Penalties for DUI in Marion County, IN
DUI laws in Indiana are some of the strictest in the nation. With even a first offense for driving under the influence in Indianapolis, you could be facing a jail term, significant fines, court fees and supervised probation, your driver’s license could be suspended and your auto insurance policy will either be cancelled or your premiums will rise substantially.
Depending on the details of an arrest, such as whether you are considered a habitual offender or caused an accident with injury, you could also be facing mandatory installation of an ignition interlock device, community service, substance abuse counseling, periodic testing for presence of alcohol and attendance at a Victim Impact Panel. The penalties are partly based on your blood alcohol content at the time of arrest, with a BAC in excess of .15% or higher incurring the most severe consequences. In addition, those with a prior Indiana DUI conviction within the previous five years face enhanced penalties.
Loss of Your Indiana Driver’s License After a DUI Arrest
The State has two opportunities to suspend your driver’s license after an arrest for DUI in Indianapolis. The first is an Administrative Suspension. If you submit to a chemical test to check your blood alcohol content, and register a BAC in excess of the legal threshold of .08%, you could lose your license for up to 180 days. You have the right to refuse to submit to a breath, blood or urine test, but if you do, the officer will seize your license and you could lose all driving privileges for up to one year. You can challenge the Administrative Suspension process by requesting a hearing with the Bureau of Motor Vehicles. You must file the appropriate paperwork within 10 days of the date of an arrest for impaired or drunk driving in Indianapolis. If you fail to request a hearing in time, you will not be granted a hearing and the suspension period will begin automatically.
The second opportunity for the State to take your license is if you are found guilty of IN DUI in court. Sentencing can include a further suspension period of between 90 days and two years. Some first time offenders may qualify for a hardship license after 30 days. Those with any prior DUI convictions on their driving record are subject to the longer suspension period. Once the license suspension period has ended, you will have to pay a license reinstatement fee. In addition, you will be required to hold expensive, high risk SR-22 insurance for three years. Failure to do so will result in the immediate re-suspension of your license.
