DWI Penalties in Missouri

Missouri has an implied consent law, which means that anyone who operates a vehicle is required to submit to chemical testing (blood, urine, breath test) if an officer has reason to believe they are driving while under the influence of drugs or alcohol. Refusing to submit to this test can incur harsher penalties and a year-long license suspension. If you fail the test (have a BAC of .08% or greater), your license may be suspended for 30 days, followed by 60 days of restricted driving privileges. Prior DWIs on your record will increase the time of your license suspension. You have only 15 days from the date you receive a Notice of Suspension to request an administrative hearing. If you do not request this hearing, whose sole purpose is to allow you to contest your license suspension, then you may not be able to save your driving privileges.
