.08 BAC in Every State

A person can be considered driving under the influence (DUI) or driving while intoxicated (DWI) if his/her blood alcohol content (BAC) is above the legal limit. In the US, that limit - .08% - was suggested by the National Highway Traffic Safety Administration (NHTSA) in 2000 (see the NHTSA .08 BAC Illegal per se Level Document (pdf download)). With Minnesota's .08 BAC legislation taking effect in August 2005, all 50 States, the District of Columbia, and Puerto Rico have enacted .08 BAC laws. The law in Michigan contains a sunset clause which states that the legal BAC will revert to 0.10 on October 1, 2013.
