State Legislators Consider Breath Test Bill for Texas DWI

Under current Texas DWI law, a motorist is required to provide a breath or blood sample to test for blood alcohol content after causing an accident involving death or serious injury. State lawmakers are contemplating a measure that would make it mandatory to submit to a test in more arrest situations.

Senate Bill 261 calls for the expansion of the requirement to submit to a chemical test in driving incidents involving any injury that results in medical care; a DWI suspect with a child in the vehicle; a motorist with a prior felony DWI conviction; and a motorist with two or more DWI convictions.

During testimony before a Senate committee is was noted that more than half of TX DWI suspects refuse to submit to a breath or blood test. According to prosecutors, that makes a conviction for driving while intoxicated in Texas more difficult because law enforcement officers must request a warrant to for a blood test which can takes hours and therefore potentially lower the blood alcohol content reading.

Playboy Centerfold Nipped for Illinois DUI

Crystal McCahill DUIThe centerfold scheduled to appear in the May 2009 issue of Playboy magazine was charged with driving under the influence in Chicago last January 7. Crystal McCahill was stopped after allegedly running a red light in a 2005 Volkswagen Passat. According to the arrest report, she mumbled, had a strong odor of alcohol on her breath, had bloodshot and glassy eyes and registered a blood alcohol content twice the legal limit for intoxication in Illinois.

McCahill, 25, told the arresting officers that she had consumed three shots of alcohol at Climax, a Chicago nightclub where she works.

McCahill has appeared on the E! reality show about life at the California Playboy mansion, titled “The Girls Next Door.” She is scheduled to make her first court appearance March 19 to face the Illinois DUI charges.

New Mexico Schedules Spring DWI Campaign

Gov. Bill Richardson announced a spring crackdown on motorists who are driving while intoxicated in New Mexico. The Spring Superblitz will be conducted over the next 17 days. Law enforcement agencies will increase efforts to arrest suspected drunk drivers through sobriety checkpoints and saturation patrols. The campaign will run through the end of March.

A new state-wide anti-DWI ad campaign was also unveiled, titled ‘Women Drive Drunk, Too’. The campaign hopes to educate the public to the dangers of driving while intoxicated in New Mexico, and to the fact that the number of female NM DWI offenders is increasing. The State DWI czar says that almost a quarter of all drunk driving arrests in New Mexico involve female drivers. They also reportedly account for 20% of the alcohol related traffic fatalities. The ‘Women Drive Drunk, Too’ message will be spread through use of billboards, radio spots and television commercials.

David Hasselhoff's Ex-Wife Arrested for Felony California DUI

Pamela Bach DUIPamela Bach, ex-wife of David Hasselhoff, was arrested Wednesday night and charged with felony driving under the influence in Los Angeles. According to a Los Angeles Police Department spokesperson, Bach rear-ended another car causing a multi-vehicle accident around 9:00 pm. She was booked for drunk driving in the San Fernando Valley, with the felony charge added because the accident resulted in minor injuries to several people. Bach, 46, was released around midnight after posting $100,000 bond.

Bach and Hasselhoff have been involved in a bitter divorce and child custody battle.

Colorado DUI Arrests by Larimer County Sheriff's Department Top 1000

The Larimer County Sheriff’s Department has reported that during 2008 it made 1,034 arrests for suspicion of driving under the influence in Colorado. That is the third time in six years that the number of DUI arrests has topped 1000.

The total is almost double the number of arrests made by other law enforcement agencies for drunk driving in Larimer County. The Fort Collins Police Department registered 573 DUI arrests in 2008 and the Colorado State Patrol added 414 more.

Lawmakers Approve Monitoring Device for Some NM DWI Cases

Last year, lawmakers passed legislation making it mandatory for every one convicted of driving while intoxicated in New Mexico to install an ignition interlock device in their vehicle. Now legislators want to add another tool in the pursuit of prevention of drunk driving in NM. The House approved a measure that permits judges to require certain drivers convicted of drunk driving to wear an electronic monitoring device that detects alcohol.

The ignition interlock device is aimed at preventing drivers from operating a vehicle while under the influence of alcohol. The sponsor of the new law says the objective of the special ankle bracelet is sobriety. He said that many rural areas do not have alcohol rehabilitation facilities and the alcohol monitoring bracelet will help alcoholics and repeat drunk driving offenders remain sober.

The bracelets detect alcohol in the person’s perspiration and through the air. The device periodically relays information to a company that tracks the devices. The data is forwarded to an appropriate probation office or government agency. The penalties for alcohol consumption have not been clarified.

The alcohol monitoring devices can cost around $15 per day, and there are installation fees. For those unable to pay for the bracelet, a judge is able to tap into a state indigent fund, which is also available for ignition interlock devices.

The New Mexico State House unanimously approved the proposed legislation, and the measure has been sent to the Senate for debate.

DUI Arrests Lower on Big Island of Hawaii

During 2009, police on the Big Island have reported 233 arrests for suspicion of driving under the influence in Hawaii. That includes 27 arrests during the week of March 3-9.

Last year during the same period of time there were a total of 246 HI DUI arrests, making the latest figures a 5.3% decrease. The majority of the DUI arrests were made in South Hilo.

Serious auto accidents are down from 360 to 298, a 17.2 percent decrease. Traffic fatalities for the year total 5, down from 9 during the same window in 2008.
