The offense for impaired or drunk driving in Indiana is called Operating a Vehicle While Intoxicated or OWI. Much of the United States uses a similar term of Driving Under the Influence or DUI. An OWI/DUI is charged when a motorist's ability to operate a vehicle has been influenced by drugs or alcohol to a point of being unsafe.

Indiana OWI/DUI laws establish a legal threshold of .08% BAC for intoxication. For those with a commercial driver's license the legal limit is .04%, and for drivers under 21 years of age the limit is .02%. This is called a 'per se' violation. In addition, a law enforcement officer can initiate an arrest for driving under the influence in Indiana without a test for blood alcohol content. All that is required is a suspicion of impairment from alcohol, illegal drugs or prescription drugs, or a combination of those substances.

Those arrested for DUI in Indiana risk severe financial, legal and social penalties. While impaired driving is never condoned, an arrest does not indicate guilt. Loss of Driver's License

The State has two opportunities to suspend your driver's license after an arrest for DUI in Indianapolis. The first is an Administrative Suspension. If you submit to a chemical test to check your blood alcohol content, and register a BAC in excess of the legal threshold of .08%, you could lose your license for up to 180 days. You have the right to refuse to submit to a breath, blood or urine test, but if you do, the officer will seize your license and you could lose all driving privileges for up to one year.

You can challenge the Administrative Suspension process by requesting a hearing with the Bureau of Motor Vehicles. You must file the appropriate paperwork within 10 days of the date of an arrest for impaired or drunk driving in Indianapolis. If you fail to request a hearing in time, you will not be granted a hearing and the suspension period will begin automatically.

The BMV hearing involves a review of evidence from your arrest, testimony from the arresting officer and a determination that several key conditions were met during your arrest. Having experienced legal representation will improve the outcome of this hearing.

The second opportunity for the State to take your license is if you are found guilty of IN DUI in court. Sentencing can include a further suspension period of between 90 days and two years. Some first time offenders may qualify for a hardship license after 30 days. Those with any prior DUI convictions on their driving record are subject to the longer suspension period.

Once the license suspension period has ended, you will have to pay a license reinstatement fee. In addition, you will be required to hold expensive, high risk SR-22 insurance for three years. Failure to do so will result in the immediate re-suspension of your license.

If you are caught driving while your license has been suspended for DUI in IN, you will be sentenced to jail for up to 60 days.

Indiana Implied Consent Law

The State of Indiana has an implied consent law that establishes that all drivers issued a license to drive in the state agree to submit to a chemical test of their blood, breath or urine when asked by a law enforcement officer. Refusal to submit to a test for blood alcohol content will result in a driver's license suspension of up to one year for first refusal. The penalties for refusing to be tested are usually more serious than those associated with submitting to a test and registering a BAC at or above .08%.
