About Your License

If you refused to have your blood alcohol content tested or you registered a BAC of .08% or higher during an arrest for drunk driving in Pettis County, the state will move to suspend your driver's license. The length of the suspension depends on a number of factors, especially any prior alcohol related traffic offenses, an excessive BAC at the time of the arrest and whether there was an accident with injury.

You can fight the suspension by requesting an administrative hearing, though you must petition the right agency within a very short and strict time frame. In most cases you have only 15 days from the date of your arrest to file a request, and if you do not, your license will be automatically suspended with no possibility for an appeal.

Getting you license back at the end of the suspension period is not easy either. You must complete a Substance Abuse Traffic Offender Program, pay a fine, retake the license exam and driving test and maintain proof of financial responsibility for two years by filing an expensive SR-22 insurance policy.

Pettis County DUI Attorney Matt Lowe can help you with your license and try to keep your driving record clear. He will petition the appropriate government agency and represent you at a license hearing. Having legal counsel can increase the chances of keeping your license, so contact Dull & Lowe now.

MO DUI Penalties

Being found guilty of first offense driving under the influence in Missouri can result in jail, fines, court fees and loss of license. The penalties increase if you have been arrested before for DUI. A second offense would calls for your license to be suspended for one year, and three or more offenses would result in loss of license for ten years with reinstatement only after a court order.

Missouri has a points system where a driver's record is penalized for various traffic violations. A conviction for drinking and driving under the influence can add 8 to 12 points depending on a number of factors, and result in the suspension or revocation of your license.

A conviction for Missouri DUI would also mean having a criminal arrest record, which could make it difficult to open a line of credit or find or keep a job.

To protect your future and try to keep both your arrest and driver's records clean, contact Pettis County, Missouri DUI Lawyer Matt Lowe.
