Ohio drivers caught driving under the influence of drugs or alcohol after midnight Wednesday could spend the first part of 2004 driving with special red-letter license plates.

The state's new drunken driving law takes effect Thursday. It calls for all offenders who are permitted to keep driving to display special license plates until their normal driving privileges are restored.

The special license plates have been available since 1967 but judges have rarely used them.

I feel they should also have "CONVICTED OF DUI" on the plates big enough so it could be read. A lot of people I have talked to think they're special plates that people buy. They have no idea that the person has done anything wrong. I think they're GREAT.

Lets assume that it was a one family vehicle and your wife had to use that car as well to pick up the kids at school. Now not only does the convicted person have to deal with the plate issue but the innocent as well. Think about things like this prior to opening your battleship mouth!

I think adding "convicted of D.U.I." to the plates is a bit much. People that own the plates have already served jail time, done many hours of community service, 90 manditory AA meetings, outpatient drug counseling, pay $200 dollars every other month to get their breathalizers callibrated, not to mention increased car insurance rates. If they've done the time for the crime, why further chastize them? Shouldn't we be focusing more on real criminals like child molesters?

I agree to your message. I just had to get the "special plates" and it's absolutely humilating! But the thing of it is, I deserve them. I did my time and my job is now on the line because of all the classes I have to do bu I messed up and I know it. And I can promise it will NEVER happen again. Just wish it was the same for everyone else out there that are the repeat offenders as it is for me. I appologize to everyone for putting them in danger...

Maybe people would actually take a dui offense seriously if they were not handed out like candy. It is no longer an embarassing thing because everyone knows it's luck of the draw...you could have one glass of wine and get pulled over for a tail light out and the next thing you know your being treated like a criminal. We might take a dui offense seriously if they raised the legal BAC limit and only prosecutted those who really are drunk behind the wheel. Right now a dui is a laughing joke. 1 out of 2 people have one! So lets actually do something about the real problem of DRUNK driving instead of deciding to put A LISCENSE PLATE on peoples cars that they are just going to take off anyways. Trust me they will find a way to do it. Raise the legal BAC Limit!!!! aND ONE JUST MIGHT TAKE THE CRIME A LITTLE BIT MORE SERIOUS

They have gone from .15 to .10 to .08 and at .08 the money is rolling in. A whole industry both private and government has grown up around DUI cases. Look at the classes, they are full. There is absolutely no way to pass afield sobriety test and everyone knows it. It is purely up to the cop who pulls you over and they never have the camera when it is a questionable DUI. We see plenty of shots of the falling down drunks but never the guy who is weaving his body a half inch, or who didnt put his toe to his heel on the third step..... it is the fleecing of AmeriKa by an out of control money hungry legal system.

I recently recieved on of those famous not really drunk but had a glass of wine and am now a criminal dui's and took it to court. And funny what you said was pretty much exactly what they put in the outcome of the trial. It said they found the cops said to be the truth were my side was a deemed in accurate and in other words a lie because I had alchool in my system even though they have conviently lost the blood. So they have suceeded in creating a world famous fraud scam that the government is in on! And we as up standing world class citizens are being treated like criminals mixed in with the murders and rapist of the world. I ask you what is wrong with this pictute????

When you say I misspelled at least three words, then that implies that there must be more than three spelled incorrectly. Please identify, other than the word "sound" which was spelled correctly when I submitted, but the moderator appears to have changed it. Your credibility also appears to be lacking, just like Ashley. You think they need to raise the BAC limit so you can drink more and drive? The BAC limit is at .08 because you are IMPAIRED at .08. Even though you may not feel drunk, your motor skills are IMPAIRED. That is why it is called IMPAIRED DRIVING. You obviously don't know what you are talking about if you think that police officers are only pulling people over for DUI's because they are getting more money for the government. They pull them over and arrest them so they don't cause car accidents and kill people. ok besides bad spelling... i actually have questions about the action i should take regarding my current situation. I was pulled over for the lights over my license plate being burnt out.He told me to get out so he could show me the plate. Once i did he asked how much i had been drinking. I said one beer. He asked if it was a wine cooler, my breath smelled fruity. I then told him it was my gum. (true). I then did a sobriety test. And to my knowledge passed. then did a quick test breathalizer-blew A .064 . He arrested me and took my friend with us to a patrol station where i did an official breathalizer and blew a .062 . before the test he told me i would most likely get a OVUAC because i probably would blow over .08. and that in court the judge would probably not suspend my license. after consulting some friends i realized that i could lose my license anyway.
Should i hire a lawyer?
Whats worst case and best case scenario?
Will this afffect my scholarships? degree? Job?

