Alabama Man Nabbed With 23 Cases of Beer in Car
Driver also charged with drunk driving in Alabama
Police conducting a roadside investigation of a suspected drunk driver found 23 cases of beer in the vehicle. Ramiro Martinez Santos was arrested around 9:00 pm by the Albertville Police Department. He was charged with driving under the influence in Alabama and felony transportation of alcohol. Santos, 35, was booked at the Albertville City Jail.
Under state law, a person can only transport up to 5 gallons of alcohol without a special license.

144 Alabama DUI Arrests Over Thanksgiving Holiday
'Take Back Our Streets' initiative conducted during extended weekend
The Alabama State Patrol said it made 144 arrests for driving under the influence during their 'Take Back Our Highways' safety campaign. Conducted over the long Thanksgiving weekend, extra patrols were used to target drunk driving, speeding and seat belt violations.
The initiative started at 6:00 pm Wednesday and ended at midnight Sunday. In addition to the Alabama DUI arrests, 3,087 speeding tickets and 793 seat belt or child restraint citations were issued. 412 accidents were investigated that left six dead.

Drunk Illegal Immigrant Crashes Into Patrol Car in Alabama
Sheriff's vehicle is totaled in Alabama DUI incident
Sheriff's deputies in Madison County report the arrest of a man for DUI in Alabama after he crashed into a patrol car. A deputy had pulled over a driver with outstanding warrants around 1:00 am and a back-up patrol car parked behind them. Hernandez Donaciano then drove his Nissan Pathfinder into the rear of one of the patrol cars, ramming it into the other.
The deputies were not in their vehicles at the time of the crash, and no one was injured. One sheriff's department vehicle was totaled and the other received minor damage.
Donaciano refused to submit to a breath test though he failed a field sobriety test and was booked on charges of driving under the influence in Alabama. He was also charged with three counts of reckless endangerment, driving without a license, failure to have insurance, violating an open container law and for failure to provide safe space for a stopped law enforcement vehicle.
It was determined that Donaciano, 51, is in the country illegally, and the Department of Immigration and Customs Enforcement requested he be held in jail pending additional charges.

Troopers Instructed to Make More Alabama DUI Arrests
State troopers at Birmingham post threatened with punishment if they didn't make arrests
A March memo from the acting post commander to state police at a Birmingham post threatened troopers with punishment if they did not make at least three Alabama DUI arrests before the end of the month. The number of tickets issued for suspicion of driving under the influence in the Birmingham area doubled.
Troopers defend the memo, which threatened shift assignments and opportunity for over-time pay if the apparent quotas for drunk driving citations were not met. They say it was simply a poorly worded email to motivate troopers to target impaired drivers on Alabama roads. The memo was issued to corporals in Jefferson, Blount, Shelby, St. Clair and Walker counties, and some forwarded the memo to troopers at the post.
Alabama DUI defense attorneys cite this as another example of a positive cause impacting innocent drivers. With perceived quotas, troopers will be inclined to create evidence or arrest details to justify the traffic stop.
The author of the memo retired in May and was not available for comment.

Traffic Safety Program Nets 362 Alabama DUI Arrests
'Take Back Our Highways' campaign conducted over 10 days
Alabama law enforcement agencies recently conducted a traffic safety initiative called 'Take Back Our Highways' that led to a reduction in traffic fatalities. The Department of Public Safety announced that over the 10-day campaign that ended on Memorial Day, there were 16 fatalities, a drop of 11 from last year's total during the same period of time.
The safety effort included Alabama state troopers, local police departments and sheriff's departments, as well as troopers from Florida, Georgia, Tennessee and Mississippi. About 200 additional officers were placed on patrol, over and above the number assigned to regular patrols. The focus was on those speeding, not wearing their seatbelt, following too closely, failure to yield the right of way and driving drunk in Alabama.
The DPS director credits the safety campaign with changing driver behavior, pointing out that an estimated 300 lives have been saved since the 'Take Back Our Highways' program was started in 2007. During the 2010 effort, a total of 24,755 arrests were made. This included 6,907 for seatbelt violations, 8,286 for speeding and 362 for driving under the influence in Alabama.

