Michigan DUI Penalties

Michigan has established certain penalties for the drunk driving violations known as Operating While Impaired (OWI) and Operating While Visibly Impaired (OWVI). These offenses can also be referred to as DUI (Driving Under the Influence). To be charged with a DUI, the driver must have a blood or breath alcohol content of .08% or higher. You can be charged with an OWVI if your alcohol content level is less than .08% and you are exhibiting visible signs of impairment while operating your vehicle.
