Celina Ohio DUI Checkpoint

Law enforcement groups combined efforts to catch drunk drivers.

Several law enforcement agencies recently combined forces to target drunk driving in Celina, Ohio. On Friday, September 11, the Celina Police Department, the Mercer County Sheriff’s Department and the Ohio State Patrol conducted both a sobriety checkpoint and saturation patrols to catch those suspected of driving under the influence in OH.

Members of the Coldwater Police Department, Rockford Police Department and the Ohio Division of Parks assisted in the Celina Ohio DUI crackdown.

Really odd drunk driving news – 'Vehicles'

Lawnmower and an Illinois DUI – Dennis Cretton of Belleville in southwest Illinois had his driver's license revoked for a drunk driving conviction. He though he could get around the situation by taking his yellow riding mower for a drunken spin to a local gas station for beer. He reportedly weaved through traffic and later tried to evade police while cans of Milwaukee's Best beer were spilling out of a 12-pack. Cretton, 49, was arrested for felony aggravated DUI in Illinois.

Lawnmower and a New York DWI – Randy M. Elliot of Conklin was stopped by police for drinking beer while operating a lawn mower on a public roadway. After registering a blood alcohol content of .28, three and a half times the legal limit, the 47-year old was charged with driving while intoxicated in NY.

Ambulance and Texas DWI – Lawrence Eugene Reyes Jr. of Richards took off with an ambulance while paramedics were attending to a patient inside a Bryan hospital. The 25-year old abandoned the ambulance, undamaged, a few miles away and he was apprehended a few hours later. He was booked in the Brazos County jail for public intoxication, theft and evading arrest. Charges of driving while intoxicated in Texas are being considered.

Backhoe and Ohio DUI – Robert Tite was charged with Ohio DUI a few months ago for driving a bulldozer through his neighbors yard. The 57-year old was stopped again for operating a piece of heavy equipment while intoxicated, this time for driving a backhoe into town. He rolled through a stop sign before pulling up in front of a business in the center of Wakeman. Tite, who appeared confused at the time of arrest, failed a field sobriety test and refused to submit to a breath test. He was booked at the Huron County jail for operating a motorized vehicle while intoxicated.

Really odd drunk driving news – 'Parallels'

Naked Driver Charged with Florida DUI – Police approached a truck parked on the shoulder of the road because it was partially blocking traffic and they discovered the driver, Dearry Smiley, was naked. Smiley asked the officer, "What's wrong with a man driving home naked? It's not against the law." The arrest report clarified that the 58-year old from DeFuniak Springs wasn't actually naked because he was wearing a hat, sandals and sunglasses. He was, however, considered to be driving under the influence in FL and was arrested. A female passenger, who was clothed, was charged with felony battery after hitting a deputy with her fist as he tried to remove her from the vehicle.

Nearly Naked Driver Charged with Maryland DWI – Police stopped Jonathan Schultz for speeding and discovered he was "driving commando". The 41-year old from Delaware was wearing a shirt and had a towel partially covering his lap. He claimed he had lost his pants and the deputy found none in the vehicle. Schultz was charged with driving while intoxicated in MD.

Heavy Equipment and an Ohio DUI – Robert Tite was arrested for drunk driving in Ohio while operating a bulldozer. He had driven the heavy equipment onto a neighbor's property and uprooted trees while creating a swath of destruction. The 57-year old Huron County man was also charged with criminal damage and resisting arrest.

Heavy Equipment and Drunk Driving Arrest in Germany – After his girlfriend reportedly left him at a nightclub, a 23-year German man decided to steal a large tractor to drive himself home. He lead police on a slow chase for over 40 minutes, resisting officers holding stop signs and pepper spray shot through an open window. The tires proved too thick for stop strips and police finally resorted to shooting out the tires after the man rammed a police car and another vehicle. He was immediately arrested for drunk driving and several other violations.

Holiday Deaths in Ohio Lowest in Decade

Number of traffic fatalities over Fourth of July holiday lowest since 1998.

The Ohio State Highway patrol released figures indicating that the number of traffic fatalities over the Fourth of July holiday were the lowest in more than a decade. There were five fatal crashes over the extended weekend, the lowest number since 1998. Last year there were 15 people killed on Ohio roads during the same period of time.

