Former UT Longhorn Baseball Player Charged with Texas DWI

Former University of Texas baseball player Juston Street was arrested for driving while intoxicated in Austin early Saturday morning. Street was traveling westbound on MLK Boulevard around 2:50 am when his pick-up truck struck the right side of another westbound vehicle.

According to the arrest report, Street had watery and dilated eyes and a strong presence of alcohol. He failed a field sobriety test. Street admitted to having consumed four beers and to have taken prescription

State Senator Charged with Alabama DUI

Democratic State Congressman Zeb Little was arrested by State troopers last Friday for suspicion of drunk driving in Alabama. Little was involved in an accident on Interstate 65 in Jefferson County and then fled the scene and had to be pursued and stopped. The officer detected alcohol and Little was charged with the offense of driving under the influence in Alabama.

Little was also charged with failure to stop for an emergency vehicle, having an open container in his vehicle and driving with an expired license. Little was booked at the Jefferson County Jail, where he refused to submit to a breath test. He posted bond and was released after about an hour in lockup.

Little is the majority Senate leader in the Alabama state Congress. He issued a statement apologizing to his family and constituents and stating that Alabama DUI is a terrible offense. He went on to say that he will take full responsibility for his actions.

Former Congressman Charged with New York DWI

Former state Republican congressman John Sweeney was arrested early Sunday morning for suspicion of driving while intoxicated in New York. State Police stopped Sweeney for speeding and booked him on NY DWI charges around 3:30 am. He refused to submit to a breath or blood test. Sweeney posted bail and was released around 6:00 in the morning.

Sweeney was convicted of drunk driving in New York in late 2007. His license was suspended for six months and, as part of his plea deal, he was required to pay a fine, enroll in alcohol education classes and attend a DWI victim impact panel. As this is then his second drunk driving offense, under NY DWI law it will be filed as a felony. Because he refused to have his blood alcohol content tested, the DMV will move to suspend Sweeney

Redmond O'Neal Kicked Out of Rehab

Redmond O’Neal, the son of actors Ryan O’Neal and Farrah Fawcett, was reportedly ordered to leave a rehab facility last Wednesday after testing positive for drugs. Redmond had entered the Clearview Treatment Center as part of his probation terms following an arrest for driving under the influence in CA last June.

The 24-year old was had pled not guilty to charges of drug possession. He is due back in court May 14.

Man Loses Ferrari and Receives Texas DWI

Texas DWIA man suspected of driving while intoxicated in Texas got his 2000 Ferrari stuck on rail tracks and narrowly escaped before the vehicle was smashed by a train.

Jeff Sabold called 911 around 3:30 am and said that he was scared, lost and stranded on a railroad track crossing. When he told the operator that a train was coming, Sabold was told to get out of the vehicle immediately. He managed to get to safety moments before his Ferrari was struck by a train traveling 40 miles per hour.

Sabold, 48, lives in Carrollton, north of Dallas, and he thought he was in Mansfield, south of Fort Worth. He was actually over 100 miles away in Sherman, Texas.

Deputy's Conduct Jeopardizes Florida DUI Cases

A Broward County sheriff’s deputy has been charged with misdemeanor battery after two women filed complaints that he had touched them inappropriately. Charles E. Grady is accused of touching the women during traffic stops. His actions have lead prosecutors to reduce or drop charges in dozens of cases in which Grady was involved, including cases of driving under the influence in Florida.

The sheriff’s office said that Grady engaged in ‘inappropriate contact’ with two women. In one case he was involved with testing a female suspected of drunk driving in Broward County. The woman’s defense attorney said that Grady touched her in a way that was “not within the parameters of his job.” A second incident involved a 20-year old woman who reported Grady’s touching to Fort Lauderdale police, who began an investigation. The contact was described as “deliberate and unwelcome.”

Grady, 39, had been with the BSO for 12 years and served on the Florida DUI task force for a period of time. He arrested 303 motorists on suspicion of DUI in Broward County in 2007, earning him special recognition. Since the filing of the battery charges, Grady has resigned from the force. An internal investigation is still being conducted and Grady is scheduled to be arraigned on May 13.

Three Arrive Drunk at New York DWI Victim Panel

Police in Glen Falls, NY say that three people ordered to attend a DWI victims panel showed up at the meeting drunk. The three were defendants convicted of driving while intoxicated in New York who were required to hear stories from those who had lost someone to a drunk driver.

One of the panel members, who had lost both a father and grandmother to drunken drivers, said that occasionally someone will show up drunk but three intoxicated defendants was offensive. Stating they apparently were not ready to learn the lessons of drunk driving in NY, the panel member hoped the judge would lock the three up.

Each of the three defendants registered a blood-alcohol content just below 0.22%. The legal limit for intoxication in New York is .08%. Police request breath tests from those suspected of being intoxicated, before they join the victims group.

Austin Police Chief on Hot Seat During Blood Draw Forum

Citizens of Austin packed the city council chambers Monday to confront Police Chief Art Acevedo on his ‘no refusal’ blood draw program. The chief was grilled about his controversial plan, and the criticism led to anger and strong words during the public forum.

Last Halloween, police officers first used an aggressive DWI enforcement plan calling for mandatory blood draws from all motorists who refuse to take a breath test when suspected of driving while intoxicated in Austin, Texas. The officers were armed with warrants signed by a judge requiring a blood sample from anyone they suspected of drunk driving. Texas law stipulates that blood draws to check for alcohol impairment are sought only after an accident that resulted in injury.

Acevedo said he felt it appropriate to use all tools at the department’s disposal to keep people safe, and to hold motorists responsible.

Besides challenges to the legality of the plan, forum attendees questioned the use of force when taking a blood sample and whether officers were the correct entity to make the blood draw. Issues of contamination during the drawing, handling and storage of a sample were raised, as were concerns about police tampering. Acevedo said that force is not an option and that cameras are being considered for the blood draw area.

Still, emotions over police demanding and then taking blood from motorists were very strong. The meeting became so heated that a councilmember threatened to close the forum.

Acevedo is seeking approval from the city council to allow officers to train at the Austin Community College and then be permitted to draw blood. He said that he has 50 officers who have expressed interest in the training process. If his plans are not approved by the council, Acevedo said he would like to hire seven phlebotomists to make blood draws.

Councilmembers have expressed concerns over the logistics of the blood draw program and the role of police in the process, in addition to the city’s liability. Texans for Accountable Government, who sponsored the council forum, are said to be drafting a resolution to prevent officers from drawing blood.
