Even though he was on call for duty, Detective Jason Fitzwater had been drinking with members of a SWAT team at multiple bars. Early in the morning he crashed his unmarked sheriff’s department patrol car into a concrete barrier, causing $5,000 in damage. Following protocol, Fitzwater contacted a superior officer, Sgt. Tom Frank, and said he had bent a rim.

In the case of Fitzwater, Lt. Couch based his assumption that Fitzwater had been driving at the time of the accident on statements from other officers meaning there was no probable cause for an investigation. Couch also failed to inform Fitzwater that he was subject of a DUI investigation. The ensuing investigation and arrest was thus ruled unlawful by the civil court. Without the breath test and field sobriety test evidence, the case will be difficult to prove.

Prosecutors argued that Couch was permitted to make his own observations and that he had probable cause to investigate and arrest Fitzwater. Prosecutors plan on reviewing the ruling and consider an appeal.

Detective Fitzwater resigned from the sheriff’s department after the incident, and is currently employed as a dispatcher with the Bradenton Police Department. If the Florida drunk driving case against him is dismissed he would like to go back into law enforcement.
