Iowa Football Player Charged with DUI in Iowa City
Starting player arrested for drunk driving on moped.
The starting offensive tackle for the Iowa Hawkeyes football team was arrested for driving under the influence in Iowa City. Kyle Calloway was stopped by officers after riding a moped into a barricaded area. He admitted to having consumed seven or eight beers. Calloway submitted to field sobriety tests and a breath test, which registered a blood alcohol content of .106%. The legal limit for intoxication for adults in Iowa is .08%.
Calloway will be a senior next season and was listed as the starting right tackle during spring practice sessions. He has been suspended for one game by coach Kirk Ferentz. The school has also required Calloway to complete alcohol counseling classes and perform community service before rejoining the football team.

UFC Fighter Charged with Iowa DUI
Lightweight Josh Neer led police on high speed chase before arrest for drunk driving in Des Moines.
"Ultimate Fighting Championship Lightweight Josh Neer was charged with driving under the influence in Des Moines Iowa after reportedly hitting two vehicles and leading police on a high speed chase. Neer fled the scene of the accident and exceeded 100-mph while leading cops on a 15 minute chase. He was stopped with spike strips that deflated his tires.
Neer was booked for drunk driving in Iowa and freed on a $7000 bond.
Neer holds a 3-4 record in the UFC octagon, winning a unanimous decision on his return to UFC in early 2008. He cancelled a September bout and is scheduled to return to action February 7 in UFC Fight Night 17.

Iowa Upholds Use of Breath Test in DUI Cases
High court ruling sets standard for entire state
The Iowa Supreme Court ruled that breath test results can be used to determine blood alcohol content and justify arrest for suspicion of drunk driving.
At issue was a legal challenge against DataMaster breath test equipment. DUI defense attorneys argued that the machine results are too unreliable to be entered as evidence in a court of law. The high court decided to hear arguments in the case because the equipment is widely used in Iowa and the justices wanted to provide guidance to judiciary and attorneys. Their finding overturns a lower court decision that found the DataMaster unreliable and evidence gained from its use inadmissible.
Those arrested for Iowa DUI can still challenge the results of a breath test during trial. The Supreme Court decision, however, allows prosecutors to enter the test results into evidence.
