Boating While Drunk

New boating while drunk law takes effect Sunday August 4, 2006, 2:51 PM EDT

ALBANY, N.Y. (AP) - Beginning Sunday, operating a boat while drunk will get you the same stiff penalties as an arrest for drunken driving.

Supporters of the bill passed by the Legislature in June and signed into law in July by Gov. George Pataki note that 28 percent of fatal boating accidents involved alcohol in 2004, the latest year for which statistics are available.

"Boating while intoxicated is at least as dangerous as driving while intoxicated because the sun increases the effects of alcohol," stated Denna Cohen, the president of Mothers Against Drunk Driving on Long Island.

Under the new law, a first conviction for boating while intoxicated would be a misdemeanor with a sentence of up to a year in jail, instead of 90 days in years past. The fine would also increase to a maximum of $1,000 from $500.

A second conviction in 10 years would be a Class E felony, carrying up to four years in prison and a fine of up to $5,000. A third conviction in 10 years would be a Class D felony with a sentence of up to seven years in prison and a fine of up to $10,000.

The maximum fine for boating while ability impaired will rise to $500 from $350. A second conviction in five years would carry a fine of up to $750 and 30 days in jail.

"Boating while intoxicated is not a harmless activity and now it will be treated in the serious manner it needs to be," said Sen. John Flanagan, a Long Island Republican who co-sponsored the bill.

"This law will give marine law enforcement and prosecutors the necessary tools to maintain an aggressive posture against BWI and BWAI violators," said Assemblyman Thomas DiNapoli, a Nassau County Democrat who also sponsored the measure.

The Otsego county sheriffs boat patrol on Goodyear Lake only patrols 20hrs a week. Most of that 20hrs is Mon-Fri when there are hardly any boats on the lake. When the weekend comes around the lake is crowded with boats and boating law violations and NO sheriffs boat. North of the Portlandville bridge is not patrolled any more because the sheriff put a mast on the boat that keeps it from getting under the bridge. Instead of takeing the mast off the boat the sheriff just gave up patrolling half the water ways in the town of Milford. The boating law violators here could care less about you, your boat or your property and it seems the sheriff doesn't care eather.

There is a org. for goodyear lake that has pics of their big fest.One of the pics shows a boat owner with a coors beer in hand. I hope he wasn't driving that boat. They don't care anyway because there is almost no boat patrol on weekends during the boating season.

We should give thanks for the wonderful sheriff we have. I'm sure he has a good reason for doing such a poor job with his weekend boat patrol on Goodyear Lake this season.

Like the rest of this boating season this weekend was no exception. With the lack of the weekend boat patrol on Goodyear Lake by the Otsego County sheriffs dept the boaters were out of control. Boaters openly drinking alcohol while operating their boats plus other dangerous boating violations that were seen on the lake and river. It is reassuring to know that even tho the sheriffs boat has been sitting at the dock most weekends his department along with the town of Milford fire department has been practice drilling pulling bodies out of the lake. On MONDAY Aug 17 they put on a big drill with the sheriffs boats and the fire departments air boat practicing pulling volunteer bodies out of the lake. Seems to me it makes more sense to patrol the lake more on weekends and you might not have to pull a body out of the water. There are some great pics of this practice drill on the Otsego County Sheriff's web site.