In regards to your questions,
Yes get a lawyer, they know the law better and although they might be expensive the consequences of receiving a guilty verdict might be more expensive in the long run.

Worst and best scenario, will be to hard to state without knowing what state you received the ticket.

I don't know if the status of your scholarship or degree could be affected. When interviewing for a job if they see a DUI on your record during the background check rest assured they will ask question if not rejecting your application for the position especially if you did not put it on the application.

On a larger scope, I have heard this debate many times from people on both sides of this. I think bottom line the rules do need to get tougher to get people to think about the consequences of drinking and driving before they go out. This is not a decision to ponder on after you had some drinks as your judgement and behavior are now affected by the alchol level you have consumed. I do know also a person's weight plays a factor in detemining the BAC before the debates start up.

My main point is if you are going to drink either stay at home or assign a designated driver. I do realize it's not as much fun being the designated driver; therefore, rotate this respoinsibility around.

Anything is better then getting behind the wheel after a couple of drinks and playing russian roulette with someone elses life.

It's always good to have a DD, it sucks, but if you rotate it then everyone wins. You would be surprized at how many people would jump in on the opportunity for a safe, free ride home MOST of the time. It seems like no matter what, if you are under the legal limit, at the very least they make your life difficult. Ultimately the courts listen to the police, and if your BAC is below the limit and they still say you were intoxicated...then they just give you a DWI and call you a drug addict. It's better to just stay away from the BAC game alltogether. If you can't go out with your friends and enjoy a game of pool or something without drinking, then I suggest hanging out with more interesting people.

They use these license plates to DETER people. That means that people will see other people with these plates and think, oooo i would be humiliating my whole family if i get one of these plates so maybe i shouldn't drink and drive.. And if you DO decide to drink and drive, that is your own problem and maybe you shouldn't have driven and put other lives at risk and you're going to have to live with the fact that you are humiliating your family too.

Really, what are the rules of having "Party Plates?"

Can you drive your wife's van, shown on WTVG-DT as 'clamped' in Toledo for non-paid tickets, be used INSTEAD of your own "Party Plated" vehicle? Yes, it happened in Toledo. same light chocolate minivan, as on WTVG-DT was being driven in South Toledo, by the person who has the yellow and red plates.

Is this a law broken? If so, how should we go about reporting?

These plates are an absurd idea!
If anything previous offense info should go on the persons drivers license not the plate. People shouldn't have to be ridiculed after they've served their sentence. Breathalyzers aren't even accurate.
Alot of people have been served faulty sentences based on innacurate tests. I think the legal limit should be raised back up to 1.05
As a grown person I think it is stupid that I can be arrested for driving after 2 beers. I think it's more about generating money for the states than safety.

I would like to say that what is MORE absurd is a drunken driver killing your grandson LEAVING the scene of the killing while your grandson lay on the cold hard wet ground dying, killer also had a 1.12 blood alcohol (per blood test)level and being sentenced by a liberal judge to losing his license for 90 days and 3 years probation. The final charges were NOT vehicular manslaughter, but DUI.

Our justice system is Absurd, I was told by the ADA that she could not prove that the killer meant to kill my grandson. And that the police (those civil servants) had botched the case and she did not "feel like having her witnesses torn apart on the stand".

My grandson Timothy (yes he has a name and birthday and thanks to some drunken killer he now has a date of death) Was only 23 years, he was not drunk, he was full of life and he loved everyone. At his funeral people came and filled the funeral parlor and out the door waiting to get in to say to goodbye to my precious Timothy.

