<p>The Huntington Beach city council has voted against a proposal that would have allowed the police department to post mug shots on Facebook of those arrested for DUI in California. One council member had recommended posting the names and faces of repeat drunk driving offenders on the social networking site in an effort to shame them into changing their behavior. His original goal was to post photos of all accused of DUI in California.</p>

<p>The police opposed the plan, saying it would alienate the area residents. Council members voting against the idea said it would damage the city’s image and potentially embarrass family members who were not involved with drinking and driving. California DUI criminal defense lawyers and privacy advocates were concerned about the posting of suspect photos on-line, citing a presumption of innocence until proven guilty.</p>

<p>Huntington Beach and its ocean front location draws many to its downtown bars and restaurants. The city, with a population of 200,000 has the highest ranking in the state for alcohol related traffic deaths among cities of similar size.</p>

<p>Officers and paramedics in the Baldwin Hills area of Los Angeles were dispatched around 1:30 am after reports of a bicycle/vehicle accident. While investigating the scene, the officers observed a group of 15 bike riders using both the north and southbound lanes. None of the cyclists were wearing safety helmets and dim lighting made them vulnerable to passing motorists.</p>
 
<p>The California Highway Patrol officers decided to stop the group and conduct field sobriety tests to check for intoxication. Five riders, including the one involved in the accident, were cited for 'operating a bicycle while under the influence' and released. Under California DUI law, drunk bicycle riders are subject to a fine of up to $250 and incarceration until the suspect sobers up. The arrest is noted on a criminal record but does not impact one's insurance or driving record.</p>
 
<p>The suspects ranged in age from 18 to 22.</p>

<p>A California Highway Patrol officer stopped a truck in Riverside County on suspicion of DUI. The vehicle was occupied by two men, and a brown and white female goat in the front passenger seat. The man in the back seat attempted to run away but "fell flat on his face." Neither man claimed ownership of the goat, leading officers to suspect that the animal had been stolen.</p>
 
<p>The Department of Animal Services took custody of the goat, and it is reportedly resting comfortably at a county animal shelter.</p>
 
<p>Neither the identities or the criminal status of the men are known.</p>

<p>Actress Jaime Pressly was stopped in Santa Monica around 11:00 Wednesday night on a traffic violation and charged with driving under the influence in California after failing a field sobriety test.</p>
 
<p>Pressly was taken to the Santa Monica jail where bail was set at $15,000. That is significantly higher than the average bail for a CA DUI offense.</p>
 
<p>Pressly, 33, co-starred in the NBC hit 'My Name is Earl' between 2005 and 2009, earning an Emmy for her role in 2007.</p>

<p><strong>UPDATE: Actress had blood alcohol content nearly three times the legal limit</strong></p>

<p>The result of a breath test conducting during Jaime Pressly's arrest for drunk driving in Santa Monica showed that she had a BAC of .22%. The legal limit for intoxication in California is .08%.</p>

<p>Pressly was stopped for a traffic violation around 11:00 pm on January 5. After being booked for California DUI, the star of 'My Name Is Earl' television series spent the night in jail before posting $15,000 bail.</p>

<p>The California Highway Patrol announced that it made 499 arrests for driving under the influence across the state on New Years Eve. That is a drop from 527 CA DUI arrests made in 2009. The arrests were made during a 12-hour window between 6:00 pm Friday and 6:00 am Saturday.</p>
 
<p>In the Bay Area, 64 motorists were charged with DUI in California, down from 92 last year. 108 were charged with drunk driving in Los Angeles and 60 were charged with DUI in San Diego.</p>

<p>Last December 12, an 18-year old driver of a Ford Focus ran a stop sign, hit a curb, crashed through a fence and ended up stuck between two houses, five feet off the ground. Police in San Pedro speculate that the driver never hit the brakes.</p>
 
<p>Neither the driver or a passenger in the Ford were seriously injured. The driver was charged with driving under the influence in California.</p>
 
<p>Both houses were significantly damaged. One had recently been sold and the owners had planned to move the following week.

<p>Mario Elie, assistant coach for the Sacramento Kings basketball team, has been arrested for suspicion of driving under the influence in California. Around 1:15 Thursday morning, California Highway Patrol stopped Mario in downtown Sacramento for having a broken taillight on his 1993 Mercedes. The officer said he detected alcohol and signs of impairment, and asked Mario to submit to a series of field sobriety tests. Mario reportedly registered a blood alcohol content above 0.08%. He was booked on charges of CA DUI at the Sacramento County Jail.</p>

<p>Mario, 47, is a first year coach with the Kings. He played for seven teams in the NBA during an eleven year career.</p>

<p>A woman suspected of drunk driving lead police on a high speed chase from East LA to Garden Grove late Monday night. The incident began around 11:12 pm on the Long Beach Freeway when the unidentified driver of a Toyota Corolla failed to yield and fled from a California Highway Patrol officer. At first hitting speeds of 90 mph, the chase continued on the San Gabriel River Freeway and the Santa Ana Freeway at speeds of up to 120 mph.</p>
 
