West Virginia Drunk Driving Penalties

In the state of West Virginia, any penalties you may be facing as a result of a DUI charge depends on your blood alcohol content (BAC) at the time of your arrest. If you are a first time offender who is arrested with a BAC of 0.08% – 0.15% you are facing a “normal” DUI charge in West Virginia. If you are found guilty you face up to 6 months in prison and a fine of $100-$500. Furthermore, you may be facing a 6 month license suspension. The length of your license suspension can be reduced with the completion of DUI classes and by enrolling in West Virginia’s ignition interlock program.

If you are arrested with a BAC of 0.15% or higher you are facing what is known as an aggravated DUI. If you are found guilty you can be placed in jail for a minimum of 48 days and for up to 6 months. You are also facing a $200-$1,000 fine. Furthermore, your license will be suspended for 45 days with mandatory participation in the ignition interlock program to follow for 9 months.