Sorry to hear about his death. I too have lost loved ones to accidents involving alcohol. My brother has been in a home with brain damage since 1988. I thought about my stance on the legal limit. I'm not saying driving smashed is wise. The reason I have a tough time with this License plate issue and DUI laws is that it seems like there's no end in sight to these laws. It's like I agree with the laws but I don't at the same time. I know a guy that was in an accident sober said the stop sign was blocked by a tree. Hit a guy the man was killed. I don't even think he got in trouble at all. If he would have had 2 beers he would have been public enemy #1 for murder. Might not have had anything to do with alcohol wouldn't have mattered. On another level we were at the bar a while back saw this guy leaving the bar with a 12 pack couldn't walk straight. He was saying that he's a cop whatever. I watched that show to catch a predator and see the sentences the guys get for attempted sex with a minor 6 months probation etc. You get more than that for 1st time driving with .08 It's just annoying. So I think about this stuff and it's like I just shake my head. Catching people driving under the influence is something the police can do easily. At what point will it end. They can go down to our local bar any night and stop every single person leaving and catch a way higher percentage of people under the influence. That would theoretically protect more people. They don't do it. It would close the businesses. Instead they spoon pick a few people each weekend and it costs them huge. It's flawed. I've been run off the road and seen 90 year olds driving dangerously. Should they have I'm old and less coordinated on their plates. It's right in a way but wrong in a way. Sorry I just can't get on bored with this. Cars in general are super dangerous. An old man drove right into a restaurant front in our town and killed several people in the restaurant. Does that mean cars should be banned? Should there be an age limit on driving? Should alcohol be banned?
I don't know if my case is very strong here It's just that This things are black and white lets regulate everything future with more laws and government and hey lets have cameras on every corner society we're apparently going toward is grim. I agree but I disagree I'm conservative and I'm liberal

I picked up on your remark about where will it end. My guess is when we get serious about drinking and driving. And when the guilty ones are prosecuted and laws fully enforced. Maybe if you have a chance to drink drive and kill someone you will get a better understanding. Because it is obvious that at this point in your life you do not seem to get it.
I cannont put it strongly enough!!! Innocent peoples lives are lost and families ruined because of a selfish act. I read many of the responses here and it sounds like whinney babies crying if I get caught doing what I want, and to hell with anyone who may get hurt, then it will cost me money and be a problem for me. Obey the laws and you won't have a problem. Drink at home. Drink at friends house but plan on staying overnight. Just don't drive.

It's already serious but I get your point. A guy I work with killed somebody who was driving a moped while he was driving drunk. He did 2 years. I dont think its a fit punishment. What do you suggest?
Unfortuantely Since alcohol is sold and so readily accesible I don't think DUI will stop anytime soon. Example if every car had a breathalized ignition lock. It would prevent dui. But the local and state governments couldn't generate money. So, do they really care about lives or money.

Theses problems/issues perpetuate the need for government. I don't want people to get killed I just dont think these plates wil make a difference at all. Just more of the same. When I think of someone who's a dangerously drunk driver type How does the plate keep them from killing people with their car? It doesn't. Take some of the 15 billion and put breathalyzer/alcohol detection devices on all ignitions. That would. It won't happen. Like I said local governments generate money on this. They know it will be a steady cashflow to them. Unfortunately more lives will be lost.

I agree with your about government looking for ways to generate money. I would hope the plates identify the offender at the very least.I think that if you get caught DD in a borrowed vech. the person who loaned the vech. should have to pay as well not just in money but a stiff penalty. To read your response is very disheartning. The USA is all ready falling apart in every area of life. We do not need government to stop DD we need to police ourselves. Our society is full of big babies who will not take or do not want to take responsibility for themselves. We have laws to protect the public, if these laws were enforced by the courts then this may stop someone from DD.
As for your coworker getting 2 years, I applaud the Judge for that sentensing. The breathalizer in the car idea is in NYS the man who killed my grandson had to have one installed in his vehicle, but they are easy to side step. I think that if you take a life then the penalty should fit the crime. Killing someone with a vehicle because you wanted to drink and drive is no different from taking a knife and stabbing or a gun and shooting them. KILLING is KILLING.
Let me explain how losing a loved one killed by a DD affects the whole family.
Tim's mom is now alone he was her only child. She will never have anymore children or never have the joy of grandchildren. She will never hear Tim's laugh again, see his face. Watch him get married, or have his own children. Everyday she struggles to move past the heartbreak and live her life.
As his grandmother, I have pictures of Tim and I will never see him grow older. I will never hear his laugh again, I will never go to his wedding, or have him present at our family gatherings. He was a joy to know and I only have memories. He is not here for me to hug, and laugh with. Drunk driving is a crime against society, and unfortunatly lawyers and judges and even prosecuters have found ways to ignore the penalties. You talk about money being generated, lawyers make huge incomes on DD cases, the prosecuter who handled our case was an idiot and afraid of DD lawyer. Huge money is made, and at the tax payers expense. People who CHOSE to drive drunk should pay very dearly and if they KILL someone then they should have to pay an even higher price.

