Actor's arrest for drunk driving in LA cleared from records.

A judge has expunged Mel Gibson's record, wiping out his arrest for drunk driving in California. The 53-year old actor was stopped in July 2006 and charged with driving under the influence in Malibu. During his arrest, he uttered profanities and anti-Semitic comments towards the officers.

Under California law, a person can request that their arrest record be cleared once they complete all conditions of sentencing. Gibson has been under probation for three years, and not had another alcohol related offense. He also joined an Alcohol Anonymous program and performed public service work.

Mel Gibson Seeks to Have California DUI Expunged

Actor files to have Los Angeles drunk driving charge dismissed.

Mel Gibson has filed a Motion to Dismiss with the Los Angeles Superior Court in an effort to put his infamous California DUI case behind him.

Gibson was arrested in Malibu California for driving under the influence on July 28, 2006. During the arrest, he went on an anti-Semitic rant. He entered a no contest plea to the CA DUI charges. He was sentenced to three years probation, fined $1,300, had his license suspended for 90 days, and was ordered to attend Alcoholic Anonymous meetings and enroll in an alcohol abuse program.

Gibson's criminal defense attorney is using a provision of the state penal code in filing the motion to dismiss. The code states that a defendant who has completed the terms of his/her probation to change the initial plea and ask a judge to "dismiss the accusations or information against the defendant." It is the discretion of the judge to accept the motion.

A hearing has been scheduled in the Malibu Courthouse for October 6.

Mel Gibson Completes Terms of Probation for Los Angeles DUI

Judge finds the terms of Mel Gibson DUI agreement have been met.

Superior Court Judge Lawrence Mira found Mel Gibson has complied with terms of his probation for his Los Angeles DUI arrest. The actor-director still has 18 months of probation remaining though he no longer has to appear in court for regular progress reports or attend mandatory Alcohol Anonymous meetings.

Gibson was charged with drunk driving in Los Angeles in 2006 during an infamous traffic incident where he made derogatory comments about Jews and sexist remarks to a female police officer. In a no-contest plea agreement reached between his Los Angeles DUI attorney and the prosecutor’s office, Gibson received three years probation, paid a fine and was required to attend Alcoholics Anonymous meetings. In addition he was required to attend a 90-day counseling program for California drunk driving offenders. He completed the mandatory counseling and attended five AA meeting a week for five months after his sentencing. He has continued to attend AA meetings three times per week for the past seven months.

Gibson quickly left the courtroom after the judge’s ruling. He has repeatedly apologized for his actions during his arrest.

Mel Gibson DUI Update

Actor is fulfilling terms of his probation

Mel Gibson is continuing to put his notable California DUI arrest behind him. His attorney presented documents to a judge showing that Gibson has been successfully meeting the terms of his probation.

The 51-year old actor is required to regularly submit information to the court during his three-year probation period. The judge determined that Gibson may now be allowed to attend Alcoholics Anonymous meetings voluntarily.

Mel Gibson Considers His DUI a ‘Blessing’

In his first media interview since his infamous California DUI arrest in Malibu, California, Mel Gibson told Diane Sawyer that he needed "public humiliation on a global scale" to get sober. The late July incident forced Gibson to face many personal issues, leading the 50-year old actor to call his California DUI arrest "a blessing".

“Sometimes you need a cold bucket of water in the face to sort of snap to, because you're dealing with a sort of malady of the soul, an obsession of the mind and a physical allergy.”

Now claiming over two months of sobriety, Gibson has admitted to a long battle with alcoholism and he said it is a continued struggle to stay sober. He also said that he had started drinking again about two months before his DUI arrest.

"Years go by, you’re fine," he says. "And then all of a sudden in a heartbeat, in an instant, on an impulse, somebody shoves a glass of Mescal in front of your nose and says, ‘It’s from Oaxaca.’ And it’s burning its way through your esophagus and you go, ‘Oh man, what did I do that for? I can’t put the toothpaste back in the tube.”

Gibson earned himself international headlines with the verbal tirade made during his DUI arrest on July 28. He said to a Los Angeles police officer that “Jews are responsible for all the wars in the world,” and then asked the officer if he was a Jew.

Gibson called his anti-Semitic diatribe “the stupid ramblings of a drunkard.” He said he has since apologized “more than anyone I know.”

