What Happens After an Arrest for DWI in Missouri?

If you were arrested for DWI in Missouri, you need to know that there are two separate laws which are relevant to your case. The first is the Criminal Alcohol Law, which deals with the ticket you were issued for a driving offense related to alcohol. Under this statute, the court sends a copy of your conviction to the Department of Revenue which will assess a number of points to be added to your driving record. If you have accumulated too many points, your license may be suspended or revoked. The Administrative Alcohol Law initiates a suspension or revocation of your driver’s license if your BAC is above the legal limit. Unless you appeal this automatic suspension within 15 days of your arrest and win your Administrative Hearing, your license will be automatically suspended. This will happen even if you win your criminal case.

A first conviction for DWI can result in a 90-day suspension of your driver’s license, and after 30 days you may qualify for a restricted driver’s license. If you are a driver of a commercial motor vehicle, you can be charged with DWI if your BAC is .04%. If you refused to take a drug or alcohol test after you were arrested, your license may be revoked for one year. A DWI conviction can result in being required to install an ignition interlock device (IID) on your vehicle, which will test your blood alcohol level to start the ignition of your car. Maintenance is required on IID’s and you must report to a certified vendor each month for the court to receive readings of your IID.

The criminal penalties for a first DWI conviction can include up to 6 months in jail, up to $500 in fines, and court costs. A second DWI conviction can be punishable by one year in jail, up to $1,000 in fines, license revocation up to 5 years, and you can be listed as a Prior Offender. For 3 or more DWI convictions you may face up to 4 years in prison, you can be fined up to $5,000, and your license may be suspended for up to 10 years.
