Driver Charged with DWAI After Running Over Girl Riding her Scooter

A 9-year-old girl was struck by a car as she was riding her scooter alongside her mother in Brownsville, a neighborhood in Brooklyn. The driver has been charged with DWAI and reckless driving. A group of eight by-standers were able to lift the vehicle off the girl and free her to safety.

DWAI (Driving While Ability Impaired) is a traffic violation and not a criminal charge. A first conviction DWAI can be penalized with up to $500 in fines, 15 days in jail, and a 90-day license suspension. A DWAI can be charged when a motorist’s blood alcohol level is greater than .05% but less than .08%.
