Man Charged With Colorado DUI after Friend Falls Out of Truck Bed

Police in Colorado Springs have arrested a man following an accident where his friend fell out of the bed of his moving truck. Brandon Davis was driving his 1996 Dodge Ram and two friends were standing in the bed of the truck. While turning left, Jason Matthews was ejected and he landed on the roadway suffering life threatening injuries.

Davis proceeded to flee the scene. Police found his truck outside his home and arrested him after a brief stand-off.

Davis was charged with driving under the influence in Colorado, vehicular assault and hit-and-run.

Arizona DUI after Crash on Interstate 10

Around 6:30 Thursday morning, the driver of a Mercedes Benz, allegedly traveling at a high rate of speed, lost control, went into the center median of Interstate 10, re-entered the highway and collided with a semi-tractor trailer truck. The Mercedes continued about a quarter mile before coming to a stop. The truck ended up jack-knifed in the median.

The Mercedes driver suffered serious injuries and a female passenger was slightly injured. She initially told police that she had been kidnapped, though she later recanted her story. Both the driver and passenger were transported to a local hospital.

A Department of Public Safety spokesperson said that the driver will be charged with driving under the influence in Arizona, endangerment and criminal damage. Interstate 10 was re-opened around 10:15 am.

Tennessee DUI Suspect Nabbed for Deployed Airbags

An Elizabethton Police officer noticed a car being driven with deployed airbags and initiated a traffic stop. That observation lead to an arrest on multiple charges, before the accident that caused the airbags to pop was reported.

After motorist Adam Leibers was stopped, he admitted to being drunk and to hitting another vehicle. While conducting an ensuing field investigation, the 911 emergency center reported a nearby hit-and-run accident.

Leibers, 24, was charged with DUI in Tennessee and leaving the scene of an accident.

Former 'Bachelor' Contestant Arrested for DUI in Florida

A former bachelorette on the television show ‘The Bachelor’ was arrested early Thursday morning for driving under the influence in Tampa, Florida. Maribel Delgado was stopped around 12:45 am after a police officer suspected impairment. Delgado admitted to having been drinking though refused to submit to a breath test to check blood alcohol content. She was taken into custody and booked on misdemeanor Florida DUI charges. Delgado posted $500 cash bond and was released around 10:00 am.

The Cuban-born Delgado appeared in two ‘Bachelor’ contestants. In season six of the ABC television show, she won a proposal from pro bass fisherman Byron Velvick. The two did not marry, and then ended the relationship in 2009.

Delgado, 42, is a former cheerleader for the Tampa Bay Bucaneers NFL football team. She has two prior alcohol related arrests on her record. In November 2007 she was charged with battery while intoxicated after hitting her fiance in the mouth. One year later she got into a drunken brawl at a Texas nightclub that included a fight with police.

Single Incident Yields Three Minnesota DWI Arrests

Sheriff’s deputies in Winona County report an unusual incident that lead to multiple charges of driving while intoxicated in Minnesota. A young girl was at the wheel of a car on County Road 12 near Witoka when she mistook the gas for the brake and lost control of the vehicle in a curve. She hit a highway sign and continued to drive through a yard and into a garden. At that point, the 19-year old passenger in the vehicle, Benjamin R. Repinski, got behind the wheel and tried to extricate the vehicle, only to hit a shed.

The responding deputies learned the unidentified girl did not have a driver’s license because she was only 12 years old. Benjamin Repinski said that he had been at a party with the young girl and she had been driving him home. A preliminary breath test showed the girl had a blood alcohol content of .09%. Charges of DWI in Minnesota are being considered. Repinski was charged with drunk driving in MN, as well as underage drinking and driving, underage drinking and for allowing an unlicensed person to drive.

The girl was taken to a local hospital, complaining of side and back pain. She refused to provide a blood sample to test her BAC.

Meanwhile, a deputy dispatched to interview the girl at the hospital noticed a moped driver wearing sunglasses at night and driving wobbly down the road. When stopped, the driver said he was on his way to pick up a friend, Repinski, who had called for a ride after the accident. Daniel G. Arndt was also arrested for Minnesota DWI.

A sheriff’s deputy said, “A 12-year old driver, we don’t get them everyday”.

Police Officer Tasered During Minnesota DWI Arrest

An Anoka County Sheriff’s Department deputy is facing multiple charges following an arrest for DWI in Minnesota where he reached for an officer’s gun and was tasered three times. Lawrence John Doheny was stopped in the southern part of the state for a traffic violation. A Jordan police officer detected alcohol on Doheny’s breath and suspected intoxication. Doheny admitted to having consumed a few beers, and when asked to exit his vehicle he stumbled. He refused to perform field sobriety tests and was placed under arrest for suspicion of driving while intoxicated in Minnesota.

