New Georgia DUI Law Requires Money for License Hearing

Gov. Sonny Perdue recently signed into law a measure requiring a payment to be made with all requests for license hearings following an arrest for DUI in Georgia. Typically following an arrest for DUI in Georgia, the Department of Driver Services (DDS) will seek to administratively suspend a motorist’s driver’s license. The accused has the right to challenge the suspension by requesting an Administrative License Suspension (ALS) hearing. Effectively immediately, a filing fee of $150 must accompany a request for an ALS hearing.

Both the hearing request and the fee must be submitted to the DDS within 10 business days following an arrest for driving under the influence in Georgia. Failure to make the request on time or making the request but not including the filing fee would lead to the automatic suspension of license, with no opportunity for appeal.

The $150 fee is payable to the Georgia DDS, and personal checks are accepted.

New Minnesota DWI Law Signed by Governor

Governor Tim Pawlenty signed legislation calling for mandatory installation of an ignition interlock device for certain Minnesota DWI offenders. The new law allows those convicted of driving while intoxicated in Minnesota to recover their driving privileges if they agree to install the special device. An ignition interlock acts as a small breath tester, and a driver must provide a breath sample before starting the vehicle. If the sample exhibits alcohol above a pre-set limit, the ignition will become disabled and the vehicle will not start for a set period of time. The device also requires periodic retesting to prohibit a motorist from having someone else provide a breath sample.

Under the new Minnesota DWI law, drunk driving offenders who register a blood alcohol content at or above .16% (twice the legal limit) will be required to install an ignition interlock. Those who opt for the interlock device will have their full driving privileges restored immediately. Those who do not will have their driving privileges suspended for a period of 1 to 6 years, depending on the degree of the offense and other factors. Repeat offenders with three or more DWI arrests in Minnesota in a 10-year period will also be required to install the device.

Minnesota started an ignition interlock pilot program in mid-2009 that allowed more than 1000 motorists convicted of DWI in MN to regain their driver’s licenses.

The Minnesota Department of Public Safety hopes the new measure will reduce the number of chronic drunk drivers on state roads, in turn reducing alcohol related traffic fatalities.

Lindsay Lohan

Lindsay Lohan could not make a mandatory court appearance on Thursday, May 20 and the presiding judge issued an arrest warrant for the actress. After a bond of $100,000 was posted for her the same day, the warrant was recalled.

Lohan is facing probation violation stemming from the second of her two infamous arrests for driving under the influence in California. Under the terms of her plea agreement she was to attend an alcohol awareness meeting weekly and report her progress to the court regularly. Lohan has routinely snubbed the court, even showing up two hours late for one early morning appearance.

During the latest development, Lohan claimed that her passport had been stolen or misplaced while in France for the Cannes Film Festival. Lohan’s defense attorney said that paperwork had been filed with police regarding the loss of the passport, and went so far as to say that his client had intended to attend an alcohol education class the very morning of the scheduled May 20 hearing. Superior Court Judge Marsha Revel dismissed those claims and issued the arrest warrant, stating that “she (Lohan) has a history of

Texas DWI for Man Who Helped Brother

Police in Roanoke Texas pursued a driver they say was speeding and weaving in and out of traffic. The suspect, Raymond Smith, was actually taking his brother Gerald, who was suffering from a heart attack, to the hospital.

The dash cam evidence only shows Smith driving to a local hospital, with his emergency flashers on, and not through traffic. Smith even says, “sorry for the inconvenience officers” as an arrest is initiated. He passed a field sobriety test though declined to take a breath test. Smith was charged with driving while intoxicated in Texas and evading police.

Smith’s brother survived the heart attack.

Billionaire Polo Mogul Charged With Florida DUI

Billionaire John Goodman has been charged with driving under the influence in Florida and manslaughter following an accident that claimed the life of another driver. The founder of the Polo Club of Palm Beach was driving his Bentley in the early hours of February 12 when he struck a Hyandai driven by Scott Wilson. Wilson’s vehicle ended up in a canal and he drowned.

Goodman arrived at the Palm Beach County Jail around 6:00 am on May 19, after an arrest warrant was issued the day before. His bond was set at $100,000.

Goodman was charged with DUI in FL causing death, manslaughter and failure to render aid. The victim’s family has filed a civil suit against Goodman for wrongful death.