Police Chief Nabbed for Alabama DUI
Active police chief arrested at his home in Florence Alabama.
A police chief in the northern part of the state has been charged with driving under the influence in Alabama. Tony Logan was arrested at his home in Florence on Saturday afternoon. Police responded to a call from a witness reporting a vehicle striking a mail box and causing other damage. The police report indicates that the arresting officer determined that Logan was drunk, and filed charges of AL DUI.
Logan is the Chief of the Tuscambia Police Department. A defense attorney representing Logan hoped that people would understand what happened, and was seeking favorable disposition of the DUI.
Logan is on leave of duty. He has been the Tuscambia Police Chief since July 2008.

Teacher Arrested for Alabama DUI on Way to School
Former teacher of the year was seen drinking from a cup while driving.
A teacher on her way to work September 1 was arrested for suspicion of driving under the influence in Alabama. Around 8:00 in the morning Suzanne Morrison was observed driving erratically on Interstate 10 and drinking from a cup when she was stopped by law enforcement officers. The officers detected a strong odor of alcohol and initiated a DUI investigation. A cup with alcohol was found in the vehicle and Morrison failed a field sobriety test. She also submitted to a breath test though the results are not known.
Morrison is a former Teacher of the Year at the Chickasaw School of Mathematics and Science. She was reportedly on her way to work for the Mobile County School System when the traffic stop was initiated. Morrison was booked on charges of DUI in Alabama at the Mobile County Metro Jail. As of Tuesday evening she remained in jail on $1000 bond.
The county school system said that Morrison, 42, had been placed on administrative leave until completion of the police investigation and the breath test results for confirmation of intoxication.

State Senator Charged with Alabama DUI
Senate majority leader Zeb Little arrested for drunk driving near Birmingham.
Democratic State Congressman Zeb Little was arrested by State troopers last Friday for suspicion of drunk driving in Alabama. Little was involved in an accident on Interstate 65 in Jefferson County and then fled the scene and had to be pursued and stopped. The officer detected alcohol and Little was charged with the offense of driving under the influence in Alabama.
Little was also charged with failure to stop for an emergency vehicle, having an open container in his vehicle and driving with an expired license. Little was booked at the Jefferson County Jail, where he refused to submit to a breath test. He posted bond and was released after about an hour in lockup.
Little is the majority Senate leader in the Alabama state Congress. He issued a statement apologizing to his family and constituents and stating that Alabama DUI is a terrible offense. He went on to say that he will take full responsibility for his actions.

Alabama DUI Attorney Graduates form National College of DUI Defense
Birmingham drunk driving defense lawyer Jo also receives certification in standardized field sobriety testing.
Birmingham Alabama DUI defense attorney Louise Duckwell recently graduated from the National College of DUI Defense (NCDD) after attending specially focused summer sessions at Harvard Law. The NCDD program was developed to help DUI attorneys develop and hone their legal skills and thus better defend clients accused of driving under the influence.
Duckwell also obtained certification from the NHTSA in the administration of standardized field sobriety tests after completing courses in Seattle, Washington. The test training is the same as that received by law enforcement officers. Since officers use field sobriety tests to determine suspected drunk driving, it is important that a DUI defense lawyer understand where and how errors in making that determination may occur.
Duckwell received her law degree from the Cumberland School of Law at Samford University. She is a member of the Kreps Law Firm, which focuses on defending those accused of driving under the influence in Alabama.

Alabama Highway Crackdown Nets Over 21,000 Tickets
State-wide campaign targeted traffic offenses, including Alabama DUI.
Alabama State patrol troopers have concluded their state-wide traffic blitz. Titled ‘Take Back Our Highways’, the seven day campaign ended last Sunday night. In total, troopers handed out 21,701 traffic tickets and 2,318 warning tickets. 40% of the tickets were issued for speeding. 203 motorists were charged with driving under the influence in Alabama.
The totals also indicated 577 highway accidents and 12 deaths across the state.
This is the second year that the Alabama Department of Public Safety has conducted the campaign.
