About Your Driver’s License

After an arrest for suspicion of drunk driving in Georgia, your license will be in jeopardy. This is true whether you submitted to a breath, blood or urine test of blood alcohol content or refused. A law enforcement officer needs only to reasonably suspect impairment to initiate an arrest for DUI in Georgia.

You can petition the Department of Driver Services for an administrative review hearing to contest the license suspension. You must however, submit the correct paper work and the required fee within 10 days of the date of your arrest. Failure to act in time will lead to the automatic suspension of all driving privileges, and any right to appeal.

Types of DUI Offenses

There are several DUI related offenses that can be charged against a motorist. A ‘DUI’ applies to those in control of a vehicle who are deemed to be impaired by alcohol or drugs to the point of driving in a less than safe manner. No physical evidence is required for this type of charge. A ‘DUI Drugs’ applies to those under the influence of drugs, such as marijuana, metabolites or controlled substances. A ‘Per Se DUI’ is when you register a BAC at or above 0.08% within three hours of operating a vehicle. ‘DUI Child Endangerment’ pertains to a DUI violation where a minor under the age of 14 years of age is in the vehicle at the time of arrest. ‘Commercial License DUI’ is the same as a ‘Per Se DUI’ though the threshold for impairment is a BAC of 0.04% or higher.

Penalties for DUI in Georgia

The type of Georgia DUI you are charged with and your BAC at time of arrest will influence the severity of the criminal penalties. Typically a first offense will result in fines of between $300 and $1000; a jail sentence of between 10 days and 1 year; loss of driver’s license for 6 months to a year; and 20 to 40 hours of community service.

Other penalties can include mandatory enrollment in an abuse risk reduction program, a clinical evaluation and monitored probation.

On a second or subsequent arrest for driving under the influence in Houston County within a 10 year period the penalties increase, including the amount of the fines, the length of the jail sentence and length of license suspension. In addition to this, new restrictions will be imposed, like the requirement of installing an ignition interlock device, the announcement of the arrest in your local newspaper and your license plates can be seized.
