There are two ways to be charged with driving under the influence in Nebraska. The first is a violation of ‘per se' law, which is when you have a BAC at or above .08%. This is usually determined through a breath, blood or urine test. The second is based on a perception of physical or mental impairment due to ingestion of alcohol, drugs, or both. An officer can use your performance during field sobriety tests, driving violations, such as weaving or an accident, and your physical appearance, including glassy eyes and slurred speech, to suspect impairment and make a DUI arrest.
