VICTORIES

Client Acquitted: Client involved in a single car accident, followed by an altercation with the police and hospital staff. Blood test reportedly was three times the legal limit. During thorough investigation, the defense found several weaknesses and errors in the case.

Court Dismissed All Charges: Client was a passenger when her brother was arrested for DUI. Client was under 21 and had been drinking. The police took her home but several hours later she drove to the police department to pick her brother up after he was processed for DUI. Client was stopped by the same officer who had arrested her brother, and her breath test result was well over the legal limit for a 21-year old driver. Defense filed a motion to suppress hearing and the court dismissed all charges. Mr. Suhre also prevailed during an appeal by the State.

Dismissal of Felony DUI Charge: Following a hit and run accident, client was arrested for driving under suspension, leaving the scene of an accident and felony DUI. During an investigation of the case it was determined that evidence had not been properly preserved. Mr. Suhre filed a motion to dismiss the felony DUI charge and the court granted the motion. The State appealed the decision to a higher court but, after reading transcripts of the hearings, the state's appellate attorney voluntarily ended the appeal and agreed to dismissal.
