California Gov. Schwarzenegger Signs Unique DUI Bill - AB 808 "Ambriz Act"

CALIFORNIA: Press release today from the Gov. Schwarzenegger about new signed legislation on DUI's and underage drinking.

Governor Arnold Schwarzenegger signed the AB 808 Ambriz Act into law requiring anyone getting or renewing a California driver’s license to first sign a statement acknowledging that drunk driving can be dangerous.

Under the new legislation, if a motorist who signed the statement is involved in an accident resulting in death while driving under the influence, prosecutors can claim the motorist acted maliciously. Before the new bill was enacted, a drunk driver could only be found acting recklessly.

The act is named after Steve Ambriz, an Orange city councilman who was killed last year by a drunk driver who was found guilty of gross vehicular manslaughter.

The bill’s author hopes it will facilitate the filing of second-degree murder charges against drunk drivers responsible for alcohol related traffic fatalities.

This law sucks. You can get a dui charge just thinking about drinking. This should be manslaughter only.

When it's your wife and kids that have been killed by a person who has a long history of drunk driving second degree murder charges do not sound to harsh.

This is unbelievable. You act maliciously just because you sign a statement saying you know drinking and driving is harmful. Drunk driving laws are out of control. MADD has lobbied and paid off many politicans to enforce their acts of vengence. Vengence is not justice. There are many other crimes that need more stigent laws this focus on drunk driving is absurd!