Or if you know you have to leave at 9, dont take your last drink at 8:55! Check the statistics on how many people died when the BAC was at 1.05 and how many there are now when its at .08. Then tell me you think it should be raised again. It is at .08 because you begin to lose your motor skills at .08!

I was convicted of a DUI a couple of months ago. I had followed the general guidelines of no more than one serving of alcohol per hour (with water in between) to make sure I was safe (I had three glasses of wine over almost five hours). I never take chances, so if I'd felt even the slightest bit tipsy, I wouldn't have driven. My field breathalyzer was a .15. At the station, an hour and a half later, my breathalyer result was a .20. How did this happen? Acid reflux. Apparently this is one of several medical conditions that can create false breathalyzer results. In my case, they weren't just false, they were highly exacerbated. By the math, based on what I drank, how much, and my weight, I should have come out to about a .04. My problem was trying to find my cell phone while driving (cell phone use is not illegal while driving in VA unless you're under 18). My BAC certificate was dismissed by the judge at the trial because we were able to prove my medical condition interfered (that cost quite a bit of money to do), but then it came down to the cop's word that against mine. I made the 'mistake' of doing the heel/toe with 2" between steps. My lawyer started to read the training handbook to the judge where it says there is some leeway allowed and explained I was wearing 3" heels on rocky surface, but the judge was in a nasty mood and kept telling him to 'hurry up'. The judge was rolling his eyes, playing with something on his desk, not really listening. He never even looked at me, he was rude to the lawyer, my witness, even the prosecuter. The cop couldn't even remember most of the evening I'd been arrested and his notes weren't thorough, but the judge just assumed I was drunk and convicted me. I wish I could have afforded an appeal, but I couldn't. The cop was nice and had told my lawyer he wasn't sure I should be convicted in the hallway before the trial (he definitely wanted to dismiss the BAC) but he was obligated to read from his notes and answer as truthfully as possible. He admitted that my crying and the cold probably played a big part in my field testing, but the judge didn't care, so I don't blame the cop. I blame this faulty system. How can we let justice come down to whether a man/woman on the bench is willing to listen to something or not? Maybe they just had a fight with a family member or they've got a headache, but my life was on the balance and that must be taken seriously. And this just gets worse: though my BAC certificate was proven false in court, the ASAP folks decided to use it anyway and now I'm in an alcohol treatment (it's automatic with any BAC over 0.15). I've never been in trouble with the law, I've never even had an accident before, I'm a professional (senior staff member, master's degree), I definitely don't have a drinking problem (I don't drink often, maybe sometimes on weekends), and now I'm convicted of a DUI and in alcohol treatment? And these things are costly- court fines are $475, VASAP is $375 (not sure what I'm paying them for since they're not doing with me), ADAPT (treatment program) is $645, DMV reinstatement is $220, lawyer and expert witness is $6800 and I'm not sure yet how much my new insurance rate will be. I'm now dealing with this about three hours a week, which is painful with a job and family...for what??? It's absolutely ridiculous. And the thing is, to whomever said 'just don't drink and drive' it wouldn't have mattered if I'd had a single drink or not. Acid reflux, diabetes, certain asthma inhallers can all cause major problems in breathalyzer results. If you've been around paint or lacquers or certain other fumes, used breath spray or certain types of mouthwash, even some lip protectants, smoke cigarettes...you can show a false positive on a breathalyzer. Even if I had not had a drop of alcohol that night, I would probably have been arrested- my BAC was up over .15 OVER what it would should have been. I'm not saying the laws need to relax, but they need to function more effectively, target the real problem. What good is it doing the state to treat me like this and subject me to all of this? I'm not getting anything from this except to learn that it's easy to get a raw deal based on someone's subjective decision-making. It's dangerous and no one benefits....except those with their hands stretched out for the allmighty dollar I guess.

No, they should not have large letters stating anything!! The plate alone is enough. Punishments are in order for the offense, but the bold plates already pose a large enough threat to the driver as it is. Too many ppl have had their lives turned upside down by accidents involving drunk driving and now we have done just the opposite by making the convicted drivers targets for anger and hostility.
i was in the car with a friend who had a dui conviction and her vehicle displayed the tags to prove it. She harmed no one. She was pulled over for a tail light and blew just a smidge over the limit. Anyway, while driving down the highway at 65 mph, a car that had been following us for a while finally pulled up on the drivers side of the vehicle. the passenger spit at our vehicle and then threw a milkshake at the windshield as they pulled past us! We swerved and were lucky to misss traffic.
