Use caution when boating this lake. The sheriffs boat patrol here is very poor. DUI boating is seen in this area. The sheriff gave up patroling the river north of the Portlandville bridge and all kinds of boating violations are seen here. Use caution because the boating law violators here don't care about you, your boat or your property and the sheriff doesn't care ether.

There is a web site for this lake that showes pics of their big lake day. One of the pics shows a boat owner with a Coors beer in hand. I hope he wasn't driving. Most of the time there is no law enforcement on the weekends and the boaters do as they please.

if you know the county that your parents lived in at the time you can look in that county's newspapers in the archives and try to put in as much info as you can,and search for that article, you will most likely have to pay $3.00-$6.00 for that article if they have it.if you want me to help just email me with names and locations.

I heard that one of the San Jose Superior Judges daughter was killed by a drunk driver? Does anyone know which Judge? Wouldn't it then be a conflict of interest if this Judge presided over DUI cases?

I do not know about this guy, but the same thing happened to me. The man who hit me already had 4 dui's, this would be his 5th. He was sentenced to 16 months in California's Folsom Prison. Including his county time and good time, he only did a total of 8 months. Only 3 of those months being in actual prison. Did I mention this guy did not have a license or insurance either. He was also ordered to pay back more than 24,000 dollars in medical, I have not seen a dime. It is now 3 years later and I am still paying out of pocket for this.

Jacki, you need to go to the courts and pursue payment of you medical bills. The courts will do nothing to assist you unless you demand assistance.
In September of 2001 I was struck by drunk driver. She actually hit us on purpose. She had stated that she was going to kill us and I didn't believe her. We stopped at a stop sign and sure enough she hit us 80 MPH and shoved us out into oncoming traffic. Her insurance did not have to pay medical bills because they deamed it "Road Rage" and "Road Rage" was not covered in her policy.
I have been struggling since 2001 to pay $250,000 in medical bills with no recourse. You on the other hand have a court order for the man that hit you to pay your medical bills. Camp on the sentencing Judges bench daily until he/she forces the individual to make restitution or go to jail. You can also enforce a judgement through collections. The next time one of your medical creditors sends you a bill, mail them a copy of the court order for the offender to pay.
Best Of Luck

i was reading everyones comments and it brought back memories of my best friends death in sept 1985, this drunk driver, last name McCORMAC was driving driving at such a high rate of speed that when he hit "lori" she was on her bike that the emt's had to take her and her bike to the hospital just to remove her body,he broke every single bone in her body.then took off running like the coward he was and still is,anyway i was researching her case and i decided to see what kind of sentence he recieved and i was blown away, that low life scum of the earth recieved 6-12mths,WOW! that mad me so upset and angry that i cried all day,my point is the laws have to be set higher for these creeps,he should have gotton 20 yrs in prison.these laws have to be harder and inforced, just because it was his first offense?that's crazy.i hope he rots in hell for the rest of his miserablr, sorry, worthless, pathetic life. i miss you lori jones, died sept 3,1985 by drunk driver while on her bike.

I feel for you but your best friend was not killed because of drunk driving, your friend was killed by an idiot out "reckless driving" who happened to consume alcohol.

My father, Arthur James Lent, was killed in August of 1979 by a drunk driver in Montery, CA. He was driving a semi that was filled with fuel. From the little news paper clippings that I have found, very few and they are not dated, he was hit coming into town and drove while on fire through town to the field where his "rig" blew up. The woman that hit him, from the information I have, did not serve any time and was a habitual offender. He was killed two months before I was born and I am trying to find any information I can about what happened. I don't know where to start. My grandparents have since passed and my uncle, his baby brother, is still very tender about everything. Please anything would help.

My grandson Timothy Payne was killed by a drunk driver on March 11, 2009. He was 22 years old. The charges were dropped concerning Tim's death, and the driver of the car is only charged with 2 misdemeanors. The driver blew a .09 alchol level but passed the majority of the roadside testing done. If anyone has lost a love one due to a drunk driver and is not receiving the justice they feel is due, there is strengh in numbers please contact me.
Because our family had been so hurt and let down by the justice system please do not contact me if you are not sincere.

What was not mentioned, was the Drunk Driver was given 1 hour to digest the liquor before being administered the breathalyzer. 2 hours later he revealed a .20 BAC. He admitted to 4 hard liquor drinks and 2 hard liquor shots within a 3 hour period, before getting into his car and pulling out of the parkinglot, then striking my Son. He drove with my Son for over 175 ft. through his windshield, before throwing him to the concrete, killing him. He was able to retain attorney Paul Cambria. Because his attorny was able to bulldoze the ADA, he is not paying for any of it, and his lies are being held as truth in court. We have hired private Specialists to prove him a lier, and the court will not look at it.
So much for our legislative system. My Son is in a grave being called the "Victim" and this guy is tring to get sympothy, as an accident!!
We are beside ourselves as a family. Timothy was such a loving, kind, and very special important person, and part of our family. You could not know him and not love him!!!

