About Missouri DUI Penalties
A criminal conviction for driving under the influence (DUI) can be penalized with jail time, up to 12 points on your license, fines, suspension, community service, SATOP classes, and you may be required to obtain SR-22 insurance.
Your license is at stake after an arrest for DUI in Missouri. By obtaining a driver’s license, you have given implied consent to have your blood alcohol level tested by a police officer who has reasonable suspicion that you are driving while intoxicated. If you refuse to submit to this chemical test, your license may be revoked for up to one year. If you submit to a chemical test and fail with a blood alcohol level over 0.08%, or greater than 0.02% if you are under the age of 21, then your license will be suspended and you will have only 15 days until the suspension goes into effect. You will have an administrative hearing to challenge your license suspension, but the hearing will only take place if you request for the hearing within 15 days from the time you receive your temporary driving permit. Failing to request this hearing within the 15 day period will result in you losing your privilege to challenge your license suspension.
