Washington DUI News: Judge Throws Out Breath Tests in Washington DUI Cases

Three King County Washington District Court judges have ruled that breath tests should not be used as evidence in drunk driving cases because of problems at the Washington State Patrol’s toxicology lab. The finding directly affects eight plaintiffs; though more than one hundred cases have been on hold waiting for the outcome of the case. It is also probable that thousands of previously resolved cases will be re-opened at the request of Washington DUI defense lawyers.
