Tennessee DUI for Man in Parked Car

Police called by someone who thought vehicle was suspicious.

The Greenville Police Department responded to a 1:30 am call from a citizen reporting a suspicious vehicle at an old car wash near Stan’s B-B-Q. The officer found Eric Donahue asleep in the driver’s seat with the car keys in his hand.

After reportedly detecting alcohol, the officer ordered Donahue to perform field sobriety tests. After performing the tests poorly, Donahue, 25, was charged with first offense driving under the influence in Tennessee. He was transported to and booked at the Greene County Detention Center.

Sorry but he was in control of the vehicle. He had the keys in his hand. He could have driven the vehicle if he had not fallen asleep first. Make sure if you do not intend to drive hide your keys before you pass out then you wont go to jail for DUI. Don’t put them in your pocket, don’t put them in your ignition, don’t hold them in your hand and don’t just drop them on the floor. You need to hide them good. Maybe put them under the car on top of your tire but hide them. Better yet just call a CAB... to take your drunk A#$% home.

What if he had absolutely no intention of driving? We all have the ability to poison someone, but merely having cyanide in the pocket doesn't constitute attempted murder.....at the most it should have been a public intox and vagrancy. The DI laws are out of control. It all seems to be about the money using public safety as a front to continue the crusade. If you want to stop DUI then close all the bars. The state is making money coming and going. There are parking lots for bars for a reason, people drink and then they drive. Without earmarking the money drawn in from DUI cases to promote chemical dependency programs its just a revolving door. When someone's license gets revoked it just aids in promoting heavier drinking for the individual since they are in the "woe is me" frame of mind and then cant drive anyway so just get drunk....I believe that states should grant separate licenses for buying alcohol (not just age of consent) that can be revoked upon ANY drinking related crimes. They could still drive to work to be productive and not a leach to society and if they do indeed drive under the influence again then they wold be drinking on a revoked license carrying the same stiff penalties. This would promote more rehabilitation among problem drinkers and lower the domestic violence in alcoholic families. LICENSE TO DRINK!