Several groups however, including Jewish leaders and addiction experts, say Mel Gibson must do more if he wants to make amends, including being more accountable for his behavior.

Entertainment publicist Michael Levine said Gibson “did not reach out as he could have. Even in their most drunken moments, they don't utter something that has never crossed their minds.”

Others feel that the Gibson interview was a strategic public relations move rather than a rehabilitative or apologetic effort.

During the interview he admitted being very concerned about how he looked in his police mugshot. “The first thing that went through my mind was Nick Nolte's photograph. Vanity won out.”

In a plea bargain arranged by his California DUI defense attorney last August, Gibson pleaded no contest to drunk driving and agreed to serve three years of probation, pay a fine and seek alcohol rehabilitation.  He also must make public-service announcements about the dangers drinking and driving.

Gibson says he wants to continue making movies, though he accepts he has alienated influential people in the movie industry. His latest movie ‘Apocalypto’, which he co-wrote, directed and financed, will be released in December.

Under the agreement Gibson will pay a $1,300 fine, perform public service announcements on drinking and driving and regularly attend Alcoholics Anonymous meetings. He is also placed under a three year ‘supervised probation’ where he will have to periodically return to court to show he is meeting the terms of his agreement.

Gibson was to appear in court on September 28 but all parties involved preferred to avoid a media spectacle. The plea bargain was presented by his DUI defense lawyer to the Los Angeles County Superior Court in Malibu, and the charges stemming from the now infamous July 28 event were resolved quickly. Gibson was not in the courtroom.

Under the deal, Gibson plead no contest to a misdemeanor charge of driving with a blood alcohol level above 0.08, while the charges of driving under the influence of alcohol and driving with an open container of alcohol were dropped. Gibson also avoided additional charges like ‘speed enhancement’ for going more than 20 miles per hour
over the posted limit, attempting to leave the arrest scene and threatening a police officer.

In California, first-time DUI offenders often receive probation, especially when there was no accident or injuries.

A Los Angeles Times news analysis said, "Crossing this line could cost him deals."

On the other end of the spectrum Rabbi David Baron has extended an offer to Gibson to speak at his Beverly Hills based Temple of the Arts for Yom Kippur. That is the Jewish Day of Atonement and Baron thought it would be a good opportunity for making amends with the Jewish community and to initiate change in anti-semite bias.

DUI Defense Attorneys Hired – Charges Filed
On Tuesday, August 2, Mel Gibson hired the prominent law firm of Tarlow & Berk to represent him in connection with his DUI arrest in Malibu. The legal defense team from West Hollywood, California has represented numerous celebrities, including Courtney Love, Tracey Morgan, Lindsay Lohan and Halle Berry.

Wednesday afternoon the Los Angeles County District Attorney’s office formally filed misdemeanor charges against Gibson for driving under the influence (DUI) and having an open liquor bottle in his car. If convicted, he faces up to six months in jail.

Gibson is scheduled to appear in court on September 28, though his attorney may appear in his place. Prosecutors will decide this week whether he will face any charges relating to the DUI arrest.

Mel Gibson Arrested for DUI in California

The Los Angeles County Sheriff's Office released information stating that Mel Gibson was arrested July 28 in Malibu, California. Gibson has been charged with Driving Under the Influence (California DUI).

According to sheriff's office spokesman Steve Whitmore, the Academy Award winning actor and director was stopped 2:30 Friday morning on Highway 1 - Pacific Coast Highway. The arresting officers reported that
Gibson was driving his Lexus automobile at an "excessively fast speed." L.A. County officers placed Gibson under arrest on suspicion of driving under the influence (California DUI) after administering a field sobriety test.
The results of that test are not available. Whitmore said that Gibson was charged with a misdemeanor California DUI and released on $5,000 bond.

Mr. Gibson (50) was not immediately available for comment, but Saturday released a statement of regret for his actions and statements made during the DUI arrest.  Gibson also stated that he has battled alcoholism before.

Mel Gibson acted in the ‘Lethal Weapon’ series, won Best Picture Oscar for "Braveheart" and produced and directed "The Passion of the Christ." His latest movie, "Apocalypto" is due to be released in December 2006.
