About Your Driver’s License

After an arrest for suspicion of drunk driving in Georgia, your license will be in jeopardy. This is true whether you submitted to a breath, blood or urine test of blood alcohol content or refused. A law enforcement officer needs only to reasonably suspect impairment to initiate an arrest for DUI in Georgia.

You can petition the Department of Driver Services for an administrative review hearing to contest the license suspension. You must however, submit the correct paper work and the required fee within 10 days of the date of your arrest. Failure to act in time will lead to the automatic suspension of all driving privileges, and any right to appeal.

While separate from the criminal DUI proceedings held in a courtroom, the hearing is still complicated. Houston County DUI attorney Ann Parman has experience with the DDS hearing and can both petition the agency on your behalf and represent you at the hearing. Having her assistance will improve the opportunity to retain your driving privileges.

Types of DUI Offenses

There are several DUI related offenses that can be charged against a motorist. A ‘DUI’ applies to those in control of a vehicle who are deemed to be impaired by alcohol or drugs to the point of driving in a less than safe manner. No physical evidence is required for this type of charge. A ‘DUI Drugs’ applies to those under the influence of drugs, such as marijuana, metabolites or controlled substances. A ‘Per Se DUI’ is when you register a BAC at or above 0.08% within three hours of operating a vehicle. ‘DUI Child Endangerment’ pertains to a DUI violation where a minor under the age of 14 years of age is in the vehicle at the time of arrest. ‘Commercial License DUI’ is the same as a ‘Per Se DUI’ though the threshold for impairment is a BAC of 0.04% or higher.

Penalties for DUI in Georgia

The type of Georgia DUI you are charged with and your BAC at time of arrest will influence the severity of the criminal penalties. Typically a first offense will result in fines of between $300 and $1000; a jail sentence of between 10 days and 1 year; loss of driver’s license for 6 months to a year; and 20 to 40 hours of community service.

Other penalties can include mandatory enrollment in an abuse risk reduction program, a clinical evaluation and monitored probation.

On a second or subsequent arrest for driving under the influence in Houston County within a 10 year period the penalties increase, including the amount of the fines, the length of the jail sentence and length of license suspension. In addition to this, new restrictions will be imposed, like the requirement of installing an ignition interlock device, the announcement of the arrest in your local newspaper and your license plates can be seized.

Not all law firms have the experience required to successfully challenge a charge of Georgia criminal DUI. Worse still, some attorneys will take a quick fee and then just accept the prosecutor’s plea agreement. Do not risk your future or your freedom.

"Ann Parman is one of the best attorney's I have ever had or worked with. Ann was very knowledgeable; she had a really good rapport with police officer's, Judges, and court personal. She returned phone calls and texts in a timely manner. Ann also treats you with respect and really cares about what happens to you. Ann got my charge reduced to reckless driving and only two months probation. Ann assured me the whole time everything would be okay and she made it work out that way."

"Ann Parman told me from the beginning what the likely outcome of my DUI and Open Container charge would be, and it was spot on. My charge was in Dublin, GA and she had it reduced to Reckless Driving with an Open Container. Speaking with the judge reduced my probation from 1yr to 6 months. She returned my text and phone calls in due time. Whenever there were updates on my case she immediately called me. She is a straight shooter and does what she says she's going to do. I recommend Mrs. Ann Parman. She is a solid, trustworthy lawyer."

"I recently used Ann Parman. She got my DUI completely dismissed!!"

"In my case I was charged with endangerment of child, dui, open container, failure to maintain lane and was scared to death. I thought my life was over. I had never been in any trouble before and did not know what to expect. Mrs. Ann returned my first phone call within minutes and immediately got on my case. After hard work of staying on my case and being so knowledgable in the dui laws my case was dismissed on all charges and reduced to reckless driving. I am so glad I made the phone call to Mrs. Ann Parman."