<p>The chase ended at 11:44 pm on Garden Grove Boulevard, west of Knott Street. The driver was arrested for several traffic offenses and for driving under the influence in California.</p>

A DUI safety campaign will be deployed, including public education, as well as saturation patrols, stakeouts and sobriety checkpoints to target motorists driving under the influence. In addition, deputies will execute warrant searches against repeat offenders and conduct court stings looking for those who drive after having their license suspended for DUI in California.</p>

<p>An on-duty Merced police officer in a marked cruiser stopped at a traffic light was struck by a suspected drunk driver early Saturday morning. Around 2:00 am, Crystal Genel was driving a 2001 Lincoln LS northbound in the southbound lane of the street. Genel lost control of her vehicle on the wet roadway, traveled across the northbound lanes and crashed into the front of the patrol car. No one was injured in the incident.</p>

<p>When alcohol was considered to be a contributing factor, the Merced Police summoned the California Highway Patrol to the accident scene to conduct a DUI investigation. Genel, 29, was determined to be driving under the influence in California and was booked at the Merced County Jail.</p>

<p>California Highway Patrol officers responded to reports of a single vehicle accident in Santa Rosa Tuesday night. They found a Toyota pick-up truck on its side in the roadway. Firefighters who had arrived on the scene first told the officers that the driver had walked off down the street. The driver, Brandon Cheney, was soon found and he reported that his truck had been stolen and he had been running after it. The officers did not buy the story and initiated a drunk driving investigation. Cheney failed to walk in a straight line and was soon under arrest for driving under the influence in California.</p>

<p>As the scene was being cleaned up, a woman drove up in a Volkswagen Passat and said she had received a phone call from her boyfriend  Cheney  saying that he had been in an accident. Something aroused the officers' suspicions and they asked the driver, Jennifer O'Neal, to submit to a field sobriety test too. She too was determined to be driving impaired.</p>

<p>Cheney, 23, and O'Neal, 29, spent the night in the Sonoma County Jail. Cheney has two prior convictions for California DUI on his record, as well as arrests for street racing and driving with a suspended license.</p>

<p>A copy of the same information is also available by presenting identification to the Forensic Sciences Laboratory in the Ventura County Government Center.</p>

<p>The California Highway Patrol has announced a decline in the number of traffic fatalities involving drunk driving. The total was tabulated after a year long DUI and safety enforcement campaign that ended in October. It is the fourth year in a row that the figure has dropped.</p>

<p>Starting in October 2009, the Border-to-Border DUI initiative conducted by CHP sought to reduce alcohol related deaths and injuries on state highways. The effort included more than 50,000 hours of enforcement patrols, 240 sobriety checkpoints and 100 California DUI task force operations. A total of 1,900 arrests were made for driving under the influence in California. In addition, CHP conducted a statewide media campaign on the dangers of impaired driving, made numerous traffic safety presentations and supported Designated Driver Programs.</p>

<p>The Border-to-Border campaign was funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.</p>

<p>55-year old John Poshepny of Kenwood was arrested for California DUI around 7:50 pm Saturday night. California Highway patrol officers stopped Poshepny after he left the parking lot of a local market and drove down the road. The mower was not equipped with lights.</p>

<p>Poshepny had a bottle in a brown paper bag and his breath smelled of alcohol. He also staggered and had slurred speech. He was booked on misdemeanor driving under the influence in California at the Sonoma County Jail and released. Poshepny has no prior CA DUI arrests and he had a driver's license. While he only lives two blocks from the market, he said that he occasionally uses the mower to get groceries.</p>

<p>All motorized vehicles and bicycles on public roadways are subject to California DUI laws, and the operators must have a valid driver's license and registration.</p>

<p>Sacramento County District Attorney Jan Scully elected to dismiss at least 79 cases of suspected driving under the influence in California after an investigation into the conduct of a local police officer. A deputy district attorney was reviewing videotape evidence of a CA DUI arrest when he noticed substantial differences between the footage and Officer Brandon Mullock's written arrest report.</p>

<p>Scully opened an inquiry and determined that Sacramento Police Officer Mullock, 24, had likely falsified at least one piece of evidence in each of the 79 cases that were dismissed. According to the DA's office, the discrepancies included legally unsound decisions to detain motorists, wild inaccuracies in field interviews and misuse of preliminary alcohol screening.</p>

<p>California DUI defense lawyers suspect that quotas, overtime pay, awards and possible promotion contribute to an officer's observations and actions when it comes to touchstone issues like drinking and driving. Evidence, they claim, is susceptible to interpretation, and, as proved by Mullock, falsification.</p>

<p>Scully said that prosecutors must not simply seek to win a case but to proceed only when there is trustworthy and legally obtained evidence. He cited it as a fundamental part of the US system of justice. The District Attorney's office is working with the defendants to help remedy the damage with insurance companies and employers caused by the falsely obtained DUI convictions.</p>
