Lawyer Charged with DUI Might Bring Mistrial

abc NEWS reported that a civil case “between two of the biggest radio names in the Tampa Bay, Florida area took an odd turn last week when an attorney representing one of the DJs ended up behind bars for alleged DUI, in what his legal team calls a setup.”

Charles Campbell, who is legally representing and defending Todd “MJ” Schnitt’s case against Bubba “The Love Sponge” Clem, was arrested on Wednesday at Malio’s Prime Steakhouse in Tampa for suspicion of DUI. Campbell had been at the restaurant’s bar with a paralegal, Melissa Personius. It was determined that Personius works for the law firm of Clem’s attorney. Strong accusations from Schnitt’s defense team have been made against Clem’s attorneys, stating that “Personius tricked Campbell into getting arrested.”

John Ellis, one of Schnitt’s legal representatives, stated “Personius lied to Mr. Campbell, or me, when we asked her where she worked…she bought him drinks. She specifically, we believe, asked him to move her car.” Furthermore, Schnitt’s defense team stated that Clem’s team of lawyers could have gotten a legal advantage because Campbell left his briefcase with important documents in the paralegal’s car. 

In addition, police officials testified that someone from Clem’s legal team called them to report and arrest Campbell for his DUI. Schnitt’s legal representatives have pleaded for a mistrial on suspicion that the publicity on Campbell’s arrest might influence the jury’s decision.  On Friday, the judge decided that more evidence and research was needed before making a final decision on the mistrial plead. It was stated that Clem was disappointed about the occurrence, stating “It’s like a ‘South Park’ episode…quite frankly, I’m getting a little tired of it.”
