Miranda Rights

MIRANDA WARNING:
  1. You have the right to remain silent,
  2. Anything you say can and will be used against you in a court of law,
  3. You have the right to talk to a lawyer and have him present with you while being questioned,
  4. If you cannot afford to hire a lawyer one will be appointed to represent you before any questioning,
  5. You may also waive the right to counsel and your right to remain silent and you may answer any question or make any statement you wish. If you decide to answer questions you may stop answering questions at any time, to consult with an attorney,
  6. Do you understand what I have told you?

Anytime you are arrested for DUI,YOU ARENEVERREAD YOUR RIGHTSuntilyou are inthe court and sometimes not then. How is this considered legal.

I think they don't bother reading you your rights because it interferes with the speed at which they can arrest you, book, and then release you to make room in the cell for the next unlucky schmuck they want to take money from. Also they classify you differently from "the common criminal". Usually they make you deals which you must first agree to waive your rights to anyhow. So they figure 99% of people will take the deal why bother reading you your rights? Also I have to think that most people don't even know they have rights and should have then read to them. Just another instance where "big brother" is trying to pull the hood over your eyes. Always remember, like it or not, you're going to die. Being killed by a "drunk driver" is probably better than having to suffer the horror of cancer.

Miranda only must be read to someone who is in custody AND being interrogated or questioned. If the police arrest you for DUI (handcuff you, put you in the car, etc.) that is the point where Miranda is required for if further questioning will take place. If they aren't going to ask you any further questions, Miranda is not necessary. Any questions that you are asked during the actual traffic stop are allowed without Miranda

So I've learned that if you are getting pulled over or have been drinking and driving, Before you answer any questions the police officer asks you, ask for an attorney. You don't have to submit to field sobriety tests. Ask for an attorney. I've also learned that it has to be better to refuse the chemical test. You might automatically lose your driving privleges for a year but will save yourself a whole lot of money in attorney fees, court costs, insurance. etc. you'd been better off just appearing like a resistant jackass to the police officer by not cooperating with his directional questions than a criminal in front of the court and essentially to the rest of the world because good jobs are hard enough to come by and with a criminal record it's damn near impossible.
