Key Evidence Tossed in Case Of Judge Accused of Texas DWI

Key evidence in the Texas drunk driving case of Tarrant County Judge Elizabeth Berry was barred from evidence by a judge. The action comes after a review of the search warrant affidavit that sought to take a blood sample from the defendant to test for alcohol content. As a consequence, the results of the blood test are inadmissible in the Texas DWI case.

Barry, 43, was stopped for speeding in Alvaredo, Texas, south of Fort Worth on November 8, 2008 for speeding. The officer reportedly found an open container of alcohol and, after Barry refused to submit to a breath test, sought a search warrant to demand a blood sample. District Attorney Charged with Louisiana DWI

The District Attorney for Winn Parish was arrested for driving while intoxicated in Louisiana last Wednesday. Richard Christopher Nevils was involved in a hit and run accident around 9:50 pm. When stopped, Nevils reportedly failed a field sobriety test. A breath test revealed a blood alcohol content of .173%, over twice the legal limit for intoxication in Louisiana.

Nevils in the DA for the 8th Judicial District of Louisiana in Winn Parish. He was booked on charges of Louisiana DWI, leaving the scene of an accident and failure to maintain control of his vehicle.

Legislator Files Bill for Tougher Oklahoma DUI Laws

State senator Harry Coates has filed legislation calling for stronger penalties for driving under the influence in Oklahoma. SB 1014 would require those convicted of felony DUI to forfeit all vehicles in which they have ownership. The state would then sell the vehicles, applying any proceeds to a drug abuse education and treatment fund. The defendant would be responsible for all costs associated with the seizure, such as wrecker and storage fees.

City Alderman Charged with Illinois DUI in Chicago

Sharon Dixon DUIThe Chicago Police Department used marked patrol cars with their emergency lights activated to block traffic at the scene of a fatal fire around 1:30 am Wednesday. Chicago 24th District Alderman Sharon Denise Dixon drove up to the closed street and told the officers to move their vehicles so she could drive through. When the officers responded by telling Dixon to move her car to make way for fire equipment, she got out and yelled at them. The officers in turn charged Dixon with obstruction of traffic and operating a vehicle without proof of insurance.

She then reportedly moved her car, walked up to the patrol car and pulled on the door handle, demanding the officer’s badge number. This time the officers detected alcohol on her breath and a sargeant was summonsed. Dixon, 46, admitted to having had several glasses of wine at a party. She was booked on charges of driving under the influence in Illinois at the Belmont District station in the North Side district.

Dixon, a first term alderman, declined to comment on her Illinois DUI arrest when she was released around 9:40 am, simply stating that she will “have her day in court.”

Shia LaBeouf Loses License in Relation to California DUI

Actor had charges of drunk driving in Los Angeles dropped, but he still loses license for a year.

Shia LaBeouf has had his driver’s license suspended stemming from an accident and a case of suspected drunk driving in Los Angeles, California. LaBeouf was involved in a two vehicle accident in West Hollywood last July. While he was initially arrested for suspicion of driving under the influence, the LA County Sheriff’s Department later said there was insufficient evidence to press charges.

At the time of the accident, the ‘Transformers’ star refused to submit to a breath test to check for blood alcohol content. Even though he was cleared of CA DUI charges, that refusal was used by the Department of Motor Vehicles to automatically suspend LeBeouf’s license. California DUI law states that a person’s license shall be suspended for up to one year when he/she refuses to submit to a chemical test (blood, breath or urine) when drunk driving is suspected.

It was later determined that the other motorist ran a red light and struck LeBeouf’s Ford pick-up truck while he was making a left turn. LeBeouf, 22, had his hand crushed in the accident and has had two surgeries since the July 27 accident.

Arrests Up for Hawaii DUI in Honolulu

The Honolulu Police Department has released figures showing an increase in the number of arrests for driving under the influence in Hawaii. Nearly 400 more motorists were charged with suspicion of DUI in Honolulu in 2008 than the previous year. That continues an eight year trend reflective of increased law enforcement efforts.

The total number of arrests for suspicion of drunk driving in Honolulu during 2008 was 4,316. All but 62 of those cases were formally charged and prosecuted. In related news, there were 46 vehicular fatalities on the island of Oahu, 14 of which involved alcohol, a significant drop in both categories.
