Arizona cities in the movement to rely on blood tests to identify drunk driving suspects. Advocates say that blood tests are more accurate than breath tests for determining blood alcohol content. The Phoenix Police Department has set a date of 2010 to accept only blood based evidence in DUI court cases.

Arizona DUI defense attorneys have long argued the problems associated with breath samples for determining a legal threshold in drunk driving cases. Aside from equipment calibration and maintenance issues, discrepancies in readings can occur through incorrect administration of the test. As recently as the year 2000, nearly 1,400 Arizona DUI cases were dismissed in Phoenix and Glendale alone due to legal challenges to the machine results. To complicate the issue, a new Arizona law requires the installation of an ignition interlock device for everyone convicted of DUI, even first time offenders. With the consequences so high, the need for accuracy becomes even more important.
