The American Beverage Association paid for an ad campaign that challenges one of the penalties for drinking and driving. Whereas drunk driving is a serious crime, arrest statistics show that a growing number of law enforcement agencies are taking a zero tolerance approach to alcohol and are arresting motorists who are not intoxicated. In several states, an arrest for DUI could result in the mandatory installation of an ignition interlock device.
Using a mugshot of Lindsay Lohan taken last year during one of her arrests for driving under the influence in California, the print ad states that ignition ionterlock devices are appropriate for repeat offenders, like Lohan, but questions their appropriateness for a low blood-alcohol content, first offender. The ad, which appeared in US Today, attempts to make a visual distinction between the traditional image of a chronic drunk driver, who statistically has a BAC more than twice the legal limit, and the person arrested after having a glass of wine with dinner.
The American Beverage Association represents the liquor and restaurant industries, and it promotes responsible social drinking.

Vito Fossella, a member of the US House of Representatives, was arrested for driving under the influence in Virginia. The Republican lawmaker was stopped in Alexandria, Virginia for running a red light, and, after detecting a strong smell of alcohol, police asked him to submit to field sobriety tests and a breath test. Fossella reportedly failed the field tests and registered a preliminary blood alcohol content of .133%. When a second breath test was taken during booking for Virginia DUI, the result was .17%. The legal limit for driving while intoxicated in Virginia is .08%.

State Senator Rosalind Kurita sponsored an amendment to a bill that would ban Tennessee DUI defense attorneys from making certain advertising claims. This included not stating that the attorney specialized in DUI cases, offered discounts, guaranteed a result or indicated that they had more experience than another attorney. Kurita said her legislation was aimed at reducing the number of suspected drunk drivers who are not convicted.
The amendment came under immediate fire from other state legislators on constitutional questions, and an opinion from the attorney general of Tennessee was requested. AG Bob Cooper has stated that Kurita


The sentencing phase of Chad Kroeger’s case of driving under the influence has resulted in the Nickelback singer losing his driver’s license for one year and being fined $590.
Kroeger was stopped for speeding in his Lamborghini in June 2006 in a suburb of Vancouver, British Columbia. After detecting alcohol, the officers adminstered a breath test. Kroger’s blood alcohol level registered .14% and he was charged with drunk driving.
Kroeger’s DUI defense attorney had unsuccessfully tried to get the test results thrown out. The singer was not in court last month and a judge declared him guilty of driving while intoxicated.
Kroeger, whose birth name is Chad Robert Turton, plans to appeal the sentence.

The recently released video game Grand Theft Auto IV is coming under fire from anti-DWI organizations for a controversial drunk driving scene. One game mission has a character getting drunk in a bar and then having the option of getting in a cab or driving drunk. A spokesperson for StopDWI in Midland Texas said

Mike Krusee, Republican chairman of the Texas House Transportation Committee, was arrested for Driving Under the Influence in Texas late Wednesday.
Krusee was stopped by a Texas DPS trooper for driving erratically in
northwest Austin. His vehicle registration was also expired. The
officer noticed a strong smell of alcohol and had Krusee performed a
field sobriety test, which he reportedly failed.
Krusee was booked at the Williamson County jail on the charge of drunk
driving in Texas. He refused to submit to a breath test, and under
Texas DWI law his driver’s license was suspended for 180 days. With a
first offense misdemeanor DWI, the state lawmaker could be facing
probation to 180 days in jail plus fines.
Krusee has represented the Round Rock area of the metropolitan Austin
area since 1993. He is a close political ally of Governor Rick Perry.
Krusee sponsored legislation that led to the state’s toll-road system,
and the law’s language includes a driver responsibility program that
calls for a $1000 surcharge for first time offenders convicted of
Driving While Intoxicated in Texas.
