Governor Signs Legislation Boosting Arkansas DWI Penalties

Governor Matt Blount signed legislation into law today that will strengthen the penalties for driving while intoxicated in Arkansas. The legislation covers a number of transportation oriented issues, and it includes increased fines for those who plead guilty to drunk driving in Arkansas and then receive a suspended sentence.

In addition, repeat DWI offenders must install an ignition interlock device in their vehicle. Such a device requires the driver to breathe into a tube and if alcohol over a set blood-alcohol limit is detected, the car cannot be started.

Senate Bill 930 was signed at the Greene County Courthouse in Springfield, Arkansas Thursday morning.

Police to Patrol for Repeat NY DWI Offenders in Nassau County

The Nassau County Police Commissioner has announced a crack down on New York DWI over the Fourth of July weekend. Officers will employ a new tool, a license plate scanner, to target repeat drunk driving offenders.

The scanners will be mounted to patrol cars with access to a database containing license plate information on 361 known chronic drunk drivers. About 13 vehicles will be equipped with the equipment in an effort to deter driving while intoxicated in Nassau County New York.

In addition, another dozen Highway Patrol Bureau vehicles will be used in saturation patrols of areas prone to increased drunk driving activity. Last year over the five day extended holiday weekend, 74 motorists were arrested on suspicion of drunk driving in Nassau County. It is expected that more arrests will be made this year, with motivation partly coming from a Nassau police officer being injured by a drunken driver last May.

Andy Dick Arrested for Sexual Assault of Female

Andy Dick, the 42-year old openly bisexual comedian, was arrested after leaving a bar southeast of Los Angeles. Some of the charges he could be facing include sexual assault of a minor, lewd public exposure, drug possession and public intoxication.

Dick allegedly pulled down the tank top of a 17-year old at Buffalo Wild Wings in Murrietta, California. Police then responded to a man urinating outside the bar, stopping a truck that was fleeing the scene. Dick was in the front seat of the vehicle. Police placed him in a line up with other men at the scene and the female victim and another woman positively identified Dick.

Dick reportedly had Xanax and marijuana in his pockets at the time of the arrest and witnesses say he was extremely intoxicated. He was charged with California DUI in 1999 following a hit-and-run accident. Dick has repeatedly entered rehab, the latest effort following a 2006 Comedy Central roast where he licked the faces of Farrah Fawcett and Carrie Fisher and allegedly groped a reporter.

Ohio DUI Bill May Violate Constitution

Governor Ted Strickland is expected to sign legislation that will give police greater powers to force a blood or urine sample from certain motorists. The bill would allow police to demand samples from drivers who have been convicted of driving under the influence in Ohio two or more times.

Under current Ohio DUI laws a warrant must be obtained from a judge if the motorist declines to submit a blood sample. The new bill would make the blood draw a requirement even without a warrant. Opponents of the plan point out that a repeat DUI offender could be stopped for any traffic infraction, not just suspicion of drunk driving, before being asked to submit a blood sample. Those states that have provisions for warrantless blood draws usually limit the action to situations where a driver involved in an accident involving an injury or fatality is suspected of impaired driving.

The Ohio chapter of the American Civil Liberties Union is expected to challenge the new law on the basis of constitutionality.

If you have been arrested for DUI/OVI in Ohio, you will need to hire an Ohio DUI attorney for representation on your drunk driving charge.