Amare Stoudemire's Mother Arrested in Scottsdale Arizona

The mother of Phoenix Suns basketball player Amare Stoudemire was arrested last Saturday after a traffic infraction in Scottsdale. Carrie Mae Stoudemire was stopped around 3:30 pm for straddling two lanes and speeding. According to the police report, her eyes were watery and glassy. The officers then noticed that she was in violation of Arizona DUI law for not having an ignition interlock device in her vehicle. Stoudemire’s driver’s license indicates that she must have this device in her vehicle until October 30 of this year because of an Arizona DUI conviction.

Stoudemire claimed the SUV she was driving was a rental vehicle and she was unaware that the ignition interlock was required in all vehicles she operates. She said that she was driving to an alcohol education class, another condition of her sentence. After Stoudemire refused to perform field sobriety tests, she was arrested and placed in a squad car.

Amare arrived on the scene in a Bentley and Carrie started yelling for her son, asking him to get a lawyer. Police recognized the Suns player and asked him to leave because his presence was causing his mother to “act out”. Amare complied.

Carrie Mae Stoudemire, 54, was booked at the Scottsdale jail for speeding, a lane violation and operating a vehicle without a mandated ignition interlock. She has a history of incidents with the law, including drunk driving, drug possession and prostitution. She was sentenced to three years in prison in 2006 for aggravated DUI in Arizona involving an accident.

Fishing Opening Weekend Brings Extra Minnesota DWI Patrols

The opening weekend of the fishing season will have sportsmen heading to lakes across Minnesota. To reduce drunk driving and alcohol related accidents, the Departments of Public Safety and Transportation will be staging extra DWI patrols. The heightened MN DWI enforcement will be focused on Anoka, Hennepin, Olmsted, Rice, St. Louis, Crow Wing and Stearns counties.

Officials are urging motorists to be prepared, buckle up, use caution and plan for a sober designated driver. The DPS reports that 18 motorists have been killed over the past five fishing season opening weekends, and 6 of those fatalities were alcohol related. During the same time period, 2,331 arrests for driving while intoxicated in Minnesota were made.

FL Drunk Driver Leaves Scene of Accident But Leaves ID in Car

A Groveland Florida resident went to investigate a loud noise outside his house and he found a car had crashed into one of his trees. He also saw a man running from the scene. Police were able identify the man quickly however after finding a pay stub and a social security card in the wrecked vehicle.

Police soon caught up with Cody Dow Sullivan, who exhibited signs of inebriation, including bloodshot eyes, slurred speech and a strong odor of alcohol. Sullivan admitted to crashing into a tree while driving home from work. He also confessed to leaving the scene because he had been drinking. Sullivan failed a field sobriety test and his blood alcohol content was reportedly .166% and .168% during two different breath tests. The legal limit for drunk driving in Florida is .08%.

Sullivan, 20, was charged with driving under the influence in Florida and leaving the scene of an accident.

Girl Scout Mom Busted for Connecticut DUI/OUI

A 50-year old Girl Scout leader was arrested for driving under the influence in Connecticut. West Hartford police stopped Theresa Tracy after being alerted by other motorists to an erratic driver on a winding hilly road. In the truck with Tracy were four young girls, including her daughter, being driven to a scout jamboree.

Tracy was seen hitting a traffic barrel and driving poorly while traversing Avon Mountain, considered one of the most dangerous roads in the state. Her blood alcohol content was reportedly nearly four times the legal limit for intoxication. Tracy and four eighth grade girls were heading for a scouting event in Tolland, nearly forty miles away. In addition to being charged with DUI in CT, Tracy is facing four counts of risk of injury to a minor.

New Federal Lab Opens in Texas

A new, federally funded facility located in The Woodlands has opened to serve southeast Texas. Ten full time examiners will process blood evidence and test for drugs. The laboratory will serve Montgomery County and 10 counties north of Houston, and reduce the backlog of cases in the state. Currently the area is using an overwhelmed lab in Austin is being used for testing.

The lab is run by the Sam Houston State University. Drug tests and blood analysis can take up to a year to process in some Texas facilities. The new lab plans to handle 6000 cases a year, with results in as little as two weeks. This will help prosecutors involved with crimes such as sexual assault, drug possession and driving while intoxicated in Texas.

While the facility has opened, it must be accredited by the American Society of Crime Lab Directors and the Texas Department of Public Safety before accepting evidence in Texas criminal cases. That is expected to happen this fall.
