Husband of 'Real Housewife' Charged with DUI in California

Matt Keough DUIOne of the husbands featured on the cable reality show ‘The Real Housewives of Orange Count’ was arrested last Saturday for allegedly driving under the influence in CA.

Matt Keough reportedly rolled through a stop sign in Coto de Caza and then refused to stop for police officers until he arrived at his home. The 54-year submitted to a breath test and registered a blood-alcohol content three times the legal limit. He was booked for California DUI by the Orange County Sheriff’s Department and later released after posting $10,000 bail.

Keough was convicted of felony DUI in California in 2005 after rear-ending another car, rolling into a pedestrian and then wandering away from the accident scene. The pedestrian was hospitalized with a knee injury. Then in January 2008 he was sentenced to 180 days in an Orange County jail for drinking in violation of the terms of his probation.

A former major league baseball pitcher, Keough was drafted by the Oakland A’s right out of high school. He also played for the New York Yankees and the Chicago Cubs. On the reality television show Keough is the husband of cast member Jeana Tomasin.

Sheriff Cleared of Tennessee DUI Ticket Fixing

An East Tennessee county sheriff has been cleared of fixing a ticket for drunk driving in Sevier County. Sheriff Ron ‘Hoss’ Seals was accused by a former deputy of helping a TN DUI suspect avoid prosecution by allowing the motorist to be taken from the scene by a third party.

The Tennessee Bureau of Investigation conducted a four month long investigation and was unable to corroborate the allegations. The deputy who made the accusation could not provide the name of the individual arrested for DUI, the name of the third party who took the individual from the scene, nor the date of the alleged DUI traffic stop. The TBI could not locate a record of the suspect

Arrests Up for Boating Under the Influence During Seattle Water Event

Seattle BUILaw enforcement officials issued 110 violations for boating under the influence in Washington during the recent Seafair weekend. That number reflects a 23 percent increase over the number of Seattle BUI arrests made during last year’s event.

Seattle area police departments conducted special patrols on Lake Washington and Lake Union over the weekend. In addition to looking for potentially drunk boat operators, the officers stopping boats for having too many passengers and for violating ‘no wake’ zones. Most offenders were cited and released. One boater however was jailed after being charged with two WA BUI offenses, one on Friday and another on Sunday.

In addition, 50 motorists were arrested for driving under the influence in King County during the weekend.

Seattle Officer Who Shot DUI Attorney Charged with Washington DUI

Zsolt Dornay with the Seattle Police Department was arrested last month for suspicion of driving under the influence in Washington. He and his younger brother were stopped by Washington State Patrol in Ocean Shores for going 49 miles per hour in a 25 mph zone on his motorcycle. The two men admitted they had been drinking. When the older Dornay submitted to a breath test he registered 0.149% and then 0.172% blood alcohol content, and he was booked for WA DUI.

Dornay has been placed on administrative leave while the Seattle Police Department conducts an internal investigation.

In 2006, Zsolt Dornay shot an unarmed Seattle DUI defense attorney. Dornay was involved with an altercation with a woman who took umbrage to the off-duty officer riding his motorcycle through a crowd of people outside a pub. That escalated into a brawl with several men upon which Dornay fired several shots from his .40 caliber Glock, hitting the uninvolved lawyer. When sued for assault, Dornay countersued the victim claiming it was simply to protect his legal position and that he had little interest in pursuing legal action. King County prosecutors eventually decided Dornay was justified in firing his weapon and no additional action was taken against the officer.

Man Charged with DUI in Colorado After Falling Out of Truck

The Eagle Police Department was contacted by members of the city fire department, warning them of a potential drunk driver. When police arrived on the scene around 9:30 pm they observed the truck pull away from a nearby business, weave through traffic lanes and hit a curb. The truck then slowly crossed the road, jumped another curb, traversed a sidewalk and rolled onto a grassy area before coming to a stop.

When police approached the vehicle the driver was eating a hamburger. Officers detected a strong odor of alcohol and when they asked the man to exit his vehicle he fell out of the truck cab and had to be caught. Asked if he had been drinking, the man replied he had a couple of vodkas. The driver could not produce a driver

Sheriff's deputy cut corners during investigations of drunk driving in Florida

Prosecutors in Polk County have dropped charges against 54 defendants accused of driving under the influence in Florida. The reasons stem from a sheriff’s deputy taking shortcuts in preparing DUI arrest reports and conducting tests to determine blood alcohol content.

Deputy Tex Thomas joined the Polk County Sheriff’s Office last year and made 124 arrests for suspicion of DUI in FL. In a court deposition for a drunk driving case, Thomas admitted to clearing just the top portion of an arrest report and reusing words from a previous arrest. The use of such a template, rather than writing specific details and observations unique to an arrest, is a violation of procedure. In one case, he inadvertently left in the name of the previous suspect’s last name. Thomas also admitted to not properly observing a 20 minute period of direct observation before conducting a breath test to ensure that the suspect did not belch, vomit or ingest something that could affect the accuracy of the test. He would include the drive time from the point of the traffic stop to the testing facility as part of the intended face-to-face window of observation.

Prosecutors felt the shortcuts jeopardized the DUI cases and they elected not to file official charges against 50 defendants and dropped four other charges. Those arrests were made between October 2008 and early July 2009.

Thomas, 27, has not been disciplined though there is an ongoing internal investigation. While he has been reassigned from targeted DUI enforcement to general patrol, he is still able to initiate traffic stops for suspected Florida DUI.

Man Uses Obesity Defense in New Hampshire DWI Case

Jaimil Choudry was arrested on April 18 for suspicion of driving while intoxicated in New Hampshire. Choudry had refused to submit to a breath test and his arrest was based on his performance on standardized field sobriety tests. Choudry, who is 5’10” and weighs 230 pounds, says that his obesity should have been taken into account and the officers should not have asked him to perform certain sobriety tests. He and his DWI lawyer feel the police should not be able to testify that he ‘failed’ the tests.

A police lieutenant/prosecutor confirmed that police are trained to consider weight when a suspect is asked to perform certain sobriety tests, such as walking toe-to-toe.

The definition of obesity appears to be at the crux of the argument, with police claiming that a 5’10”, 230 pound person can be physically fit. Choudry’s NH DWI defense attorney submitted documents from Met Life Insurance and the Centers for Disease Control showing that his client’s height-weight ratio falls within standards defined as obese.

The DWI defense has indicated that the weight issue is not a request for automatic dismissal, rather they want the testimony of the police to be restricted from saying that the results of the tests were consistent with their training to identify intoxication.

Choudry’s case is scheduled to go to trial September 8.
