Olympic Gold Medalist Busted for DWI in New York

An athlete who won a gold medal at the 1996 Olympics in Atlanta has been charged with suspicion of driving while intoxicated in New York. Derrick Adkins was stopped in his Nissan sedan for drifting in his lane shortly before 2:00 am on August 29. He told the State Police officer he had consumed two glasses of wine at a bar. The officer had Adkins perform a field sobriety test and submit to a breath test. Adkins’ blood alcohol content was reportedly .15%, nearly twice the .08% legal limit for intoxication.

Houston Texan Football Player to Enter DWI Diversion Program

Jacoby Jones Houston DWIWide receiver for the NFL Houston Texans Jacoby Jones is due in court this morning and he is expected to enter a guilty plea to driving while intoxicated in TX. As part of a plea agreement, Jones with enter the DIVERT program for one year. The special program set up by the Harris County District Attorney’s office allows qualifying defendants who have been charged with DWI in Houston to plead guilty and then have the case expunged after one year if stringent conditions are met. The defendant would be required to enter alcohol education classes and install an ignition interlock device on their vehicle. In some cases, the defendant must wear an alcohol detecting bracelet and be tested regularly on a home breathalyzer.

According to the Assistant District Attorney who developed the program, 490 Texas DWI defendants have qualified for DIVERT. The program started on August 1 of this year.

Jones was arrested for suspicion of driving while intoxicated in Houston on March 16, 2008 after police found him around 3:00 am asleep behind the wheel of a late model Nissan Altima stopped in traffic. Jones reportedly registered a blood alcohol content of .135%, substantially higher than the .08% legal threshold for intoxication in Texas.

Sunday Beer Run Leads to Georgia DUI

Robert Keefer Dell walked into a convenience store in Canton Georgia to purchase a six-pack of Michelob beer. Sales of alcoholic beverages are not allowed on Sunday though that did not stop Dell from ripping the neon orange tape stretched across the coolers and grabbing the beer. The clerk tried to stop him, explaining to his regular customer that he would get in trouble if he sold him the beer. Dell responded by placing $6 on the counter and walking out of the store. When the clerk followed him, things went from simple shoplifting to an escalating series of crimes.

Dell lifted his shirt to reveal a handgun in his waistband. That made the offense an armed robbery, a felony in Georgia. Dell then fled into the neighboring county where he led Georgia State Patrol and Pickens County deputies on a chase. Dell struck one patrol car and attempted to run over an officer. He was eventually stopped when officers rammed his truck.

Dell was booked at the Pickens County jail on charges of fleeing police, aggravated assault and driving under the influence in Georgia. He also faces a warrant for armed robbery in Cherokee County.

The store clerk said he thought something was wrong when Dell stumbled around the store and grabbed the Michelob instead of his usual Natural Ice. Dell also didn’t put down enough money for the $8.99 six-pack of Michelob.

DUI Conviction Keeps International Couple Separated

Many do not realize that Canada has strict limits on those you can enter the country, even for recreation and tourism. One couple found out the hard way that the restrictions apply to those with a DUI conviction.

David Williams, an American, and Janeane Ardiel, a Canadian, married five months ago and now find themselves limited to meetings at the border. Williams was convicted of driving under the influence 6 years ago. Canada denies entry to those with a felony conviction as well as many with misdemeanor offenses such as reckless driving, theft, drug possession and drunk driving. It does not matter how long ago the offense occurred.

To make matters worse, in July US border agents noticed Ardiel’s near weekly visits to the United States and denied her entry because of fears that she would seek to live in the country rather than just visit. She was photographed, fingerprinted and told not to try to enter the US again for six months.

The couple is in the process of seeking a green card for Ardiel, though the process can take six months or longer. Williams can seek to prove ‘rehabilitation’ for his past DUI arrest but it is not a simple process and he reportedly has more pressing economic priorities at the moment.

In the mean time, the couple meets at the Peace Arch near Blaine Washington, a no-man’s land along the international border accessible to both without technically leaving their respective countries.

Man Charged with Florida DUI after Passing Breath Test

Vincent Tallo was driving home after an evening of dancing with his friend Mary Debenedetta when he was stopped at a sobriety checkpoint in Cape Coral. The 72-year old man told the officer that he had sipped one beer over two hours. The officer required him to perform several field sobriety tests and declared Tallo under arrest for suspicion of driving under the influence in Florida.

Tallo requested a breath test and he registered a .000% BAC. The elderly man was then taken to a portable toilet and asked to provide a urine sample. A preliminary result, which tests for 12 drug classifications, revealed something that the police did not like and they proceeded with the arrest for DUI in FL. The official result from the state lab will take some time. Debenedetta told the police that Tallo is a health-nut and doesn’t even take Advil. The Cape Coral police say that they are convinced there was enough indication of impairment to initiate the arrest.

Tallo’s vehicle was impounded, and he and Debenedetta, 62, were forced to walk two miles to her house after midnight. A police sergeant explained that the couple just didn’t ask officers for a ride.

The couple is fighting the charges, and Debenedetta said “I want other people to not go through this ever.”

Michigan Woman Drives Son to School While Drunk

Ferndale Michigan police arrested a mother for drunk driving after she stopped to ask for directions. Dena Ellington was trying to locate the Coolidge Intermediate School to drop her 9-year old son off at school. She pulled her Land Rover into the parking lot of Taft Education Center shortly after 8:30 am to ask a police officer for help. The officer detected alcohol and initiated an OWI/DUI investigation.

According to the arrest report, Ellington registered a blood alcohol content of .29%, more than three times the legal limit for driving while intoxicated in Michigan. The Oakland County resident was booked on charges of drunk driving in MI while an officer took the child to school.

It is Ellington’s first intoxication arrest. Police are considering elevated charges because the passenger was under 16-years old. If convicted, Ellington could face an additional six months in jail for having a minor in the vehicle.

Teacher Arrested for Alabama DUI on Way to School

A teacher on her way to work September 1 was arrested for suspicion of driving under the influence in Alabama. Around 8:00 in the morning Suzanne Morrison was observed driving erratically on Interstate 10 and drinking from a cup when she was stopped by law enforcement officers. The officers detected a strong odor of alcohol and initiated a DUI investigation. A cup with alcohol was found in the vehicle and Morrison failed a field sobriety test. She also submitted to a breath test though the results are not known.

Morrison is a former Teacher of the Year at the Chickasaw School of Mathematics and Science. She was reportedly on her way to work for the Mobile County School System when the traffic stop was initiated. Morrison was booked on charges of DUI in Alabama at the Mobile County Metro Jail. As of Tuesday evening she remained in jail on $1000 bond.

The county school system said that Morrison, 42, had been placed on administrative leave until completion of the police investigation and the breath test results for confirmation of intoxication.
