About Ohio OVI/DUI

Ohio OVI/DUI laws stipulate that first time drunk driving offenders lose their driver’s license for up to one year, pay fines of up to $1000 and spend a minimum of three days in jail. If convicted for DUI, you will have a criminal record, which could impact your ability to travel and find or keep a job. Hamilton, Ohio DUI Attorney Joseph Suhre will provide an aggressive legal defense in an effort to keep your record clean and protect your future.

About your driver’s license

The police probably seized your driver’s license when you were arrested for suspicion of driving drunk. State of Ohio automatically suspends your driving privileges for a minimum of 90 days and possibly as long as five years, depending on the circumstances of your arrest and prior DUI offenses. Renewing your driving privileges requires the payment of an additional fine and, in some instances, taking another driver’s license exam.

You can request an Administrative License Suspension hearing, but the appeal must be made within 5 days of the date of your arrest. This is not a simple process and the hearing will involve legal issues and the presentation of physical evidence gathered during your arrest. You will have a better chance of keeping your driving privileges by having Butler County, Ohio DUI Lawyer Joseph Suhre represent you. The amount of time for pursuing your legal options and fighting for your license is very limited, so contact Joseph Suhre now.

Previous Client Cases

  • Client involved in a single car accident, followed by an altercation with the police and hospital staff. Blood test reportedly was three times the legal limit. During thorough investigation, the defense found several weaknesses and errors in the case. Client was acquitted.
  • Client was a passenger when her brother was arrested for DUI. Client was under 21 and had been drinking. The police took her home but several hours later she drove to the police department to pick her brother up after he was processed for DUI. Client was stopped by the same officer who had arrested her brother, and her breath test result was well over the legal limit for a 21-year old driver. Defense filed a motion to suppress hearing and the court dismissed all charges. Mr. Suhre also prevailed during an appeal by the State of Ohio.
  • Following a hit and run accident, client was arrested for driving under suspension, leaving the scene of an accident and felony DUI. During an investigation of the case it was determined that evidence had not been properly preserved. Mr. Suhre filed a motion to dismiss the felony DUI charge and the court granted the motion. The State of Ohio appealed the decision to a higher court but, after reading transcripts of the hearings, the state’s appellate attorney voluntarily ended the appeal and agreed to dismissal.