Law enforcement agencies across the state used saturation patrols to combat speeding, reckless driving, seat belt violations and DUI/OVI in Ohio. A total of 556 motorists were charged with driving under the influence in OH during the holiday.

Police Shift Tactics Against Ohio DUI/OVI

Roving patrols allow police to cover larger area seeking drunk drivers in OH.

Law enforcement agencies across the state are regularly employing a different tactic in their pursuit of suspected drunk driving in Ohio. Police are utilizing saturation patrols, rather than sobriety checkpoints or speed traps, to target OH DUI. This past Fourth of July holiday saw just such plans put into effect by both state highway patrol and sheriff’s department troopers.

DUI checkpoints have been a common tool of law enforcement since being allowed by a 1990 U.S. Supreme Court decision. However, it is required by law that the location of such checkpoints be made public in order to balance constitutional rights against unreasonable searches and seizures.

Saturation patrols allow officers to cover a much larger area and to less obtrusively target locations with statistically higher numbers of arrests for driving under the influence on Ohio. In addition to searching for signs of impairment, the patrols use moving violations such as not wearing seatbelts, breaking traffic laws and failure to maintain proper speed to initiate a traffic stop.

Really odd drunk driving news – Multiples

1 traffic stop, 2 Indiana DUI arrests – State trooper stopped 19-year man for speeding and then arrested him for drunk driving in Indiana after determining his blood alcohol content was 0.17%. Troopers contacted the man’s father, the county coroner, to retrieve the vehicle. When the father arrived, he too was arrested for Indiana DUI after registering a BAC of .10%. Father and son were both booked on charges of driving while intoxicated.

2 Minnesota DWI charges in 2 hours – Lake Forest police stopped Michael Douglas Johnson for a traffic violation and was ticketed for fourth-degree DWI after registering a blood alcohol content of 0.15%. The time was 12:34 am. Rather than having the police tow the vehicle, a sober friend agreed to move it. However, at 1:49 am, Johnson was observed driving his truck at 15 miles per hour under the speed limit. He was stopped again and charged with a second fourth-degree MN DWI. He also spent the night in Washington County Jail.

1 day, 2 New York DWI arrests – Joseph Babbie was arrested by State Police for suspicion of drunk driving in New York at 2:22 a.m. Saturday. He was arraigned on a felony driving while intoxicated charge and released on his own recognizance. He was arrested again at 9:52 p.m. Saturday after taking a car without permission. Babbie was booked for his fourth NY DWI offense in 10 years and remanded to the Clinton County Jail.

3 Ohio DUI arrests in 6 days – Tammy Webb, 43, was arrested for driving under the influence in Ohio on April 1. The next day she was charged again with OH DUI. Her third arrest came April 6 when she stopped at a fire station at an auto plant to ask for directions. Police say that initial chemical tests did not reveal alcohol in her system during any one of the three incidents, though she was impaired and confused at the time of her arrests. Tests are being conducted to determine drug ingestion. Local law enforcement officers don't recall ever arresting one person so often in such a short period of time.

Eric Carmen Sentenced to Jail for Ohio DUI

Former 'Raspberries' singer to spend 30 days behind bars.

Eric Carmen was sentenced to 180 days in jail for driving under the influence in Ohio, though he will only be required to serve 30. The judge showed little leniency however in doling out additional penalties.

Carmen was arrested for OH DUI in the Cleveland area after crashing into a fire hydrant. He reportedly handed the officer a credit card instead of his driver’s license. His blood alcohol content registered .23%, nearly three times the legal limit for intoxication.

Carmen was also fined $1000, charged $362 for court costs, ordered to enroll in an alcohol treatment program, required to install an ignition interlock device and ordered to begin his jail sentence on April 25. He lost his driver's license until September 9 and will have to undergo regular testing to ensure that he does not drink alcohol for 12 months.

This is Carmen's second offense for drunk driving in Ohio. In 2007, Carmen was arrested after striking a mail box and a sign.

