California Gov. Schwarzenegger Signs Unique DUI Bill - AB 808 "Ambriz Act"

Governor Arnold Schwarzenegger signed the AB 808 Ambriz Act into law requiring anyone getting or renewing a California driver’s license to first sign a statement acknowledging that drunk driving can be dangerous.
Under the new legislation, if a motorist who signed the statement is involved in an accident resulting in death while driving under the influence, prosecutors can claim the motorist acted maliciously. Before the new bill was enacted, a drunk driver could only be found acting recklessly.
The act is named after Steve Ambriz, an Orange city councilman who was killed last year by a drunk driver who was found guilty of gross vehicular manslaughter.
The bill’s author hopes it will facilitate the filing of second-degree murder charges against drunk drivers responsible for alcohol related traffic fatalities.