I am sorry to hear about your loss. But how did the accident happen? You said the guy passed the majority of the sobriety tests. Just because he is legally intoxicated by the state bac laws doesn't mean he driving was actually impaired. Instead the person was probably reckless driving which is an issue that needs to be taken seriously. People think that every person that has had something to drink means alcohol was the cause of the accident and that is not always the case. Reckless driving actually kills more people than drunk driving, just because a person is convicted only of dwi or dui doesn't take away from the fact that the person was reckless driving. A charge that usually always gets dropped when paired with a dwi charge. A person could be right at the legal limit, driving perfectly, doing absolutely no harm to anyone, not speeding, not driving recklessly, not doing anything other driving while having a tag light out, and get more punishment than someone who hasn't drank but is out on the roads speeding, goofing off having a good time and crashing into someone. People need to start realizing that the bigger issue is reckless driving and the punishment for it needs to be higher than that of driving under the influence. The issue is masked because no matter what a person gets pulled for if they've been drinking that's what they will get charged with, dwi, not reckless driving or speeding. Not everyone out there who has a bit to drink lacks the since to drive responsibly. I'm not trying to condone drinking and driving so please don't get me wrong, but if you really want to help lower fatalities we need to do something to lower reckless driving and speeding, that is what kills people. It's not right that one person drinks, drives over 20 miles the speed limit, racing, or taking off spinning tires and loosing control and kills someone is added to statistics of drunk driving; that's not it, it was an idiot out driving reckless, and someone who went to the bar, has a .08, who's driving abilities weren't impaired driving normal but is pulled over for an equipment violation has to pay for that guys stupid recklessness. I'm truly sorry for your loss and regardless of whether you agree I hope you see where I'm coming from.

Thanks for your response Tom. The problem with the reckless driving is that Timothy was about 100 feet from the drive way of the club he had been in. The person who took his life was at the same club and had been drinking heavily. This person left a few minutes after Timothy did and I believe he must have flew out of the driveway to get the amount of damage that happened to the car.
When the prosecution went before the grand jury (not sure how it was presented), they did not feel there was sufficent evidence to prosecute the killer with vechicular manslaughter. They said the evidence did not show any intent.
Posted by Tom at 2010-02-25 08:25
Again, that's what I mean, you said the person must have "flew out of the driveway." That is reckless driving, not everyone that has had a few drinks and then drives are going drive drive like maniacs. Plenty of people also even drive this crazy and cause accidents who haven't even been drinking and get less punishment than someone who does nothing other than have a tail light out but the person with the tail light out has a few beers and is at the legal limit, something very hard to know when we have bac laws but breathalyzers aren't readily available. And then the person with the tail light out who did nothing else but make a mistake, loses is job, his freedom, and is put in a financial whole he can almost never get out of. The person with the reckless driving who was in a crash pays a fine, something that to me wasn't a mistake, reckless driving is more dangerous than any other driving offense.

revisement to previous inquiry: July 12, 1964 looking for any information on a suspected drunk driving accident that occurred in los angeles. venice blvd and Rimpua. according to my mom (the only witness) a drunk driver went through a red light(his)as a station-wagon full of african american children and one female adult. the station wagon had the right of way turning left as the drunk driver sped through his red light - slicing the station wagon in half. several children died at the scene. my mom was the only person who stopped to help. she held dying children in her arms. and tended to the woman who was in shock in the drivers seat. my mom never healed emotionally from this tradegy. she has always wondered how the rest of the victims survived. my sisters and i only know of a story that changed the course of our own history.. as my mom had a nervous breakdown shortly thereafter. PLEASE if anyone ie;police report, newspaper clipping anything and what if anything happened to the man who did this horrendous act of selfishness. please let us know

I am currently looking for a particular story about a man you killed someone when he was drinking and driving. As his sentence, he was to pay the family of the child he killed $1 for the rest of his life. It is an older story. Please help if you know what that man's name was.

Is anyone aware of the car seizure laws in MN? If so, can they take your car prior to conviction if its a second offense and BAC > .2? If they can't immediately take the car, what prevents the person from just selling the car prior to their court date? I am happy to know that my state enforces harsh punishments for drunk drivers. It just seems that this punishment is too easy to get around.
