What happens after a DUI/OVI in Central Ohio?

Ohio DUI laws stipulate that first time offenders lose their driver’s license for up to one year, pay fines of up to $1,000 and spend a minimum of three days in jail. If convicted for DUI/OVI in Ohio, you will have a criminal record, which could restrict your ability to travel to Canada, impact a credit rating and limit your employment options. Columbus OVI attorneys Suhre & Associates will provide an aggressive legal defense in an effort to keep your record clean and protect your future.

What happens to your driver’s license in Ohio after a DUI/OVI?

The police probably seized your driver’s license when you were arrested for suspicion of OVI/DUI in Columbus or Franklin County. The State of Ohio automatically suspends a motorist’s driving privileges for a minimum of 90 days and possibly as long as five years, depending on the circumstances of an arrest and the presence of any prior alcohol related traffic offenses. Renewing your driving privileges requires the payment of an additional fine and, in some instances, taking another driver’s license exam.

You can request an Administrative License Suspension hearing and try to retain your license, but the appeal must be made within 5 days of the date of your arrest. This is not a simple process and the hearing will involve legal issues and the presentation of physical evidence gathered during your arrest. You will have a better chance of keeping your driving privileges by having the Franklin County DUI Lawyers at Suhre & Associates represent you. The window of time for pursuing legal options and fighting for your license is very limited, so contact Suhre & Associates now.

VICTORIES

Client Acquitted: Client involved in a single car accident, followed by an altercation with the police and hospital staff. Blood test reportedly was three times the legal limit. During thorough investigation, the defense found several weaknesses and errors in the case.

Court Dismissed All Charges: Client was a passenger when her brother was arrested for DUI. Client was under 21 and had been drinking. The police took her home but several hours later she drove to the police department to pick her brother up after he was processed for DUI. Client was stopped by the same officer who had arrested her brother, and her breath test result was well over the legal limit for a 21-year old driver. Defense filed a motion to suppress hearing and the court dismissed all charges. Mr. Suhre also prevailed during an appeal by the State.

Dismissal of Felony DUI Charge: Following a hit and run accident, client was arrested for driving under suspension, leaving the scene of an accident and felony DUI. During an investigation of the case it was determined that evidence had not been properly preserved. Mr. Suhre filed a motion to dismiss the felony DUI charge and the court granted the motion. The State appealed the decision to a higher court but, after reading transcripts of the hearings, the state's appellate attorney voluntarily ended the appeal and agreed to dismissal.

There are specific factual and legal circumstances unique to each client's case. The circumstances in your case may be different from the ones above. No representation is being made that the same or similar results can be obtained in your case.
