California DUI Laws Require Proof of Insurance SR-22 Form

California requires the proof of insurance form SR-22 resulting from a DUI. The requirement to show proof of insurance comes in the form SR-22. This is a Department of Motor Vehicle form (similar to SR-1). The only difference is the SR-1 is required when you have an accident or are ticketed for not having proof of insurance, the SR-22 is for DUI!

So, it is 'known' by the person you are asking, that the SR-22 is in most cases for a DUI. The Department of Motor Vehicles will not accept any other form (policy, identification card, etc.) as a substitute for the SR-22.

An SR-22 is required by all those persons arrested (or convicted – you don’t have to be convicted to get a restricted license) for a DUI in California and who are in a program and who want to get a restricted license.

To get a restricted license after being arrested for a DUI you have to do 3 things.

1. Pay a re-issue fee of $125.00
2. Show proof of financial responsibility (SR-22)
3. Show proof of enrollment in approved DUI program.

Other situations where you will need to show an SR-22 to the DMV to have your license returned:

1. Those convicted in the court of a DUI in California and sent to a DUI school. If the four months is not up by the time the DMV receives notice from the court of your conviction, then the requirement to show an SR-22 goes into effect.

2. Those who had their licenses restricted by the court of a California DUI or “Wet Reckless”.

Proof of insurance must be maintained for a period of three years (from the date the original 4 month suspension would have been up). Proof of insurance WILL stay active (and you need not re-submit an SR-22) if you do not cancel the policy or get dropped during the 3 year period. The insurance policy that the SR-22 is filed under must remain in effect. If for any reason your policy is no longer in effect the insurance carrier is REQUIRED to notify the DMV. The DMV will then notify you that by a certain date you will have to file another SR-22 with them or your license will be suspended.

your finished paying after 3 years that's the law, just stop paying insurance of you want or get a cheap cheap new rate,, dump the company now and tell them too shuv it up their ass,, that is their privaledge now,, hahaha,, i fuckin have to start that shit soon, and i want to kill a counselor who thinks she can bust my balls and not have any consequences for her actoions but their will be,, soon enouph. they are not God !! they are not in control !! they are not my sourse of life and lively hood,, i will retailiate soon enouph,, revenge is so sweet.

Whoever posted they got the best deal @ www.drivewestinsurance.com was obviously an agent or the owner. I did plenty of research and their prices are about as high as they get. Do yourself a favor and do the extra research and find a place not charging you broker fees which go straight in their pocket.

If someone doesn't want to get a restricted license is the SR22 form still required? Or is it only required for DUI offenders if they still want to be able to drive?

People who don't want to get their lic. back or have the privilege to drive often do not file a SR22. The DMV will keep your license suspended. I just had some guy call me yesterday that had a DUI in 1997. He just reinstated his drivers lic. so he will pay a surcharge for 3 years due to the suspension. SR22's are cheap. just got out of court on 10th. had a pulic defender and for the most part she was ok.i plead out guilty at my arraignment. now when she was explaing the 3 things i need to do for my restricted lic. she said you need a sr22 and i ask her if i already have full coverage insur(more than minium) do i need to get other insur? she said no that if i already had full coverage that is basically sr22 and that is dmv lingo.my policy is paid thru jan 15.my ques is could i go into dmv with my proof of policy and other2 things &get my restr lic? and wen i renew my policy just go in & show them that im still covered and just keep doing that? i know sombody out there can answer this & thank u for your time in reading & responding.

If you are currently insured many carriers will endorse a SR22 filing on your current policy. This will suffice the DMV requirement. You current carrier will usually charge for the filing until the end of your policy term. Usually $15-25 for a filing fee. Any thing more them this you should shop around right away. After your policy term is when the DUI will become chargable on your insurance. This is when you must be a wise consumer and shop your rate. Most carrier have a huge surcharge for a DUI conviction. I have been calling every single insurance company for the past two weeks and i have received more than 50 quotes, I finally hit the jackpot today, i called MIS Insurance and I got a sr22 insurance for $33 a month, Most companies I called, they were trying to charge me two or three times more, I am so grateful that I found them, I will recommend them to everyone who has the similar problem like me, give MIS Insurance a call 877-611-4647

I have had an sr22 with filemysr22 for 2 years, I shopped around a lot, but ended up getting the lowest price with this company. I started without a car, got my license and then switched to a car policy...it was easy and I did it over the phone and internet.

I was arrested for a DUI on July 24th, so my initial 4 month suspension was up last month. However, my court case is still dragging on. My next court appearance isn't until March. Since I haven't been convicted (not yet, at least), can I get my license back without an SR-22?

Bad news dude! Just went through it. Finished my 4 months in early December, arrested on 3/12/11, but convicted on 1/9/12. If convicted (very likely, no matter your circumstances, short of BAC being retested as significantly different than that in the police report), you will get a sentence from the court. This sentence IS INDEPENDENT from that of the CA DMV. You've got to serve BOTH sentences. The court will award a 6 month suspension, the DMV only 4 months. The DMV will give you a four month credit towards your six month court awarded suspension (from your previously served DMV awarded suspension). You can get a restricted license during your suspension. In my case, I have to additionally provide proof of completion of a nine month DUI class to get rid of the restriction. You likely have to do so also, but also likely have only a 3 month class.