Doheny was taken to the Jordan Police Department and asked to have his urine or blood tested for blood-alcohol content. He offered to submit to a breath test, which is not an option in Scott County. Doheny then said, “you guys nailed me” and agreed to a blood draw at a local medical facility. While being escorted to the hospital, he reached for an officer’s gun and threatened the officer by saying they shouldn’t test him. As the officer secured his gun and called for back-up, Doheny pushed the officer in the chest and started to flee. When Doheny refused the officer’s command to get on the ground, he was hit with a taser gun. He continued to try to escape and was tasered two more times.

Doheny was restrained and taken to the hospital where a blood sample was taken. The results will not be known until processed at a state lab. Doheny was reportedly belligerent to the hospital staff. He faces charges of DWI test refusal, drunk driving in Minnesota and obstructing an officer with force. If convicted of all charges, Doheny, 49, could be fined $7,000 and sentenced to jail for 27 months.

NY Man Jailed for Arriving at Court Drunk

Frank Simone, of Mountaindale, was scheduled to appear in court to face charges of aggravated drunk driving in New York, misdemeanor assault and child endangerment. When he showed up for a 1:00 pm court appearance, Simone was visibly intoxicated. The judge cautioned him several times for being belligerent before finding him in contempt of court.

Simone, 48, was sentenced to the Sullivan County jail for 15 days.

UPDATE:Texas Tech Officer Placed on Administrative Leave

A Texas Tech campus police officer has been placed on administrative leave following an incident where she is thought to have let an intoxicated driver go free. Around 4:50 am on August 1, the unnamed female officer stopped Michael Aaron Garcia for a traffic infraction. Garcia claims the officer told him he would not be charged with Texas DWI if he found a safe ride home. Garcia was taken home by his relatives. A little over an hour later the Lubbock Police Department responded to a scene where Garcia was threatening his relatives because they thought he was too intoxicated to drive. That incident lead Garcia to be charged with arson and assault.

Now University officials want to know about the initial traffic stop. It is unclear if Garcia was actually impaired at 4:50 am, though he did tell Lubbock officers about the offer from the campus cop. The initial reason for the traffic stop is not documented in computer records, nor is there a reference to Garcia driving while intoxicated. As Garcia is under 21-years of age, he was subject to arrest for any detectable presence of alcohol. Texas DWI law says it is the discretion of a law enforcement officer to make an arrest for drunk driving, and while the university policy mandates that officers follow state law, it does not specify specific action for suspected DWI traffic stops.

In a related issue, the investigation will try to determine why three outstanding misdemeanor warrants for Garcia’s arrest apparently did not appear in a routine check.

An administrative leave is not an indication of wrong-doing on the part of the Texas Tech officer. It is considered standard action at most law enforcement agencies while an investigation is being conducted.

As of August 10, Garcia remains jailed on $74,000 bond.

Tennessee Man Stopped for Lawn Mower DUI

Lonnie Michael Haney was stopped in Olive Springs, just outside the Oak Ridge city limit, in East Tennessee and charged with DUI. Haney was riding his John Deere lawnmower at the time. The arresting officer said that Haney was swerving down a major 4-lane boulevard. The suspect exhibited signs of intoxication, including slurred speech, a strong odor of alcohol and red glossy eyes.

Haney, 46, failed a field sobriety test and refused to submit to additional tests. He said he was driving to Hilltop Market in Oak Ridge. The officer had to place a protective helmet on Haney because he continued to bash his head against the protective cage in the police cruiser.

It was Haney’s fifth arrest for driving under the influence in Tennessee, and charge was filed as a felony. He was also charged with refusal to submit to a breath or blood test.

Woman Gets 2 Ohio DUI Charges in Two Weeks

A Northern Ohio woman has been charged with her second offense for driving under the influence in 12 days. Heather M. Leyda reportedly lost control of her 1998 Pontiac Grand Prix, drove off the left side of the road and struck a highway barrier. She was not injured though a test for blood alcohol content registered .194%. The legal limit for intoxication in Ohio is .08%.

Leyda, 25, was booked at the Ottawa County Detention Center and held Wednesday morning on $4,000 bail. She is scheduled to appear in court on August 18.

Leyda has another pending case from July 30 charges of DUI in Ohio and resisting arrest in Erie Township. A sheriff’s deputy observed her erratic driving around 2:00 am and followed her to a rest area. According to the arrest report, Leyda appeared highly intoxicated with glassy eyes and an odor of alcohol. She refused to submit to field sobriety tests and at one point told the officers that she was leaving. When told she was under arrest, she resisted and began yelling at the officers. Her bond in that case was set at $9,025.