Carmen is the former lead vocalist for the 'Raspberries', recording the band’s biggest hit 'Please Go All The Way'. He also recorded the 80's hit 'Hungry Eyes'.

Really odd drunk driving news – Vehicles

Street sweeper and New York DWI – Gary Dye, 42, crashed a street sweeper while working in Dansville. A Steuben County Public Works Commissioner said that a ‘broom’ is “easy to use, it goes slow (and it) doesn’t get any simpler.” That didn’t stop Dye from causing over $10,000 in damage to the vehicle and suffering a head laceration. Dye was charged with suspicion of driving while intoxicated in NY.

Fire truck and Illinois DUI – An unidentified driver was arrested for drunk driving in Chicago after smashing into a fire truck that was responding to another crash. The man’s Honda bounced off the fire truck and smashed immediately in front of police and fire crews at the scene of the previous accident. The driver was charged with IL DUI, failure to yield to an emergency vehicle and several other offenses.

Barstool and Ohio DWI – Kile Wygle was ticketed by Newark police for drunk driving in New Jersey while he was on a motorized barstool. Wygle admitted to having had “more like fifteen” beers before crashing the barstool. OH DUI law prohibits people from operating any motorized vehicle while under the influence of alcohol or drugs.

Backhoe and Pennsylvania DUI – William Price was stopped for suspicion of DUI in Pittsburgh after driving a backhoe on the wrong side of the road and almost hitting a police car. Price registered a blood alcohol content of 0.13% and was charged with driving under the influence in Pennsylvania, driving under the influence with a high rate of alcohol, driving under the influence while operating a commercial vehicle and reckless driving.

Ohio to Buy Controversial Breath Test Device

Allegations of bid bias are raised.

The Ohio State Controlling Board authorized the purchase of 700 Intoxilyzer 8000 machines for testing blood alcohol content of motorists suspected of Ohio DUI. Nearly $7 million in federal grant money will be used to purchase the portable breath testing devices. The described intent of the purchase is to standardize the breath test equipment and procedure used to help catch drunk drivers in Ohio.

Concerns were raised during the decision making process because the manufacturer of the Intoxilyzer 8000, CMI Inc of Kentucky, is involved in several law suits with states over the equipment’s software. A suspicion of bid rigging has also been raised because the Ohio Department of Health official who wrote the state’s specifications for the device is friends with the president of CMI. An Ohio based firm that had previously supplied law enforcement with such equipment was excluded from the specification process. In fact, the process reportedly excluded all competitors.

The State Controlling Board voted unanimously to approve the acquisition. While acknowledging that the departments of health and public safety could have made a better case for the Intoxilyzer 8000, the legislators thought there was no reason not to buy the devices.

The Intoxilyzer 8000 will first be put into use in southwest Ohio. The handheld device will replace larger units now used to test for driving under the influence in Ohio.

New Breathalyzers Considered for Ohio DUI

Plan is to standardize breath testing equipment for testing drunk drivers in Ohio.

The Ohio Controlling Board a considering the purchase of new breath testing equipment for the state. The goal is to standardize the equipment used when testing driver’s for suspicion of driving under the influence in Ohio. Currently law enforcement agencies use a series of devices and techniques to test blood alcohol content or BAC. Both the Ohio Department of Public Safety and Department of Health are asking for the state to buy 700 Intoxilyzer 8000 machines. The Ohio State Patrol has also approved of the standardization of all breath test equipment for Ohio drunk driving tests.

The two state agencies say that the Intoxilyzer has been tested in a range of temperatures and climate conditions and been found to perform well. The concern is that the equipment has been the focus of several lawsuits recently. Judges in Florida, Arizona and Minnesota have ordered CMI, the Kentucky manufacturer of the Intoxilyzer 8000, to release the software code. To date the company has refused to do so and large penalties have been accrued. The software is the center of an on-going debate as to the accuracy of the breath test. Rather than being a static test with a single code version, each state has the latitude to define tolerances it finds acceptable. Drunk driving defense lawyers have challenged those variables and also claim that the manufacturer has changed the software authorized by the states without their knowledge or permission, leading to the possibility of false BAC readings.

Ohio Controlling Board is expected to announce a decision today.
